6:39 pm
6:40 pm
that's ((kelly--vo-)) it's a stand off with epic consequences. as we told it is a standoff with epic consequences. apple is fighting the f.b.i.'s order to break into the
6:41 pm
shooters. and the defiance has created controversy over privacy. let's bring in jeff brown. first of all, what is wrong with the government's request? >> this is where it is complicated and the public is split. if you are asking someone on the street and you said should the government get into an iphone to stop terrorism. everyone would say yes. nobody is disagreeing, there is of software where there is no back door. they are asking apple or having a judge tell apple they need to create the back door. and they are saying to them. you need to create this faster key, you tonight have it yet but create one for us. but you need to create it to get into the phone.
6:42 pm
problem with all of this lies they will be given the key and destroyed but it will be out there and everyone's phone may be hacked into, that's what apple is trial trying to prevent. prevent where they cannot control it and anyone can get into the iphone. >> even facebook has come out on apple's side at this point. is there a scenario here where both sides could get what they ultimately want? >> it's not as if on older phone this is very helped them get into them. they are willing to do that. >> there is no software that's created to allow apple to get into the phone. what the court is saying you have to create this. that's a step we don't get into.
6:43 pm
it is another when the court says and f.b.i. asking to you create something that has yet to be created. that's the problem that apple says we don't want to create this and be responsible for destroying it later on so nobody gets into it. everyone wants to know what is in this and fight terrorism. at what point is it more heavily wayed it is terrorism so forget privacy rights add big brother. let's do this. that's a tough question for most people that are thinking about this. we do want to fight terrorism but it is bigger than that. what happened if aim does not do that, they have until friday to respond. there will be something they file but could you always end up with contempt of court and have
6:44 pm
you're not doing it. i assume they will file a response and there will be some appeals, that's what would happen. but theoretically if they refuse to do it as a rule of law they could be held in contempt. you have to live in a society where we follow the rules. >> what will happen. who will win? >> this is a tough one. i don't think apple was going to allow themselves to be forced to to this. i think it is difficult to force someone to create something. one thing to say that you have the master key. give it to us. they say we don't have a master key, apple, you need to create one and allow us into the phone. that's a different thing to do to have a judge force someone to create it.
6:45 pm
