the 10:00 news starts now. good evening, and welcome tonight. ike mark wilson. >> i'm kelly ring. we begin with breaking news out of southern hillsborough county. the search is on to find a father missing after he took his young son out on a personal watercraft, a jetski. the 3-year-old boy was found by a good samaritan on an island by himself. fox 13's haley hines is live along the river tonight. okay. father, and how is the little boy doing, haley? >> reporter: well, kelly, at this point no sign yet of 38-year-old william morris. all deputies found from him was his jetski, his life jacket and wallet. that jetski was brought here to where we are right now at a.j.'s on the river. crews and deputies are all out there searching that dark river water looking for a sign to lead them to william morris. if there's any good news, it's

with him on the river is safe tonight. a good samaritan found him alone on a small island west of i-75. they got a call morris was missing. he took his son for a jetski ride earlier in the day. when the wife called the cell phone, the 3-year-old answered via facetime. a good samaritan found the little boy on the island and stayed with him until deputies got there. at this point of what happened on the river or where will nam morris could be at this hour. deputies are out here and at different points on the river searching by boat as well as helicopter. it looks like it could be a long night with investigators and family out here hoping for good news. we stay out here and bring you any developments here on the search. we're live in gibsonton. haley hines. the get out the vote effort

accident. it paints a clearer picture of what was going on saturday night and what put a hard-working deputy here in the hospital. sometime around 12:30 saturday morning this 911 call comes in to polk confident. >> it was a woman dressed in black walking like on the grass trying to flag down cars in the median. >> that woman is jessica who was just involved in an accident. scene calling in a signal 4, a car crash. it's routine stuff until between 12:38 a.m. and a quarter till 1:00. >> that's when this unknown person runs through the median, runs over them, and then flees the scene. >> reporter: the force of impact killed jessica. she was 33 years old. radio chatter calling out a signal 7, a fatality. >> it appears at this time we

deputy down. >> reporter: the loss crushes jessica's mother who has lived through the deaths of all three children. >> when my son passed away, she promised -- i said please promise me that you're not going to go away from me. you're not leaving me. >> reporter: still alive but struggling is deputy pernell, the hid and run leaves him with a number of broken bones. sheriff judd pulling no punches towards the still unknown fleeing driver. >> you're a coward. that's what you are. you're going to be wearing orange sooner or later. >> reporter: he and jessica's mother both calls for justice. >> we have to solve this as much for her family as we do for our work family. >> turn yourself in for our sake. >> reporter: and deputy pinnell is scheduled for surgery tomorrow. his recovery could take at least a year or more. as for the case, there is a

the folks along prospect road go all out in south tampa. you may have seen this at 6:00. kids in costumes of all kinds love the neighborhood. hundreds of trick-or-treaters went house to house filling up bags and some homeowners turned their front yards and doorsteps into quite the elaborate show. >> every year we put up the decorations and about a month in advance, so the neighborhood and just come and listen to the music and, i don't know, have fun and remember. >> mark: a lot need storage sheds for all that stuff, too. they have programmed each individual note to their night light show as well. so a lot of thought and time and effort that goes into it. it's always worth it. >> kelly: like she said, they're really doing it for the whole neighborhood, and that's what works.

prosecution, because she describes ross harris as a loving father who was unquestionably devoted to their son even if he wasn't devoted to their marriage. today the jury in brunswick, georgia saw home videos and pictures of father and son playing together. there was a lot of tears in the courtroom as the videos played, a stark contrast to the picture painted by prosecutors. they stay in 2014 harris purposely left cooper inside his car for seven hours so his son would die and he could pursue extra-marital his ex-wife told the court that harris was never good at keeping track of time and was often forgetful. they both shed tears as she talked about the moment she learned her son was dead. >> the only thing that made sense to me based on everything i knew that day, ross must have left him in the car. that was the only thing that made sense.

verifying who these people are and they're using the information the appropriate way. >> reporter: driver privacy protection act makes your driver information private and protected and for good reason. congress decided states shouldn't profit by selling private information about its citizens. information that could put a person's physical safety, privacy, and identity at risk. but the law left open several wide-ranging exemptions that allow businesses private information without your consent. for things such as used in motor vehicle recalls, various insurance activities, research and toll booth operations. and according to the state of florida, a lot of businesses need meet those exemptions. in the past two years alone the department of highway safety and motor vehicle vehicles brought in $150 million by selling personal driver information to

concerned about it, and that they heavily vet anybody that wants to buy your information. in fact, a state spokesperson said that repeated. >> it's heavily vetted. numerous processes to vet, and all of those agencies are heavily vetted by the department. >> reporter: whether you say heavily vetted, if we can go back to that, what does the state do when a company says, we want to purchase mass amounts of personal data of floridians? what does the state do sure they're, in fact, using it for that purpose? >> again, i'm sorry to do this to you, but i have to follow-up. >> reporter: we asked the state to describe how they screen these companies to make sure they'll use your information legally. several weeks after our interview, the state dmv finally sent an e-mail saying the department vets these companies by confirming they have a registered business name with the state. that's it. attorney brandon robinson says

the records is basically swear by penalty of perjury that they're using that information for an allowed purpose. there's no further checks or balances than that. >> anyone can sign up a business name with the state registry. >> absolutely. you can file a fictitious name in a matter of weeks. you run ann ad in the paper and if no one else is using that name, voila you have a sole proceed pry fictitious name. >> we spent four months researching who is buying your informing. what we found is some of the companies don't have a florida business registration. other companies seem to have no footprint at all, apart from a state business registration. no website, no storefront, no answer when we tried to contacts them. then there are large companies you may have heard of. the state of florida sells your information to large data

like the entire both online and physical world if not for creating better, more specific groups of people that you then sell to people when they're targeting marketing. >> we discovered some of the companies on the state sales list have been sued over allegations they misused driver data purchased for several states including florida. two federal class action lawsuits have been filed in the past few months. there's domini company of a crossel. they used private driver records in violation of the federal driver privacy protection act. florida is currently selling your information to the company for 1 cent per record on a regular basis. then there's a company called national recall and data services. according to a federal class action lawsuit filed against the business and its owner, charles holly, the company released

companies. the state dmv in texas cut off the contracts to buy driver data. the state dmv in florida gave his company a direct pipeline to your personal information until september 29th, one day after we asked the dmv about it. a spokes woman said holly was given six months to return an out of station that he wasn't misusing your data and that he never did. direct marketing ads are why fox whether the state is truly keeping your private information safe. after attorney brandon robinson recently bought and registered a car, he started getting direct marking ads, too. >> it had to have been through the state records. within a week, no one else could have got the information that fast. >> reporter: the risk is beyond junk mail. if marketers get ahold of your private information, who else can? and that is the concern many of

information online for a few bucks to anyone willing to check a box claiming they have a legal reason to access your information. >> it's really amazing. whose job is it? if it's this federal law but we have a loophole with the state, who is supposed to be policing if they're not selling it to reputable agencies that aren't at least in question, you know, at least there's a question to where this information is going. >> right. the state is supposed to follow the law applies to state dmvs. if it's not, the department of justice can step in, but it's eggs treemly rare. a lot of accountability comes through lawsuits like the ones there. by that time, the claims of the damage have already been done. >> other than you, nobody else is watching it right now? >> this is a very unreported issue so far, but hopefully we get more traction on it and stay on the story as well as. >> identity theft if there's take correlation, you're talking

stuff. some kids couldn't go door to door tonight. >> guess what? the staff brought halloween to them, which is a beautiful thing always to see. they call it reverse trick-or-treating to make sure sick children and families tonight miss halloween. look at them. they did not. the hospital staff went door to door giving out candy, spreading so many smiles. look at the costumes. that's fantastic. the kids were about to change from their hospital gowns into their favorite costumes thanks to donations. even got into the fun spreading the halloween spirit boosting the spirit of sick children and their families. everybody had fun. >> seeing your kid sick in the hospital laying there and we currently have an unknown diagnosis so we don't know what's going on. this is a great distraction while we're still in the testing process and figuring out how to treat him. just seeing a smile, just upbeat, it melts my heart.
