drill into the debate over medical marijuana. plus tightening in the polls and more changes in the race for the battle of florida to the new fight for texas. this is money, power & politics. let's start with a score card. fox news projections show donald trump is in a hole. because of hillary clinton wins the states that fox news rated as solid or leaning democrat. she'll have at least 307 electoral votes and you only need 270 to win. foxes 57 votes column. the decision team moved iowa to toss up. projections show democrats will gain some seats in the house but not enough to take over the chamber. a different story in the united states senate. democrats have a good chance to take over that chamber but it may be very close one way or the other. it could come down to florida where senate democrats pulled their money from patrick murphy. fox 13 poll shows murphy is tied with rubio.

expensive to advertise in florida and there are other states they have a better chance to gain seats so they left murphy at the al or the. murphy was a republican who supported romney and rubio is a household name and held a slight lead in the polls going back months. they may have play into some of their thinking. every night from here o through election night we're fact checking the ads and explaining issues. we received a lot of questions about the aems and questions to break that's our next step tonight. we go through the amendments on the ballot, what they would change and the pros and cons. we start with the one getting much of the attention. that's amendment two for medical marijuana and questions for the opposition. >> it's a fraud, folks. anybody that thinks it's anything other than that is smoking marijuana. >> the push for medical marijuana failed in 2014. this year it's back on the ballot with amendment two. supporters say marijuana for medical use will help people

debilitating disease. opponents say it's vague and susceptible to abuse. we cover both sides as the debate plays out. tonight we hear from dr. spencer who speaks for the opposition. >> welcome dr. spencer. thank you for joining us. >> thank you for having us. >> the core argument is this amendment would be susceptible or open to abuse, correct? >> absolutely. we're looking at the same amendment we saw in 2014. >> if it was a closed list, conditions listed say cancer, aids, glaucoma, period. at that point, wold you be open to supporting this amendment? >> i think the problem with that is that's not what we're looking at. >> it's not. if it was? >> it doesn't matter what would be or could be. that's not what is. what is is what we're looking at and how they worded it, how they phrased it and putting forth as a constitutional amendment, which would supersede all state

we're looking at the same thing we saw in 2014. >> i'm asking because i'm trying to get a sense of the objection you have only being the fact it's open ended list. were they to have closed it. that's why i'm asking. >> i wish that was my only objection. >> the other would be? >> there's numerous problems. not only loophole ridden, again. it does open it up for any condition, much like we see in the california style amendment. what people do not understand is this is not this is bud tenders. these are not pharmacist that is are trained. you're not going to your local pharmacy to pick up quote medicine because this is not medicine. you're going to need to look in california and what we're seeing or whatever to find medical marijuana dispensaries to see what we're facing. the difficulty with the other conditions is they've added conditions and kept it wide open so that it will be abused.

different conversation in your mind? would you be open to supporting it? >> i would not be open to supporting it. i support scientific study. i support true medicine through the fda process. that is no what this is. no matter if you closed it or left it with one condition listed on there. >> if this were to pass would violent crime go up? >> it could. that's what we're experiencing in other states. you're dealing with a cash business and criminal en including one from ut dallas that showed in the eleven states that passed medical marijuana from 90 to 2006 there was a drop in violent crime. >> i would argue that's incorrect and go through the law enforcement municipality and also look at the different law that is were in place in those states. that is not what we're looking at here in the state of florida with this constitutional amendment. >> what are the health risks of marijuana? >> many. marijuana affects the brain

the only thing we're supposed to breathe in is oxygen, not smoke. the list can go on and on. >> to those who look at what appear to be contradictions in drug policy. for example, you have people in florida receiving joints, courtesy of uncle sam, our federal government free of charge for decades because they have glaucoma or a bone tumor. and others say i have a debilitating condition and i can't get this. you would say what? >> first to the only reason why they are getting that continued from the university of mississippi is because they went through a legal case to get that. that was a failed study. that's a moot point. the individuals that claim that they have a debilitating condition and can't get that now. two days ago the e-mail that united for care sent out from morgan said if they rescheduled this would be illegal.

people to have marijuana under medical conditions through their doctor. again, that's not what we're talking about. we're talking about a flawed amendment. a loophole ridden amendment that's going to be on our ballot once you change your florida constitution it's difficult to take it back. >> but it can be done. it's been done before. in the united states you had an 18th and 21st amendment. bullet trained here in florida. it's not impossible. >> let's be serious. we know how much money it the ballot and get the signatures. it's difficult to do. so what will the fallout be in the meantime if that happens? it won't happen because, again, floridians are too smart for this. they can see this is the same amendment essentially two years ago and they are not going to vote for it. >> if you're concerned it's susceptible to abuse, why not rely on law enforcement to snuff out the bad apples so this can be implemented with little abuse.

west with the language the way the amendment is written. you've created more difficulty for law enforcement and the department of health and our physicians and our local people to handle the problems that will come inevitably from this amendment. >> dr. spencer thank you for your time. >> thank you. >> this is a copy of a ballot received bay gentleman in plantation. it's deficient. if you go to the section with the constitutional amendments it does not list amendment two! florida. some voters say there was some sort of glitch because amendment two did not show up on their ballots. >> i was simply asking that as the ballots are opened up by mail that amendment two was in fact on it. >> election managers say this was a goof that affected a handful of ballots and the judge is looking into it. it could come back around if the results are close. on amendments you need more than a majority.

worse depending on who you ask. it relates to solar energy and whether solar producers can compete with the power companies. florida utility companies are backing amendment one on the claim that it would protect their consumer and control costs for people who do not go solar. critics say it'll make it harder to compete with the power monopolies and therefore impede or slow the growth of solar energy in florida. we're going to drill davis. >> supporters claim it's the obvious future for powering up mr fl. but it's leaving many seeing red. >> the way the initiative is written, it sounds good. i sounds like it would advance solar but it's not true at all. >> susan of southern alliance for clean energy says amendment one which promises to protect consumers and businesses and the states initiative toward solar power is flawed.

>> so again bottom line. this does two things. one it gives consumers a constitutional right to produce solar energy for personal use. we have that right under the law. but this stamps it into the constitution. and, two, it gives government a constitutional right to regulate it and restrict competition within the utilities. a yes on one would make it harder for people or third parties to sell their energy on the open market. they could be hit with new example. that could, in fact, limit the growth of solar energy. on the other hand, utilities say it would help people who do not invest in solar panels because they would not have to subsidize those who do by paying extra to maintain the grid. that's amendment one. in fact first half to have show we walked you through segment two on medical marijuana. that brings us to amendment three. the legislature put this one on the ballot. it would give some tax are e leaf to permanently disabled first responder.

texas. voter turnout was among the highest in history. this time around new records have already been shattered. in the first full day of early voting in harris county, more than 67 thousand people cast a ballot. roughly 20 thousand more than day one in 2012. in dallas, different county, same story. an 80% hike has been recorded with first day voting totals in and around austin, almost a jump. many establishment texas republicans can't get behind this gop nominee. >> there's real reluctance and some of that reluctance will show itself in people staying home, leaving the top of the ticket blank. >> state democrats see this as a golden opportunity. >> being this close is a huge accomplishment for this party. it's getting people excited because in a state like this that always has traditionally gone republican. >> the first couple of days

again has voted against our trade embargo against cuba. condemning our embargo. our nation stood up to the united nations but not this time around. this time the white house directed our government to abstain from that vote saying we're not going to stand up to the united nations on this one. it is a strong signal to congress from try to get congress to lift the trade embargo against cuba. but this ultimately will come down to the position of the next president and the next congress. one of many reasons this election is important as big implications. with that in mind, i want to look now at the early vote in florida because it is fascinating. bottom line florida is going to be close. if you look at the early voting numbers there's good news in this for republicans and democrats.

people voted. one in five all florida voters weighed in. bet that more than 40% of the vote will be in before election day. republicans are doing particularly well in the fort meyers area. democrats doing particularly well in miami-dade. not as much so in broward county. we continue to watch the returns thaz come in the coming days. it will give us very good clues of which way florida may go. right now it shows our state may be a that's our show tonight. see you tomorrow night. until then take care.
