provokeed. >> according to the caregiver her puppy was simply being a puppy approaching padi out of curiosity when he was attacked. padi's owner claims the puppy was growling at his dog when padi, quote, nipped his ear. story. but the pictures of the injuries speak for themselves. there are teeth marks on the top of obi wan's nose from a bite his caregiver says came from dog. >> i thought it was going to be a normal meet and greet and the dog basically attacked him. >> reporter: tammy is afraid that four-month-old golden retriever she's training to be a service dog through new horizon could be scarred for life. >> having fear issues can take a dog out of the program. he is being trained to be a wheelchair support dog so he has to be able to go into neighborhood with other dogs. >> reporter: she took him to the pet clinic in bradenton monday morning to get his puppy shot. outside the exam room the puppy came face-to-face with padi.

latched on to the nose. >> reporter: chris says the doctor, padi's owner, dismissed the attack as minor. he did not want to speak on camera monday but claims the puppy was the aggressor growling nose to nose with his dog. last june he also claim add four-year-old boy provoked padi to bite part of his ear off. he says the boy wouldn't stop following the dog as he roamed the clinic. >> i suppose there are some dangerous dogs that the public has to be protected from. dog. >> padi was sentenced to be euthanized but gained international attention through a free padi facebook page. a sarasota judge ruled to spare the dog and padi's bill was passed at the state capitol. it protects met is accused of biteing from being put down. the caregiver says she does not want to see padi killed but after this second incident something must change. >> you have the dog who has a history of biting other dogs and

florida. but tonight he brought an optimistic message to the tampa convention center. and he left out any personal attacks that we have seen in take a look. this here is marco rubio here this evening at the tampa convention center. and rubio argued that conservatives need to not portray anger or fear. rather he says he can make up a current eight point deficit in one florida poll against trump by using momentum from a win in puerto rico. he admits that he flung his own personal attacks at trump several weeks ago but only because someone had to stand up to trump who he called a bully. just two weeks ago polls showed that rubio's deficit was much larger down by as much as 20 points to donald trump. >> we have to do it now. a turning point is coming. a turning point awaits in this election and for this country. and it begins here in florida.

florida always does. decide the nomination and decide the presidency. >> the story is the trend more than it is -- i mean, you know it can turn in two days let alone two weeks or another week before the primary. >> still ted cruz the senator from texas has run a solid second to trump in many primaries and caucuses and also in polls. and rubio would see trump's delegate lead grow to a nearly insurmountable 540 if trump can win florida and the 99 winner take all delegates. but if rubio could win, the deficit against trump would fall to as few as 240. obviously this is also rubio's home state so there are many reasons he cannot afford to lose here and rubio would not say whether he would leave the race if he can't win florida a week from tuesday when the final voting happens here in florida.

compromised. deputies found skimming devices instead two pumps. those devices steal credit card information from people pumping gas. here is a look at the devices. we're told they used blue tooth technology. that's how they send the information to the person who planted them there. they were installed at this 7-eleven mobile station on fruit vail road. deputies think they have been there at least two weeks before anyone realized it. >> these skimmers are inside the pumps so you can't see them you know. and if somebody looks at the pump if you don't know what you are looking for it might look like part of the regular electronics with the pump. >> deputies are trying to go over security video to see if they can see anyone installing those devices. so far no arrests in this case. new at 11, a tampa man making a plea to whoever has his dog to please bring her back. it's really a bizarre story. last month anthony says he let his two dogs out in his fenced backyard and they got out. neighbors tell him they saw a

with treats. the dogs were wearing collars and tags at the time so he hoped they would be returned quickly. a few days ago one of the dogs a pit bull named buck found his way home. but buck had on a brand-new collar with a brand-new tag showing a new name and unfamiliar phone number. >> i love my dog. she is part of my family. she is my baby. and i hope she comes home soon. i wish that the ladyer in picked her up or at least called the phone number on her tags. >> he is talking about his other dog who is still missing. by looking up the phone number on the tag he thinks the person who took the dogs is somebody who lives nearby in the neighborhood. at this point he hasn't pressed charges. the sheriff's office says the case is closed. he says he doesn't want any trouble he just wants emma, right there, back. >> basically a is put being worked out by a couple of neighbors at this point. >> hopefully so. hopefully emma comes home. >> we'll see.

big day in tallahassee. senators approved a bill that will allow floridians with terminal illnesss to use full strength medical marijuana. the bill expands a law that allowed cancer patients and people with chronic seizures like epilepsy to use a weaker form of the drug. the senate passed the bill today by a vote of 28-11. there was disagreement over the limited number of nurserys allowed to grow the medical marijuana. under the 2014 law, only five growers in the state could grow and sell cannabis. >> you are basically mandating that five families get wealthy. you are mandating and using the power of government to stop everybody else from getting into this cartel. >> several nurseries filed suit over that 2014 law and its limit of five growers. so the new bill will allow additional licenses to be granted to nurseries whose court challenges are successful. which means there could be more

stuff in the future. the bill is now awaiting the governor's governor's signature. florida has a death penalty. governor scott sign add revised death penalty bill. it requires ten out of 12 jurors to agree to put someone to death. the new law also prevents judges from imposing the sentence saying it must be the will of the jury. that's because in january the supreme court ruled florida's death penalty is unconstitutional because it allowed judges to override the jury's recommendation. two executions were delayed while the legislature worked on its fix. and this is the final week of the legislative session in tallahassee. lawmakers have to finish their work on the state's $80 billion budget by tomorrow so they can vote on friday. state law requires a 72 hour cooling off period before a final vote. the jury has awarded sportscaster erin andrews $55 million in her civil lawsuit. andrews sued the national hotel

over, dipping over the horizon. but it doesn't get much better than that. that picture by the way is on my facebook page. if you want to take a closer look you know where to find it. thanks a lot eric nicely done. today temperatures up near 80. we're not going to cool off at all. we're going to stay with a southeast wind. the forecasting dilemma is this weekend. there is going be a front that's producing rain in texas. it's back here and it's going to move across the gulf mexico. the models are struggling on the timing of when the rain will arrive. kind of focusing on saturday into sunday. we'll fine tune that forecast the next day or two. give you a heads up. high pressure north of us will give us a southeast wind. eventually a south wind. rain is heavy by oklahoma city. eventually rain will expand along the lower mississippi valley. and that rain is going to be locally heavy. right now 50s, 60s and 70s up and down the state.

night. 58 in atlanta. 64 birmingham. 65 little rock. 68 in new orleans. the dew points are gradually coming up especially in the western gulf. our dew point now is about 55. it's going to rise. and i think by thursday and friday i would not be surprised if the dew point kind of sits in that 65 to 70 range, maybe 70 or so briefly until the weak cold front goes by. has to turn muggy eventually with winds from the southeast. high pressure is east of us. we stay warm tomorrow. we stay warm on wednesday. in the low 80s. and then we just kind of wait and watch for this front back here. it's going to produce all kinds of weather trouble in the lower mississippi valley. that's going to head our way and probably arrive sometime on saturday. clear and mild tonight. we're down to 59. we've got sunshine tomorrow. it will be a warm day we're up near 80.

a harty run up dozens of flights of stairs in new york may be in jeopardy. this run is supposed to support the families of 9/11 victims. maybe you have heard of it. last year it was held in the new one world trade center for the first time. >> this year they're say saying it may not happen at all. fox's linda schmidt explains. >> it just really is upsetting, disturbing we're not even 15 years away from 9/11 and how people can treat it. >> frank siller is the ceo of the tunnel two towers foundation. it is best known for its yearly tunnel to towers run in honor of his firefighter brother stephen who died on 9/11. last year the foundation start add stair climb fundraiser. they had planned on doing it this year. in one world observatory which is part of one world trade. however the organization which manages the building has just said no. the event is two months away. >> they've been not getting back to us with 100 percent answer
