stars and the media and privacy 2013. it was 2013. radio mj and bubba the love sponge. and one of the lawyers was arrested for dui. an arrest that was uncovered as a set up by rival attorneys. and mj lost the case and never paid his legal bill and now the lawyers are suing to get paid from mj and they are counter suing. a lot is going on in the story. let's bring in the defense attorney to talk about this. crazy. what is your take on this? , well you know the gift that keeps on giving. the original lawsuit was ridiculous. the defamation suit he lost that. but what we're talking about here is a breach of contract. i'm sure there is a written contract that the lawyers had with mj outlining what they were to do and how they were going to
6:42 pm
not paying on that is a breach of that contract. that's what is going on now. they're suing the lowers. they are saying you need to follow the terms of the agreement of the contract that you signed. he is counter suing at this point and arguing some of the shenanigans and what went on was not what he wanted to see unfold but it is a breach of contract case. they will be awarded the money, we'll see it could last two weeks or so. >> and we want to get your opinion on the other case a big one for a couple of weeks now. the jury awarded hulk hogan 25 million in punitive on top of the $115 million verdict that stems from the sex tape posted on gawker. the money is astonishing. that's what people are talking about. >> you know what, one of the things you fear in the law this goes true for criminal cases as well as civil is what we call the run away jury. you have that in civil cases
6:43 pm
overwhelmed or caught up in the issue this is they should not be spending that much time on they come back with a verdict that's astonishing. and it happens in criminal cases you will see someone who you believe is guilty and the evidence suggests so yet they are found not guilty. you have those. and in criminal court that's the system. but in the civil system it's not the same. in the civil system the judge or the court has the right to turn that back and cut it down to something they believe is more appropriate. i think that what we're going to see is eventually the verdict will be cut back and not stand as $115 million. it has to be in line with the injuries that we see in florida. if a child was injured for the malpractice of a doctor and for the rest of their live they needed medical care you are see a verdict of $10 million tops. for this verdict of emotional pain and suffering to be 115 million.
6:44 pm
why you called it astonishing. the system will right itself and that will be cut back. >> the punitive damages you think that's in line? >> i think the punitive damages are in line. we expected that the damages would probably have been a dollar because it is hard to suggestion he is really emotionally or hurt by this and when he went on television and radio and talked about it. he didn't seem like he had the damages. the punitive though is a way to slap someone back when you say that your conduct is outrageous. if that's the conduct they felt was going on by gawker what they were doing was outrageous. stay. ky see that. the punitive damage claims make sense but 1,915,000,000-dollars to hogon or terry bollea, whoever is hurt, will stand, you think it was the focus on the
6:45 pm
gawker and not hulk hogan? , i think the lawyer, the lawyer did an amazing job for hogon. he was like a prosecutor, i thought he tried a great case. i think that reflects on the verdict. the lawyering was really out done by him. and the second part of this i request met be about bush i with met see it will -- the second part of this. ky not see that it -- i cannot see that it will stick. we're months away from hurricane season.
