>> from the department of justice is not legally binding, but there's a, what, schools that don't comply could use federal education dollars. joining us is jeremy senior counsel from the pennsylvania family counsel and attorney angela, talk a little bit about this. good morning to both of you. >> good morning. >> good morning. >> let's start with you, jeremy. the federal government comparing this to gender and racial discrimination. in taking issue with it, you disagree, tell me what your challenge with this. >> we think that we can respect the dignity of every person by providing the safe space and privacy, and there's few areas where the biological differences matter. those are in the rest rooms, locker rooms and showers and dormitory rooms and things of that nature. now, the race analogy is problematic because when you look at a water fountain or bathroom that has nothing to do with the color of your skin. the only reason that we have separate rest rooms and locker rooms in the first place is because of the biological

differences. >> angela your response? your both attorneys and activists, this is a two-front fight for those advocating legally and getting out there. >> how do you respond. >> unfortunately, i didn't hear anything he said. >> he said gender is an issue or separate sex is an issue as it relates to bathroom. it's not as it relates to race or some other comparisons. >> i would completely disagree. you know, we do -- you do three things in life. we eat, sleep and we go to the rest room. and to deny kids one of them at their foremanmative years while in school, the ability to use the rest rooms they feel matches their gender identity. >> i'm hearing anything. >> being comfortable at school. which is you're being discriminated against for race or any other reason, to me, they

completely relate and it's a civil rights issue. when you have 80 percent of high school kids feeling discriminated against at school and unsafe at school, transgender-wise. that's the stat it's are staggering. really, i just my heart going out to the transgender children that have to be in school in today's day and age. >> they're having difficulty hearing each other. jeremy, i will tell you angela says it's about comfort level and you have individuals being bullied and discriminated against. of don't we need to make accommodations for them and allow them that comfort. >> you know what? we think transgender people when they use a rest room, they shouldn't be bullied. if a transgender person comes into the male rest room, i would stand up and i think everybody would stand up to prevent bullying. of the only reason we have the rest rooms in the first place is because of biological differences. schools need to know this

directive is not a legal binding directive. and western pennsylvanialy from court march 2015 held that it doesn't violate title nine or equal protection of constitution. a big problem with the way this is being interpreted. you're giving one student the ability to choose which he have rest room they want to. they've two maybe three options available and you're telling others they would only have one rest room available to them. it would be discrimination on the basis of gender identity to tell a biologically male student who identified as a female that you can no longer use the male rest room. that would be discrimination on the basis of gender identity to tell a biologically male student that they can't use a rest room that compends with their biology. if you another student who

identities as male, that violates the constitution. >> interesting point. angela, as an attorney i'll let you have the last word. what jeremy saying essentially this is discrimination you're allowing choice of bathroom to some and not to others, do you end up discriminating against those not transgender. >> absolutely not. the issue is everyone is allowed to go to the rest room of their gender identity. there will always be a bathroom for those that are be uncomfortable. so if you are uncomfortable going into the woman's rest room because a trans woman may be in that rest room, go to the single stall and you segregate yourself. however, we're not going to create a bathroom for transgender individuals. so no one is discriminated against. everyone can go into the woman's rest room or men's based on gender identity and then if you are uncomfortable only as a trans person or a gender person,

it's a good day. i'll tell you about a day to different families, 7:38 a 5-year-old boy credited with saving his dog's life from a retail snake but wound up getting bitten in the process. >> he was playing with his dog sunshine in his backyard in california when he noticed the snake. his mom said the boy noticed the animal. he pushed the dog out of the way and ended up receiving the snake a bite. his mom amy reacted quickly killing the snake, then noticed her son was foaming from the mouth. >> so scared because i know that the baby rattle snake are worse than the mother, bigger snakes because they hold on longer. they don't know how to release the venom, so it really got him. >> are you afraid of snakes. >> now i am. >> it's a great thing she actually knew that information because lend received 35 vials.

dashboard. that guy got glass in his eye. another girl got hit. a spike went through the roof of her vehicle. and another guy, the last guy that we know of being hit. he thought he got hit by a rock. he pulls over and runs up on to the railroad tracks 40 feet above and chases the guy and catches him and that's how police caught him. here is one of the officers in charge out here in southwest philly, john walker. >> very dangerous incident that happened out here. you see these spikes. the fact that they are nailed into the ground they're sharp edges being thrown at cars and you see the damage caused and one impaling into the actual dashboard of the car. could have been much worse. >> look at the overpass, so recognizable. if you're going to any of the hospital, penn, children's, veterans, if you're going to the campus at penn, you come off the schuylkill, you go on to this overpass. this is a railroad overpass, these spikes and those kind of rocks that are under the railroad ties, they won't just fall down off of that on their own. of amtrak had to go up there to

brunch. i got a little breakfast make and cheese going on. i use cut ham, basile and toss it with white cheese. it really works. it's always great to get some kind of breakfast meat in there. of bacon, i use smith field's cooked ham. it's easy, quick to go. >> who's the lover in your life? who is this woman you're keeping in bed. >> all right now, you know, hey. >> i had another mental segway that i'll keep to myself. >> let's no got there. chicken and waffles. individual servings. of crusted chicken, make your standard waffles. use protein shakes. of you get that in the morning, i like to work out as you see. i like to get extra protein in the breakfast.
