this happened 5:00 this morning when the winds were getting up to 50 miles per hour. the strong enough winds to bring down trees and bring down power lines. we talked to folks around here who described hearing that wind as howling overnight. i know we heard it i heard it at home. here's what somebody on the scene earlier this morning told us he thought about all this. >> when you get this kind of weather these strong winds and trees are really brittal this time of year because of the cold. everything is frozen inside them and it splits easy. it's not unusual to see that happen. >> back here live you can see the incredible damage this tree caused here. it is very, very frigid. that wind still gusting kicking up the snow. if you stay indoors this morning it's the right idea. >> thank you so much. in other news, 8:05. delaware county a man springs to action to save daughter and baby granddaughter after a tree fell open their home it happened 1:00

8:09 am
and putting a moratorium in place until the issue is really decided in his mind. >> if you look at the numbers pennsylvania has or had the death penalty but three people executed in the last 40 years all them gave up their appeals. so ultimately we weren't executing anybody anyway why do you see touch a back lash. >> that's really true. it was interesting the last person execute was in 1999 by somebody that i think we all know his name gary hidenick. so you're right it has not been a long history of executions here in pennsylvania. but, you know, i think you still need to -- even if it's only one person bill that's executed and it was wrongful, it is still making sense that you need to take a better look at this and that's what governor wol service trying to do. put a more tore glum place and take a look and look at fact and see where we should go with this. >> prosecutors in pike county say regardless of the moratorium they'll go forward seeking death penalty in the eric frein case.
8:10 am
from a legal standpoint with the moratorium can they do that? >> well he's going to do it. i mean the courts will decide whether he has legal authority to it. they're saying the da a in pike county that affects people already convicted not people convicted in the future. and eric frein's case has not been decided yet. so the courts will have time to sort this out and it will be interesting. i'll bet that the governor will prevail in the end. >> always a pleasure. we appreciate your legal analysis and look forward to seeing it again sglon you have a good young. always a pleasure speaking to ken, folks, tell us you what you think about this story. do we need this moratorium. send your messages to us and use the #afox 9 weekend. >> thank you, bill, to the auto convention in town. show us your ink. guess which member of our "fox29
