shooting is what's called righteous justify. the attorney general office said it was standard practice and he has been given psychological counseling and placed on leave. people around the family say he was a victim of police overreach and has shown us that this was a justified shooting. >> these things occur when police officers go into something called tunnel vision and it becomes blurred. at that particular time his training and experience kicks in and you react quickly. >> the police say he was shot in the leg. was that on purpose not to use

accused of going into a young girl's bedroom at 2:00 o'clock in the morning and sexually assaulting her. he is described as 5-foot 2 inches at approximately 125 pounds. he was last seen wearing a white t-shirt, black best and brown pants and brown shoes. >> she is a 21-year-old mother of a three -month-old baby girl and said she was fired from her job because she needed brakes to pump milk because she was breast-feeding. she has now ignited a whole group of support from women who are breast-feeding. they are calling themselves justice for ariana. >> take a look at these photos of a boat crash that injured three people saturday night. police were called around 9:00 p.m. when the boat hit and the operator was arrested and charged with boating under the

influence pending a toxicology report. >> if you were on the transit this morning you knew your commute was a disaster. the commute was a mess. the new jersey transit took to twitter to help their writers. writers. trains are subject to a 15 minute delay. the bus service made experience delay up to 30 minutes due to a motor vehicle fire. at 724, service of the buses is being diverted due to a motor vehicle fire.

to follow up with an individual who was considered dead by the government and her family. >> they first brought us a story of a woman who received a phone call saying she passed away on april 2, 2015. nancy said social security received notice that she died which caused her to have to cancel he her medicaid and her bank accounts. since that time she has resolved the issue and they now acknowledge that she is in fact alive. we now have an expert attorney on this type of issue. is the story unique or is this

something that is fairly common? >> i don't know if it's a common problem, a common problem, but it certainly happens more than it should. annually about 2.5 million people are reported deceased in the u.s. annually, of that number there are about 12000 who are mistakenly reported. >> so we just want to clarify that, 2 million die but 12000 are reported dead and they're actually alive. how much of that is fraud or people doing it on purpose because they want to collect someone else's check and how much of it is clerical error #. >> social security has something called the death master file. it is actually commercially available and can be bought. it's called the social security death index and all it takes is one wrong keystroke and you can mistakenly be put on that list. >> is there anything our viewers

can do to prevent this or avoid it or just hope you're not part of that number? >> everyone is entitled to a free credit report every year. there are the three major credit reporting agencies in those three will give you a copy of your credit report every year. >> why would the credit report be helpful? >> the credit report agencies are going to pick up that social security file because they have a duty to verify a duty to verify the data on their report. >> i can imagine it took this long for you as an attorney to bring up a lawsuit. >> i appreciate it. >> we have an update for you from the social security administration. the new york regional medications director explained that nancy's story was a rare example of rare human error and offered an apology.
