our cover story this morning, california now mandate that school children be vaccinated. if parents choose not to get their children vaccinated then they must home school their kids. only exception for children, with serious health issues. now, the bill was first introduced after a measles outbreak at disney lands, in december, that sickened more than 100 people, the law will go into effect for the 2016-2017 school year. when it came out people started commenting on social
8:05 am
media. mia wrote go california, congress a proves one of the tough he is mandatory vaccine laws, but rochelle said i can't believe california passed a mandatory vaccine law, while personally vaccinate every parent has the right to choose. so joining us now by skype, this morning, attorney heather hanson, to talk to us a little bit more about that. and, actually, we are working on getting heather back. we're having little bit after problem with heather's feed. so we will get that up, in just a moment. but they continue to go through this process. trying to figure out exactly what is going to happen with this. then the vaccination debate is one that many parents have gotten involved in, is it ultimately parental responsibility or should the state have the ability to step out there and mandate it? so, as soon as we can get things worked out with hit r, who we see right here, we have it all worked out, and ready to go. heather, good morning to you. >> good morning, bill. >> so, one of the tweets that
8:06 am
we were just talking about said while they personally vaccinate, it should be a parent's right to choose. legally california decided that's not the case. >> right. and legally it isn't the case. way back in 1905, people were argue being this same issue. and someone said i don't want to get my kids vaccinated r i don't want to be vaccinated. supreme court said because of the risk every health problems, to other kids, to other people, they can, in fact, make you get vaccinated. they can't force to you get the shot, but in that case they said they could fine you, here they can say, listen, if you don't want to get vaccinated that's fine becomes but your cuz can't come to school and put the other children at risk. >> i need to understanded from a legal point, i know a doctor who opposes vaccinations, the one thing he said to me is that the state will hold parents responsible for not vaccinating, but they won't hold the pharmaceutical companies or others responsible if someone gets sick from the vaccination. that seems a little
8:07 am
inconsistent. >> that is a huge outrage for a lot of people. because there is this whole set of laws that sort of exempt pharmaceutical companies from liability. the reason for that is because the science just doesn't seem to be thereto proof that vaccinations actually cause harm. and when the pharmaceutical companies are out there trying to help the children, hold them responsible, i know it is something that upsets a lot of people, understandably so, but it is sort of public policy because small pox, poll yo, measles, killed so many people they wanted to do everything they could to have pharmaceutical companies to have something to fix it. >> california went harsh, went and mandated it. locally it is not so much. they are various exceptions. here explain how we would go through that process here. >> well, it is really interesting because since that measles outbreak in california, both delaware and new jersey have started talking about bills to make a law similar to that in california. it wouldn't make it completely that you couldn't get your kids, have your kid not be
8:08 am
vaccinated watch it would mean you have to write out affidavit as to your moral or religious reason that you can't have them vaccinated. those bills are pending. it is interesting because in delaware, they have some of the highest vaccination rates in the nation, pennsylvania, has some of the lowest. and, pennsylvania has one of the most permissive laws t allows you to not have your child vaccinated simply because you're morally opposed to it. >> one more thing, we've gotten your legal analysis. now i want your opinion. a lot of the people who are out there posting this high profile celebrity, jim kerry tweeting and opposing it, do they need to stay out of this? little irresponsible for celebrity to join this this debate. >> i agree. i think ultimately specially recently the scientists proven it is good for your childrenment now, listen, there r ways to do it so it is more safe, space out the vaccines, wait until you are kid is older so they are bigger and heavier so the vaccine is not as strong, but i think that the science has proven it is helpful. when we look back to people who died of those diseases,
