> your news, your fab hood, life and interactive. this is fox 29 weekend. good saturday morning. it is an absolutely gorgeous saturday as we begin this april 11. thank you so much for waking up early and joining us. we have a lot going on this busy saturday. i love it when we start off and the weather is like this h. the it's saturday and going into the 60s. we'll hear about the weather in just a couple minutes. we have a lot of things to get to. a police officer shooting an unarmed man in the back firing his gun at it times. that officer is now charged with murder. but does the video speak for itself. another very controversial story from our area, a teacher facing a lot of controversy after

outside right now we have clouds clearing the area slowly, north and west more sunshine than along the coast. you guys will pick up some more sun in a couple of hours. 55 in philadelphia, low 50s south and east where we saw some thunderstorms last night in cape may county and southern delaware. winds will be picking up today, too. even though it's a beautiful looking afternoon we will have gusts at times. winds sustained at 15 miles an hour right now. we're looking milder with some sunshine. breezy for tonight. much more on that warming trend still ahead in your seven-day forecast. karen and bill. >> thanks, caitlyn. > happening right now in your news, a 40 year old woman remains in the hospital. this happened in philadelphia's may fair section. you can see that the white police suv is over there on the left that's the vehicle that investigators somehow hit the

child. this is on the 6300 block of leonard street. it doesn't appear to be equip with the flashing lights on the roof like the other vehicles that you say there. that four year old was taken to the hospital with minor injuries. > it's 8:03 and right now philadelphia police are asking for your help because there was a very brutal attack and it was all caught on video. it happened right outside of a convenient store in olney and sabina kuriakose is there. it involved a whole group of people. what are you able to find out. >>reporter: half a dozen people wielding everything from pipes to mace to even a piece of wood. here is the surveillance video. we do want to tell you it is violent. take a look. you can see the 51 year old victim is standing near the edge of the frame when a gray minivan pulls up. people are pouring out of the van. they beat, kick and bunch the

vehicle as he falls to the ground. the brutal attack lasts seconds before the group gets back in the van and takes of off. it all happened in the 5500 block street of north philadelphia. we spoke with an eyewitness. >> i saw a van pull up and at it people jumped out. they had weapons, like pipe type of things and they cracked them and they kept cracking him and pumping him. i'm scared for my life. i said that's enough, that's enough. police actually arrested two women. they were actually found in the parking lot of einstein hospital where the victim is currently being treated. they're charged with attempted murder. the victim in critical condition. he's suffering from masstive head injuries. right now police on the hunt forth rest of those suspects. the very latest out here. > thanks sabina, keep us

informed on that one. a show of unity in south jersey, nearly two weeks after a man died while in police custody. 26 religious leaders in vitetta vineland came together and prayed. phillip white got -- not far from where he got in in a confrontation with police on march 31. part of it was caught on cellphone video. we're showing it to you on the ground. it shows white on the ground with officer and a police k9 over him. white was conscious in the ambulance, but died at the hospital. the pastors prayed that the community won't rush to judgment. i think we know the answer because we saw a video. a legal process is much more thorough than that. we have to show kindness, spacial in to one other without passing judgment. an autopsy could be released any day t now. funeral services are going to be held today for this man, walter

scott the unarmed man who was shot in the back by a police officer in south carolina a as he was running away. that police is now facing murder charges. there's been so many comments on this one. let ' take a look at your comments. traffic stops are not punishable by debt hashtag walter scott. failure to provide cpr to their suspect without a pulse contributing to his debt, all the responding officers should be fired. hashtag walter scott. joining us live this morning to discuss this we've brought an attorney fred piece situate and also chad laster from the good penn at penn. we know there have been charges filed. we know the officer has been charged. >> right. > do we expect -- we've seen in

so many of these cases he'll be convicted. >> there is absolutely no question he won't be convicted. any attorney would argue you. the question is what is he going to be convicted of. clearly the guy is guilty of murder or murder in the second degree depending on how much he had to form of forethought. he is guilty of a crime and needs to be punished which is outrageous and unacceptable. police officers are charged with misconduct that the union will challenge that and they get reinstated time and again. is there any scenario where you think that could happen in this case? >> not in this case, the first thing you learn particularly when i was a prosecutor, discretion is the better part of valor. there are bad valors in every organization. we've seen it in the airplanes. every where you go there are bad actors. this is a flat out crime. i think the union needs to make

sure that they take that position because otherwise they don't want to have all the officers paint pennsylvaniaed with this brush which i think would be unfair. what do you think that this day that there is a burial. the family couldn't even go to some of the viewing because they were so upset. what are your thoughts. >> i think the family is having a hard time. i think the community is having a hard time. i think individuals who are victims of police brutality and accessive force all over the country where it's not captured on videotape is having a hard time. for this particular community i would love to see social workers and community intervention working with this community and particularly with this family around the mortality of posttraumatic stress disorder and some other challenges that individuals are facing with. this is definitely tragic. the police department all over the can country should have a zero poly s. once again we need to do a better john of making sure when we say it's not all police

officers we also say all black mails fit in that category where we should not be looking at them as sub human or we should not be buying it through the racial bias of stereo types that exist. this officer gave a completely different account of what the video then showed. >> i think what we have is an officer that might have been operating anger, buying into the steer types. once again there's not all police officers, but there's something going around in our country of the psyche of white police officers killing black men, when we're seeing someone runaway and we're shooting them at it times, that's troubling and that's definitely problematic for society. final word. >> fred, that's troubling. hands up don't shoot in the michael brown was completely disspelled by the united states department of justice.

played by islam in surgeon sequence i. we're talking about social media, specifically a case in new york involving facebook and a failed marriage. a judge ruling divorce papers can be served over facebook. it sparked a lot of controversy. people questioning just how far social media is allowed to go. steve wrote yeah, that's classy, hashtag sign of times. andre says make your divorce even more public, share it with your friends and see who gets the most likes. and john wrote i think i spoke for most layers when i say we don't like this. so let's find out what lawyers think. joining us via skype attorney heater hand son. how are you. >> good morning. i'm great, how are you? >> i'm good. you hear from the attorneys. you hear the feedback on social media. why is this such a controversial issue? facebook message is almost like e-mail, aren't they. >> they really are, but it seems more public than that. when you're talking about serving someone with divorce

papers on facebook it sounds like it's something more public. it used to be if you couldn't track someone down at their place of work you could actually serve someone in the newspaper. this is a lot less public than that and it actually is a very good way if you have the right facebook address to get somebody served. >> but isn't that the key issues? one of the things you come in contact with any time you're dealing with social media is verify that you're talking to the right person. how do you do that? you can't prove that that is a legitimate facebook page. >> this woman had to do that. one of the concerns is especially in divorce when it's so contentious that one of the couple may open a fake facebook page in the other person's name. so what this judge made her to do is show a number of messages that had gone back and forth between she and her husband to prove that he was actually communicated with her that way and that he actually had this account. they tried to serve him first at an address or at a place of work

but he didn't have either one of those things so she really was in a bind and this is the way the court found around that bind. i was following a case in new jersey just recently and the judge ruled that attorneys can't use facebook to go in and accumulating people they're investigating. it's unethical. isn't this a little bit of a contradiction? you're doing the same thing, serving through facebook? >> we find that a lot in your cases and different judges have different opinions on that. if a person's facebook page is public you can get information on them. if it's private you it's a little bit harder. this is different. this is communicating via messenger. as you said at the beginning, it is very similar to just e-mails e-mailing back and forth. it's not like they're acquiring information and doing pi work through social media it's just another means of communication. to someone it requires that they respond, correct? if somebody is trying to hide from you, you have no phone up in, you have no address, it seems like facebook would be easy enough to ignore.

> welcome back, it is 8:46 and it's already 55-degrees outside. let's take a look at some of your head lines right now. in the news there are two teenagers in washington who are being hailed as heros for saving a strangers life. high school freshman hail i and jazz mean arrived at a mcdonald's to see a man who had been hit by a car unconscious also from a possible over dose. the teens jumped into action using cpr skills they learned in high school health class and taking turns doing compressions until paramedics arrived. > to know i saved someone i wasn't worried about other people knowing kind of thing, it's just nice to know that we got to do it together.

i wouldn't have been able to do it if she wasn't there. first responders are planning to honor these teens for their efforts. in washington, d.c., the famous cherry blossoms, gorgeous are expected to be in peak bloom this weekend, in fact, on today as always the national cherry blossom festival is drawing huge crowds. the park service says the trees should be peaked today. obviously they're going to last for a number of days. about the same time as the past two years. i think they have a big race tomorrow as well. we have our own pretty darn good cherry blossom festival in our neck of the woods. he why, we do. i actually went to school in d.c. take a look at that guy, he's our photo journalist list. that's when we go behind the less than. bill takes us back in time to a simplest place that while small will still make your heart grow.

its feel good kind of place. but, county, pennsylvania. there is a roadside attraction that has been entertaining people. it has been years since she was born. my grandfather started it in 1903 as a nine year old boy. her grandfather lawrence skier put together the largest indoor village. he was very meticulous in everything as far as construction of the buildings and everything goes. he wanted it to look realistic. the village is over 8,000 square feet, features 18 trains antiroll why is and 4,000 miniature people. this achievement is just incredible. for one man in a lifetime when this was relay's a hobby, the shear magnitude of what's created is mind boggling. a master piece mixing together

paint, plaster and live. this really isn't a train layout. people think it is. the artist in the building. he was only 10 years ole. the man was a genius. there is no other way to put it. roadside america usually gets a few hundred visitors each year. unfortunately notes as many as used because times change, public taste, i think, changes and we do have things like television and the internet and everything else. people just don't go out as much as they used to. >> the same as they did over 60 years ago. for delores the guest book brings joy. if i would get tired of this, that child wouldn't see it and it wouldn't be sharing the memories with maybe their parents or their grandparents being here. hopefully that will never happen. when the kids twist their

we can because they make us smile. we're hungry, let's eat. i'm chef robert bennett at classic cake and this is your fox food by the. today we are making chocolate chip cookie. this is one of my favorite recipes to make at home with the kids. 10 understand ons of unsalted softened butter. i prefer to use unsalted butter because it has a fresher taste. if you want to use salt, which we are in this i'm going to add it later on. ten ounces of light brown sugar. cream this together. you don't even need a mixture. let the kids get involved. scrub up their and and they can dig right in. get them mixed together. they don't have to be fluffy. we're not making cake batter. we're making cookies. add two eggs. and just get these mixed in so it's who he monday just.

attack that was caught on camera. >> it happened right outside of a convenient store in olney. we have sabina kuriakose with this one. this was a group, a whole attack of people. >> in broad daylight. at one point it even looked like the attacks brought out a ten year old boy from the van. we want to show you the video, but we want to warn you that it is violent. it's saturday morning, the kids are around, so just a head's up. let's play that surveillance video taking along the 5300 block of. this happened on tuesday evening. a gray minivan pulse up. a gray minivan pulls up. witnesses say about 8 people jump out of the van. they go right to the victim. they start beating him with what police say are pieces of wood, mace and even pipe. they kick him. they stomp him on the head. all this while i witnesses are screaming at them to stop. it was a 51 year old man that

they just left there on the ground. we did speak to witnesses and here is what they told us. oh, my goodness. it was horrible. the way he was bleeding. it was so much blood. it was bad. i mean, it's scary, right across the street from where i live. you can't be safe. i come here all the time. > they did not believe their eyes. police did arrest two women in connection with this assault. they actually arrested them in the parking lot of einstein hospital where the victim is being treated. he is in critical condition with massive head injuries. police still working to id the other suspects, but of course a very violent attack happening in broad daylight. the police want to id these people. we do want to mention police haven't mentioned a note just yet. witnesses ole us it may have started over a conflict involving a 10 year old boy.

>> back to you. > a show of unity in south jersey nearly two weeks after a man died while he was in police custody. there were many religious leaders, nearly 30 in vineland coming together to pray. it's not far from where 32 year old phillip white got into a confrontation with police on march 31. part of this was caught on cellphone video. it shows white on the ground with officers and a police doing over top of them. police say white was conscious in the ambulance, but died at the hospital. pastors are praying the community doesn't rush to judgment. > i think we know the answer because we saw a video, a legal process is much more thorough than that and during that process we have to show forbearance, kindness to one another without passing judgment. the autopsy could be released any day now. in our coverage story this morning a new jersey teacher now suspended. the backlash continues to grow in the case involving a third grade teacher who had her

students write get well letters the man convicted of killing police officer daniel fog inner over 30 yearsing a. that teacher is suspended without pay and the orange township school district will conduct an investigation next week. it all started when this woman reportedly had her students write get well soon cards to the convicted cop killer. she even tweeted about it. my third graders wrote to mow me a to lift his spirits as he is ill. last week the school superintendent released this statement. the school principal and district administrators vehemently deny any knowledge of the assignment and preliminary inquiries find no approval was ever sought nor were parents notified. the story is all over social media. we've again getting tweets. john wrote, third graders should not be used as pawns to further someone's personal cause, especially one as controversial as this.

she's entitled to her opinion, but third graders have no clue. marty said you know who could probably use some get well letters sick kids, wounded shoulders, people in nursing homes, not someone in prison. kay goes onto say, coming to the teacher's' deivi believe her heart was in a good place, i do, but she should have asked permission from each parent. very spirited debate. we wanted to get into it and expand it. joining us tonight by skype, kyle also son of education action group and our news room attorney, mike cord. i want to start with you kyle because you seem to represent what is the majority view at least if you look at all the social media. why was this such an outrageous over step in your opinion and why should she be punished for this? >> the case itself was settled. mow me a was convicted and then he was sentenced to debt. he was resentenced to life in prison. the case is settled and yet there is this contingent of

people like this teacher who want him freed and so what i find so objectionable about this, and i think a lot of parents do as well is you have this teacher bringing her political campaign, her personal campaign into the classroom and using these 8 year old children to do her dirty work and write these letters so this convicted cop killer will feel better. i want to take a step back before we go down that path. mike, as an attorney, i'm not going to debate the case right now, i want to talk about what happened with this teacher. fired, suspended, did what the teacher do from a legal standpoint and your interpretation, did she over step? you actually said you would defend her. >> not only would i defend her, i would defend her free of charge. let me explain the law. we can get excited, hyperredded and emotional, but it's all about the facts and the law. what's the facts? what's the law. >> in cases like this, in new

jersey, pennsylvania, anywhere else, you're talking about a each tooer's first amendment rights, that means free speech. you're talking about fifth amendment rights, that means due process in terms of what the administration can do. in addition there's the 14th amendment which deals with equal protection, that pertains to not treating people in an arbitrary fashion, but more important since we're talking about new jersey, bill, the constitution of new jersey specifically points out that students are to get a thorough and efficient education. if teachers can teach about the 12 presidents of the united states that own slaves, if they can teach about george washington, about thomas jefferson who raped a child, then what are people talking about when they call mow me a this convicted cop killer? he's no more a convicted cop killer than the 152 americans who railroad released present debt row -- >> i got to jump in. kyle is sitting here shaking his head. let's focus on this teacher. what are you shocking your head

trucks weaved around and sometimes ran right over this bizarre obstruction. when reached a philadelphia streets department assured us this was not the work of some lacy road crew. no, in fact, this was a traffic cone placed on top of an emergency patch job. the cone must have been run over. that's interesting because the cone was kicked over into the direction of oncoming traffic. and there was plenty of asphalt on top of the cone and marked within the hollow interior. in event, the streets department promised they would fix the mess. sure enough that damaged and darkened cone was hitting by the side of the street over on the side fault. the asphalt had been reworked to a degree, but there was a significant hole left in the mid of the street. my take, decent roads are the least we should expect in what we like to think of a world class city. even if we take the emergency

> welcome back, where does the time go? we're already at 9:45. thanks for being with us this morning. in your headlines, more than a dozen ships are stuck in ice on lake superior. it's still real cold there. check out this video. this is from the canadian coast guard reporting to report 18 ships have just become stuck and they need icebreakers to cut their way through the ice to get them out of there.

warmer air and a sudden change of wind loosened the ice and moved it around and that is what trapped those ships. > in just a couple hours friends and family members will say their final farewell to 50 year old walter scott. a white police officer scott and killed scott an unarmed black man in the back after a traffic stop last saturday in north charleston, south carolina. the incident was captured on cellphone video. the officer is charged with murder. there are now several questions surrounding scott's police record. about g morning, sir. >> how are you in. > i'm good. on the surface and i read some social media comments, but let's get your comment first. this seems irrelevant and i was reading some comments when we came in and some people think it matters. >> it matters not one iota and i'll tell you why.

the supreme court held in 1985 that the deadly force against a fleeing suspect is limited. you can't use deadly force against a fleeing suspect unless that suspect poses a danger to the officer or to others even if at an earlier time in the confrontation he did pose a threat. so even if -- if he's been arrested 10 times, if he owed child support, whatever, none of that matters because the supreme court says you can't use deadly force against a fleeing suspect unless, of course that person is a danger to the officer or others. in the social media comments some of them agree with you. ken wrote it makes zero difference if walter scott had a criminal record or not. mu license says no matter what seminal record had the fact remains that he was shot in the back. so now they're going to try to justify this. again, the other side michael vaguer is the true and only i am here not walter scott who had a

history of vialen. where is the outrage for vaguer. >> those types of believes still exist. >> those types of beliefs can exist until the cows come home. you cannot use deadly for against a fleeing suspect unless that suspect poses a danger to the officer. they can tweet it, facebook, talk about it, but the supreme court says you cannot do that and most deadly force policies reflect that, including the deadly force policy here in philadelphia. so walter scott is not a victim, not only is he not a victim, but that video shows that what he said is not true at all a. he said that the suspect taser, but the video shows him dropping something by the body and it looks like it was that taser. this happens all the time. any time there's a situation like this, then the victim's background starts to come out. people involved. if they had a history. is this more of kind of that

need for reform that we continue to talk about or is this how the legal process plays out? i think you have to look the at both sides of the story. i think that video really refutes anything you said and i h think that's why you saw the murder charges come so quickly in this case. you've never that before. part of it is what happened in ferguson. i think part of it is the pa hit that police departments across the country that they have taken. i think they wanted to act proactive i in north charleston when they saw that the officer was not telling the truth than when they saw he was not justified in using reform. the first thing we need in this case is justice. is this just about police. i talked to an attorney who said whenever you have a situation where you're trying to defend somebody you're going to bring out something that makes it look look like your actions are justified. i think that there are people
