allegedly started it, francis perry of winter haven. the sheriff unfurled it scroll of perry's arrest record which began with a weapons charge at eight 11 and includes convictions of attempted -- grand theft, aggravated assault and many others. he was released from prison in march. last night a drug task force followed perry as he drove through lakeland, suspecting after he stopped, detectives stopped the car and told him numerous times to roll down the window and show his hands. he fired rounds through the window and it was clear he made a choice he wasn't going back to prison. >> this guy decided that he wanted to end his life here. that this was really a suicide by cop. we didn't choose to shoot

and we accommodated him. >> the sheriff says perry fired at the officers a total of five times. he did not hit them even though two officers were very close to perry when he fired. the four officers fired at perry 28 times, hitting him at least five times. the sheriff says the officers performed cpr, called ems but perry died in surgery last night. those detectives, including a polk county sheriff's deputy winter haven are on paid leave. remember, they said they were following perry because they suspected him of selling drugs. the sheriff says inside his car in plain view they found enough methamphetamine to warrant a drug trafficking charge. thank you. this man was convicted of stabbing his girlfriend to death. now ken shivers want a new trial. gloria gomez is here to explain

>> the defendant says his attorney did not do her job, therefore he wants a new trial. the defendant was in court this morning. shivers actually says and accuses his former attorney of not arguing the right defense. he says the stabbing was done in the heat of passion and he caught his girlfriend having sex with another man. he could have reduced the charge to manslaughter but he was convicted on second-degree murder and got life in prison. he says his attorney failed him but under cross-examination that argument fell apart. the defendant admitted he never told his attorney about his girlfriend meeting up with another man and prosecutors tried to show he made the whole story up by poking holes in his timeline. >> isn't it true, sir, you did not come in and see her having sex with another man? she was there that day at her house with family members. >> no. >> there were no family members? >> at the time, yeah, but they left. >> so you were there.

significant cloud cover today to at least shade things a little bit. so it's pure sun and it's an east wind. in september you'll be in the low to mid 90s. once again, we talked about this the past couple days, the best chance of rain south of tampa bay. it happened again. a little bit of moisture, fort myers and sarasota county a few late day showers but not that many. you can see them on skytower. dry around the bay area. if you are watching in and sarasota counties, quick moving showers arriving from the east. some of them are locally heavy. some rain in northport, englewood, venice, myakka city, arcadia. south of tampa bay, you could witness a quick-moving shower, a flash of lightning and that's about it. about the same thing tomorrow. maybe a slightly better chance of showers around the bay area. still 93 in tampa.

88 in naples. the dry air -- we had a smidge of drier, low humidity this morning. now the dry air's moved away. the dew points in the low 70s around tampa bay and that's like summertime. but the dew point in gainesville is pretty good. 57. 61 tallahassee so a slight drop in humidity to our north and a lot of this, by the way, is due to the remnants of has been giving us a north-northeast wind the past couple days helping to usher in dry weather. we're in a little calendar count down row. this is the one talking about fall. 14 days until the first day of fall. the atom nal equinox. 34 days to the lightning opener. four to six weeks until the average first significant cold front arrives. then a big holiday, 53 days until halloween.

new york is 86. raleigh and columbia, both 94 degrees. columbus, ohio is 87. 93 nashville, 95 dallas, 90 baton rouge. we stay on the border between dry air to the north and tropical moisture from the south but over time, the dry air loses the battle. so moisture comes back and that simply means a better chance of afternoon showers and thundershowers. espe weekend. the rain chances maybe 30, 40%. lots of dry air back here. that's not going to make it anytime soon. high pressure over south carolina. we're south of the high so winds continue from the east and northeast. a few support sporadic showers . this weekend, 30, 40% rain chance staying nonstop in the first couple days of next week.
