on the night of tuesday, june 21st, he went too far. >>man: i saw him, i thought he'd leave but he didn't. i wound up shooting him four times >> >>reporter: his son tried to scare it off. >>man: this alligator was clean. it looked like someone put turtle wax on it. his teeth was even white. >>reporter: as family watched. >>man: it looked like he was shot out of a >>reporter: nasty injuries to his knee and calf and a broken neck from the way the gator whipped him around. he was in the hospital for ten days. that aggressiveness is why he had every reason to try to stop the alligator. after fwc trapped the alligator

he knew he couldn't just shoot it without a license. he was arrested thursday and bonded out after four hours. >>man: i was shocked because they told me i wouldn't be arrested. >>reporter: blanton said his lawyer, who is costing him $5,000 will argue that potecting him animals will trump the law. >>man: if you're put in jail just like you're a criminal. >>man: animals from an alligator that weighs over 400 pounds? >>reporter: the next court date is next week but he says his attorney is hoping to have the charges dropped before then. he does face jail time. the key word is that they're hoping that these charges will be dropped. >> do you think it had anything to do -- it looked like from the picture that they put the alligator in the back of the truck. could that have been what started this or was it actually

>>reporter: at this point, they said they cannot comment on this case. they do say you cannot just shoot an alligator without a license. obviously he feels he had a good reason for doing so because this is his property out here. so the court system is going to sort this out. >> how do you determine if the gator is chasing you. it will be interesting to see how this plays out. it's been an emotional day up and down florida's coast. lieutenant pete had lost his battle with colon cancer. he'd been a firefighter for 35 years. florida does not offer benefits to firefighters.

we'd sure like to know who it is, mark. this time it's a bird. can you believe somebody iris b. official wildlife thinks somebody did it on purpose. the thick painting so deep into the bird's feathers, it can't fly. it's now at a wildlife sanctuary. once all the new feathers come in, they'll be ae it. it comes on the heels of the two painted gopher tortoises. it's very troubling. not just because they're endangered but their shells are -- the chemicals in the paint can seep through causing internal damage. they also lose their camouflage against predators.

along and really did not meet up with a sea breeze. the storms get going on daytime heating over land and because there's no sea breeze on the coast, the storms don't intensify, they just move along. most of the activity at 5:00 was over the water. now temperatures now where they should be. i mean temperatures this time of year usually not remarkable. they kind of stay in the same future cast has a quiet night tonight. computer models indicate a very slight drop in the amount of moisture thursday and lasting into the weekend. i don't think it means we're rain free but it may mean any showers may be more sporadic.
