chester county sending us for a detour. one on 926 at schoolhouse road 95 northbound leaving the city you'll fine delays up into that construction zone at girard avenue. bridge lease fine. mass transit in delays. chris and alex, back to you. thanks very much. if you like posting to facebook or tweeting on twitter, using social media in general you will want to hear this supreme court is weighing supreme court rights of people using violent or threatening language on social media. >> what do you think, court will hear arguments in the case of the bethlehem man sentenced to nearly four years in prison for posting graphically violent rap lyrics on facebook about killing his estranged wife, and shooting up a kindergarten class, and attacking an fbi agent. anthony aloans says he was venting his, anger but federal jury convicted him. >> lets get to our legal analyst ken rottweiler who is back to talk about what this means for free speech when
8:33 am
posting on facebook. >> this is first time supreme court will be examining on line speech. what is interesting, chris, you and write talking about off cameras. we have nine supreme court justice what do you think average age of the supreme court justice is. >> pretty up there. >> ruth paider ginsburg is 81. >> it is 68 and a half years old. how many of our supreme court justices are using facebook and twitter and instagram, probably not a lot of them. so this is going to be new ground for them it will be very interest nothing terms of their decision. >> youngest one is just advertise keying an. >> she's 54. she's the youngest. >> but the essence is when on is one posted something on facebook, they have to find out if it is a true threat there. >> that is what they will deidentify whether it was a specific intent, that is what the people court will do in terms of their decision. whether this was a specific attempt by this man or whether it is a reese nal person standard. he said he would kill her. he made all these graphic threats about her.
8:34 am
the question is whether that is something that, you know, should be protect under the first amendment or not. i quite honestly think it is not. these are very specific threats. doing this to the public at large making threats against his wife. domestic groups said this cannot be protect speech. >> here's my issue. when it is on line or texting, it is hard to tell. you don't have context, the tone. can it not be hard to tell whether a threat is a true threat when someone is typing away. >> lets look the at relationship this was his wife. he made these specific threats against his wife. they are going through a divorce or some domestic problems. he made these threats. he was very specific about what he wanted to do. he said he wanted to kill her and very graphic scene about what he wanted to do with her blood and everything else. so the supreme court, it will be interesting, will take a look at this one of our fundamental rights is first amendment, freedom of speech. one of the things we have learn in law school was. one of the things you cannot do. >> you cannot yell fire in the crowded theater. >> that is exactly right.
8:35 am
why can you do. that it is a danger to the public at large. people would rush out. people can get killed. so your rights with regard to your first amendment freedom of speech is not allowed in those types offset goes where people can be hurt. in this situation he had makes specific threats against his wife what do you think would happen if we say it is protect speech and then cared out and killed his wife. people would be screaming you know what. >> you should done something. >> we should have done something you are dammed if you do and dammed if you don't in this particular case. supreme court will take a look at this. i am very interest todd see how they come out with this ruling will come out in february. >> real quickly then in this case it is specificity of it verse if he posted something on line like i hate mize ex-wife, i wish she would just die. >> that is right. it goes to exactly what was said. the what the specifics were. in this case it was pretty specific and that is why he served three years in jail. >> interesting to see how u.s. supreme court >> good to see you guys. >> wait a minute before

8:41 am
another magazine cover, obviously. she has an entire spread inside, with highlights of her accomplishments in the classroom as well. she's been on the honor role since she first enrolled, second grade. in addition to her pitching , she's got an rbi single. she had an rbi inning will in the world series making her the sixth girl to get a hit in the tournament the's history. she's getting all of the recognition because of the baseball and she has proven that she has incredible skills, but she says that basketball is actually her passion. she'd like to pursue a career in the wnba after she graduates from school but she has got the amazing videos on you tube. i wish we could have brought them to you. we didn't get a chance of them. she is doing wick stuff on the court. >> basketball girl. >> all around kind of sports sensation. >> we are so program i for her. everybody is so proud of her. >> she first started pitching and she was seven years old.
