good evening, welcome, i'm mark wilson. >> i'll linda in for kelly. a craigslist ad turns into a dangerous situation for a riverview carpenter. he thought he was showing up to give an estimate. a group of teenagers robbed him an carjacked him. now they're all facing charges and a vigilant neighbor is a big reason why. fox 13's aaron mesmer is live in riverview. what happened? >> reporter: neighbors say the criminals were just using that vacant some of them were hiding behind it while one teenager waited in the driveway where i'm standing. they had no idea that another neighbor was watching and recording. >> i could see that driveway from the window. >> in the driveway next door, michelle battles saw something or someone strange. >> i grabbed my phone and just started recording just her actions. >> the teenager didn't belong there. >> she's between my house and an

that's suspicious. >> so is what happened next. a red car pulled in. a few minutes later, teens jumped in and sped away. >> they were hiding on on backside of the house. when he pulled into the driveway, they bum rushed him. >> hillsborough deputies say it was a well-planned crime. a carpenter placed an ad on craigslist offering to do home remodeling work. he got a call from someone who lured him to the abandoned home on lynmoor drive. >> when he got there he was greeted by a female at the door. >> a group of teens robbed the carpenter and carjacked him. neighbors ran over to help. >> he was really shaken. he's a good christian man. >> little did the victim know someone next door was watching. >> i never witnessed crime like that so close to my home ever before. >> michelle battle called 911 before the crime was even finished. in a matter of minutes, deputis spotted the stolen car, chased it down i-75 and arrested five

years old. >> unfortunately kids are getting involved in crime earlier and earlier. >> detectives to do battle to i.d. the teens. >> they stood them unand thumbs up, thumbs down. >> just like a group of suspected criminals caught on camera were off the street. something unexpected happened. >> i got out of the police car and jim and them were cheering. they go, you did a great job. i go it's sad that i had to but i'm glad that i >> deputies say that the youngest suspects in this case are believed to have committed the most serious crimes so they have a longer list of charges. the other thing that deputies say, if you're going to take out an ad on craigslist, you should bring somebody with you when you respond, whether you're selling something or doing an estimate like this gentleman was in this case. we did contact him. he didn't want to do an interview but hopes the suspects learned their lesson.

a manatee county girl is lucky to be alive after man attacked her on the way to her bus stop. the 16-year-old victim doesn't want her face shown but wants others to hear the story. it happened 6:00 a.m. this morning when walking down 50th 50th avenue drive east. a man grabbed her, through her into a wooded area and tied to sexual assault her. he took her phone and left when a car approached. >> i think careful and alert about their surroundings. although you may not think it will happen to you, it could no matter who you are. nobody's invincible. >> that's true. deputies say they will increase patrols in the area the rest of the week at least. the manatee county school district is also looking into the incident. sarasota county, shots ring all early this morning. a man was found dead over rita street. detectives spoke to neighbors.

discovery. >> you have to wonder who is next door to you and figure out, like, okay. i usually keep to myself. most of us keep to ourselves to we don't worry that much. >> sarasota deputies are continuing to investigate but say everybody involved is accounted for. a former rogers middle school science teacher is under arrest. michael geist gave a female student a smartphone so she could take naked pictures herself and sext other students. josh is as rogers middle school. i got to imagine parents are a bit concerned to hear that. >> reporter: yeah, certainly some shock and anger from parents at rogers middle school. many of them send their kids to school expecting them to be well cared for and treated well then they hear this and it shakes up the trust level. here's what we know right now. deputies say back in april, michael geist gave a female

apps. -- full of apps, encouraging her to have sexual chats with other students and to take sexually explicit photos and videos of herself. geist would tell her to come to his room every day to see the messages. in may when district officials heard the allegations they notified the sheriff's office. this started an investigation. geist resigned from the school at that time. he was arrested at his house in lascivious solicitation. for parents, this is not the news you want to hear when picking up your kids in the afternoon. >> i was concerned about my daughter. i have a daughter, she's 13. i go to the stores, guys look at her sexual and i hate to feel -- she's in school, she should be safe. if this ain't a safe place, that's a problem. >> reporter: geist is out of

previous talking toes by the administration for previous conduct. nothing that rose to the criminal level but certainly red flags. we'll have much more tonight at 10:00 and 11:00. live in riverview, fox 13 news. thank you. hernando deputies arrested a woman who had personal identification information for more than 70 peoples people. she stole credit cards were mailboxes and used them. in other cases information to set up credit cards in their names. she was arrested in march but many more victims have come forward to say she stole their identity. she was arrested again and charged with organized fraud. freddy lee hall was one of the longest sitting inmates on death row. not anymore. the supreme court just spared his life. what does the ruling mean to him? >> the experts say the ruling

will be spared too. >> freddy lee hall has spent the last 37 years on death row until this week. the state supreme court set aside his death sentence for a life sentence. the high court ruled hall has serious mental difficulties and is, quote, mentally retarded. >> at the age of 51 he had a cognizant ability of a 10-year-old. >> the attorney reviewed the decision for tox 13. he says florida l a one size fits all approach. >> florida said if your iq is 70 or higher, you could be executed. what the supreme court said is that's not allowed. >> the supreme court now gives a lot of weight to the testimony of mental health experts who says hall meets the def in addition of mentally disabled. he was convicted of killing a

from organic brain damage and psychosis. the attorney argued the handicap would have effected him. >> tellit goes to his ability to understand. the 8th amendment prohibits someone from being prosecuted if intellectually disabled. >> that means hall will die in prison but not at the hands of the government. the sweeping ruling is providing mentally disabled prisoners sitting on death row. >> those individuals now have an opportunity to have their case reviewed potentially to determine whether or not they're intellectually disabled for purposes of the death penalty. >> the attorney general's office is still reviewing the ruling and have not decided if they'll ask for a hearing. regions bank is shelling out more than $52 million for the

tested what is dumped into the tampa bay area and 100% of fecal bacteria was removed but at least eight other utilities were dumping during the storm. some of it included raw sewage. that's a mess. >> hopefully on one hand we want another storm to come in and clean that out but on the other hand it will create more problems. >> speaking of which, we've got rain and dark clouds overhead. >> very well put. watching the riverview cam, there are dark clouds overhead. we have areas of heavy rain around tampa bay. interesting weather day today in the sense that that invest we were watching last night by miami it moved occupy the peninsula -- up the peninsula and off the east coast. this morning they said a goose egg chance of development.

everything is moving southwest to northeast, kind of rotating around the area of low pressure, which is well to our north. also, dade city, zephyrhills. northeastern hillsborough. rain motion to the northeast. light rain in hernando, raining by bushnell. not a big deal. elsewhere a big batch of storms down i4. you know how the traffic is in orlando this time of day. imagine this ride from kissimmee all the way toel disney and orlando. heavy rain. that definitely is a mess. then you go up the state, here's the low pressure here, the heaviest rain and winds off the east coast. if you watch the wind direction, you have south and then you have southwest, south here, northeast, northwest, north, the low is right here and thankfully it is over land. the models have it just roaming up by georgia and should be dissipating in a day or two.

some showing greater separation than others so i have to go to an average of national polls and show you what is happening. it's showing hillary clinton leading donald trump but by two points with gary johnson checking in at 9%. he needs 15% to get on the national debate stage and he has very little time to get there. what we're seeing is tightening in the race. if you look at the surveys we've seen, they're not entirely conducted after hillary clinton's health scare so don't know and will not know fully until friday of this week when surveys are in the field fully after sunday to what extent that may hurt her standing in the polls. we also don't know to what extent is might be better. it might be her remark about basket of deploreables because there's a lot of factors in play. health is just one of them. by the end of this week we will have a better temperature check of where this race stands. >> as of this weekend, donald

galaxy note 7. the company is telling customers to stop using it immediately. saturday a six-year-old boy in new york was burned when one of the smartphones exploded in his hands. the phone was recalled after 35 separate reports of the batteries overheating and catching fire. the boy's family says he was watching videos on the phone when the device exploded. >> the phone caught on fire, then the battery exploded so he threw it on the floor and it was house. >> the boy was treated and released from a local hospital and samsung says they'll replace the smartphones. in the meantime, anyone with the galaxy note 7 anxious turn off the device. >> a strip mall is totally destroyed. the firefighters were able to bring the fire under control after several hours. investigators were at the scene trying to figure out what caused it. two firefighters suffered heat

italy are back in school after the massive earthquake. it's becoming a dangerous occurance across the country... including right it's becoming a dangerous occurrence across the country including here in our area. parents leaving their young children in hot cars and the child dying. a father in pinellas, a firefighter, faces charges after his 23-month-old son died when left in the pickup truck. joining us, attorney general brown. aggravated manslaughter is the charge. why aggravated manslaughter? >> it shouldn't be. i think this is an outrage that

it's not as if he intentionally committed this act. aggravated manslaughter would be the culpable negligence or indifference to human life, it's driving down the crowded sidewalk in a vehicle. he had no intentions of committing this crime. this was a horrible, tragic accident but to put a criminal charge on top of everything he's going through, not only losing thinks job, probably his marriage, but the loss of his 23-month-old son and now they feel at if they need to put a criminal charge on him? it's going against everything in the crina there has to be intent. this is not criminal negligence. >> what about the argument you have to have a consequence, even if it's a mistake. some lawmakers think this is a way to prevent somebody else from doing this. >> we have for many years believed there was deterence. you need to set the example so others don't commit crimes. we have a huge body of law and literature that suggests

people don't think i shouldn't commit this crime because i read something in the paper. people won't say i better not frget my child because i'll end up like this firefighter. it's a tragic event but we don't need to pile on top of this. what this father is going through, i can't imagine. >> sure. it is horrible. and these cases are all different. we know that. there's another case in atlanta, a high profile case about a year ago, jury selection is underway now for a father who left son in a car and he died. how do you think the defense in this case is going to try to get him freed? >> that's a different case. all the cases are decided on separate facts. this father left his kid in the car knowing he left the kid in the car. there was internet work or activity he had done about being a single father and being child-free so there was a lots of evidence to suggest he intentionally did this. not that it was an accident or something that he had forgotten

they're going to have a very tough time in that case because of the internet work and research he did about becoming a single father and child-free. it's a completely different case in this tragedy in our county. >> has anybody ever been convicted for a crime like this? rarely do we follow these to a point of conviction. we report on the arrest but rarely conviction. >> normally the case that go to trial are a case where the person intentionally leaves the person in the car. ey think they'll have a quick drink and they have three and the child's in trouble. situations like that, they make a stupid or horrible decision and sometimes a criminal decision to leave a child or animal in a hot car. that's not the same thing we have here. this father had no idea he had done that. we went out and walked the dog, got groceries and it wasn't until he got back to his car and saw his son in there the

south of ponte vedra and near st. augustine. winds in st. augustine 30 to 35 miles an hour. so if this was over the gulf stream we'd be talking about a developing tropical storm. this gets over the water it could develop. it's over land by i-95. aaa. you have temperatures in the 80s in most spots. future cast has low pressure which we should p moving up the coast and eventually weakening with time. we stay with a southwest wind later tonight indicating showers and thundershowers moving inland. then more storms developing on thursday. we kind of stay in a tropical atmosphere for a couple more days. we've been watching this the past several days.
