8:07 am
arrest, the investigation will attempt to determine was that use of force appropriate? >> lots of comments about this story immediately came in on social media. aaron fullerton white nypd cops ft. a description i love to hear that description and fewer than .1% of americans are celebrities. imagine how many never get assaulted by police that we never hear about. #james blake. we wanted to bring in legal analyst ken roth whileer. >> good morning. >> good morning. >> we've seen the video you've seen the video we can debate whether it was racially motivated. was it excessive. >> we don't know what was in officer's mind obviously as you look at the video there's nobody that can say it's not excessive. james blake was leaping against the wall at the hotel and next thing he knows the big guy runs up to him grabs him around the
8:08 am
neck swings him around tackles him tlodz him to the ground and tackles him. james blake mind had to be going crazy at that point in time. if you watch the tape he doesn't resist at all which to me is amazing because obviously he didn't do anything wrong. but this force exhibited by this officer was obviously excessive. he's going to be in a lot of trouble. james blake if he wanted to could bring a civil lawsuit against him. this is one example of police going above and beyond in terms of their force they use. and what's interesting bill he did not identify himself the police officer did not identify himself. james blake had no idea what was going on. >> that's interesting thing that came to mind when i saw the video the officer did not identify himself. thankfully james blake was cal calm. change that scenario someone rushes you and you take a swing at them and then turn out to be a police officer he would be significant legal trouble wouldn't he. >> he would. but i think it would be defense
8:09 am
i believe what he did. if he took a swing at this many think it was totally defense i believe it looked likeself defense. the police officer didn't say anything to him. imagine if you're out in the street and all of a sudden somebody runs up to you gets in awe headlock and swings around you don't have to submit to that you have a right to defend yourself the officer's problem here he didn't identify hi himself. if he would have said i'm a police officer, i want to talk to you or put your hand behind your back that's different. that's exactly what the officer didn't do. he did not follow protocol. and this police officer officer frosctori is in a lot of trouble with his department heads. >> we'll talk more and bring you back and further expand. this one is not going away. >> does seeing you, bill. >> good to see, always. >> we want to know what you think. this discussion will not go away. leave your comments on our fox 29 facebook page ar tweet us at fox 29 philly and use the

>> two weeks away from the ol holy father visit coming to philadelphia in that particular location. news continues to come out about how pope francis being in town will affect city residents and business owners and visitors. here's what we learned this week. first off if you plan to come to philadelphia there's still plenty of hotel rooms.
9:11 am
officials actually held a press conference to announce that rooms are still vacant. also the philadelphia parking authority is making arrangements for city residents to park their car during the world meeting of families. the parking authority announce today will on designated garages for residents it park cars from thursday the 4 until monday the and cost will be 20 bucks and if you have a valid residential parking permit the ppa will waive that fee. if you park normally for free you can pack for free in these lots. don't expect mail delivery if you live any secure sdochbility u.s. postal service says zip codes within that zone will not have pickup or delivery. now be sure to joyb us when pope francis comes to philadelphia. fox 9 has all day coverage on september 6 and 27 at the holy father -- as holy father makes his historic visit to our city.
9:12 am
hi i'm bruce gordon if you blinked you may have missed this week's online distribution of free tickets for best views of pope francis when he visits philadelphia later this movement world meeting of families says during three distribution sessions thursday and friday thousands of passes were gobbled up in minutes and then it happened, again and again and againa all three seeings followed by ticket winners putting a once in a lifetime opportunity to see this world leader and religous icon up for sale on craigslist and ebay papal passes were on the block for hundreds of piece a block of four came with four figure asking price. to be fair not all the scalpers were philadelphiaians this was an online operation. winners could have come from anywhere. this is philly event and just about anything that happens before or during the festivities becomes part of our legacy.
9:13 am
i brought attempted scalping to attention of mayor nut erin showed him resale sight. some ticket offers were taken down from those sites for violating policy though it's not clear there's anything illegal about the resale attempt. of course that's not really the point. look i'm not catholic but i've been fortunate enough to be up close with pope francis twice in st. peter square during the coverage of the run up to the world meeting it was a moving experience for me even more so when i saw the faces of the true catholic faithful folks who had in some cases traveled fwraet distances for the chance to be somewhere near this hug hugely important figure. to go out of your way to win atic tote get you that privilege just so you can turn around and try to make a buck off someone else desperate enough for that kind of thrill, well if you're that much in need of cash, i empathize with you. if you're that morally bankrupt i pity you. only in philly.
