>> it's not. >> it doesn't matter what would be or what could be. that's not what is. what is is what we're looking at and how they phrased it and putting forth as a constitutional amendment which would supersede all state and local. there's no local control over this. we're looking at the same thing we saw in 2014. >> i'm asking because i'm trying to get a sense of the objection you have only being it's on open e were they to have closed it >> my only objection. there are numerous problems. not only is it loopholed again. it does open it up for any condition, much like we see in california style amendment. what people do not understand is this is not pharmacy. this is bud tenders. these are not pharmacists that are trained. you're not going to your local pharmacy to pick up medicine. this is not medicine.

california and what we're seeing going on google or wherever to find medical marijuana dispensarys to see what we're facing. the difficulty with the other conditions is that they've added conditions and then kept it wide open so that it will be abused. >> if it was not wide open. if it was closed, would that be a different conversation in your mind? would you be open to supporting it? >> i would not be open to supporting it. i support scientific study. the fda process. that is not what this is no matter if you closed it or left it with one condition listed on there. periods. >> if this were to pass would violent crime e erupt? >> it could. you're dealing with a cash business and criminal enthe ities. >> i've seen studies including one from ut dallas. showing in the eleven states that passed medical marijuana from 90-2006.

>> i would argue that's incorrect and i would go through the law enforcement municipalities and look at the different laws in place in those states. that's not what we're looking at in the state of florida with the constitutional amendment. >> what are the health risks >> mirn affects the brain directly. there are obvious impairments to when you breathe things in. the only thing we're supposed to breathe in is oxygen, not smoke. >> to those that look at contradictions in drug policy. you have peo receiving joints curtesy of uncle sam, our federal government and others say i have a medical condition as well and i can't get this. you would say what? >> the only reason that he get that continued from the university of mississippi is because they went through a legal case to get that. that was a failed study. that's a moot point. we have three laws on the books here primarily 893 that's been around decades that allows

doctor. again, that's not what we're talking about. we're talking about a flawed amendment, a loophole written amendment that's going to be on our ballot. once your change your florida constitution it's difficult to take it back. >> but it can be done. it's been done before. in the united states you had an 18th and 21st amendment. it's not impossible. >> let's be serious. we already know how much money it costs to put something like this on the ballot and get the si what will the fall out be in the meantime if that happens? it won't happen because florida is way too spart for this. they can see this is the same amendment, essentially, we saw two years and they are not going to vote for it. >> dr. spencer thank you for your time. >> thank you. >> coming up we'll drill into clinton in tampa. we'll sit down with marco rubio

what specifically can the federal government now do to stop all the lingering water from spreading sdooek mosquitos from here to tallahassee? >> first of all, it's already on ongoing effort to do an assessment of the damage in florida. once it reaches a certain point there can be a request for emergency declaration. once and emergency declaration is made by the president, which i'm prepared to pressure him to do. once we hit the numbers the assessment needs to be made by the st become available to help community, county and the state respond. part is treating the standing water so it doesn't become a breeding ground for mosquitos. i've been working with colleagues on both sides of the isle to make sure $1.1 billion is available to zika. a lot of that money will come to florida and a lot of the money dedicated to developing a vaccine. >> you pledged not to seek reelection then you changed your

nomination in a landslide. republican voters didn't care you changed your mind on that. why not commit to serving a full term if reelected? >> in the real world people change their mind every day. the question is why did you change your mind? in my case it was because i believe there's a lot of work to be done. i didn't like the direction the senate race was going and i believe it's important to have a senator that will act as a check and balance on the next president no matter who that is. i u.s. senate. it's a six year term. no one can tell you where they are going to be five years from now. i can tell you what my plans are. that's to be a united states senator from florida. to continue to work hard and continue to get results. benefit from the experience over the last six years to serve the state over the next six years. that's my plan. i'm not running to run for anything else. if i wanted to run for president again i probably would not have run for the u.s. senate. in the toughest race in the
