7:13 am
us for whatever it may be. on the newses right thousand at exactly 7:13. this weekend marking the one year anniversary of the supreme court's legalizeing gay marriage. dedicated to the price of the lgtb americans. the stonewall and christopher park right across the street from manhattan's greenwich village will now be a protected area. the supreme court handed out a series of decisions this week and at least one of those decisions we saw what could happen when the court is equally divided in a four to four tie of after justice and the ton scalia's death. the court is expected to hand down more decisions next week. joining us life to break it all down, heather hanson. good morning. >> good to see you. > the whole ruling comes down the it was a first look into what happens when you can't break a tie.
7:14 am
should we be concerned about this going forward? >> listen, there's a reason we have an odd number of justices, oftentimes ties do happen and it's important to be able toive that a court. president obama has nominated someone and it's just sort of sitting there. you have to remember, bi, that the next president is going to have a huge amount of control because you have two supreme court justices who are in their 80s. there's a good possibility that are going to have to fill four vacancies. the justice picture is a huge thing that we need to consider. president obama trying to allow the parents of children who are legally born here to stay in this country. the court essentially said that was illegal. clarify for me. they said i was illegal, not unconstitutional. the constitution obviously is the overriding law of the united
7:15 am
states. it falls pray to the constitution. what happens here is that the court, the lower court and then the appeals court said that it's illegal because it doesn't follow certain federal laws as to how the public is to be put on notice about it. so the court put in an injunction saying we haven't decided h this case on its merits but until we do we're not going to allow this law to go into effect. the case hasn't actually been decided on its merits. chances are it will be decided in a way that is consistent with what they've said so far that it's illegal. what this all means is that chances are it's going to go back to the supreme court. hopefully by the time it does we'll have a full seat of the supreme court, all nine of the justices and a true decision will be made as opposed to this tie. the court also looked at affirmative action. in this case they ruled that the university of text could use raise as one factor. >> right. > it could be taken into consideration. is that precedent setting or is that pretty much allowing what was already taking place
7:16 am
promoting diversity t. >> it is an important case because it does have precedence and there is a important interest in having a diverse student body. this university tried other ways to make that happen and it did not happen until they put h this policy into place that was affirmative action. so it does mean that affirmative action is going to be acceptable if the right factors in place, that there's an important education l a in to make that happen. if the school has tried other ways and those ways have failed. it is a very important case foray philadelphia international airporttive action and that it has been a long time coming. one more controversial story we'll touch on lightly. dui. the supreme court ruled that it is not illegal to force someone to take a breathalyzer. it's not an illegal search for violation of their privacy. should we expect more states to pass laws similar to what we have in pennsylvania that punish you if you don't take the it. pennsylvania, new jersey and delaware all have laws that say if you don't take a breathe
7:17 am
lieser test all be unpished. you've going to see that across the country. now that the court has said that that is constitution i think we'll see it across the country. heather hanson takes con fusing issues and breaks them down for us. have a good day. >> you do the same. > later on in the show we'll be making summer cocktails. let us know which ones are your favorite and we have one from renee armstrong that says extra bring margaret a. david warren what is your favorite summer cocktails? >> captain morgan and gingerale. a great look at bushkill falls and speaking of summertime weather we have a few clouds. just a great start to the day here. now, a the lot happening today. this is a big event happening right over in camden. today from 12 to 6 iso limb picks day, a funny familiar
7:18 am
fitness center in camden. will we need sunglasses or an umbrella? was he's the weather. >> put away the umbrella, you need the sunglasses and the sunscreen. the temp are warming up into the 80s. low humidity. not quite as humid later this afternoon up to 81-degrees. there it is camden all clear on ultimate doppler radar. much happening here. no storms expected today, maybe just a few low clouds and drizzle right along the coast certainly not picked up by ultimate doppler. temperatures starting off into the 60s this morning. it will climb a bit in the city here along i95, the north and western suburbs, but there is a good east wind coming in. that will keep the temps down especially along the coast. high pressure in control to the north. creating some low clouds down the shore this morning. they should begin to clear out. elsewhere pretty much keeps us clear. a few clouds maybe a shower well up into the poconos.
7:19 am
that is about it. every where else we'll stay dry. low clouds overnight developing just off the coast. we could see a repeat of that down the shore and delaware beaches. what to expect, low, we are looking at lower humidity, temperatures climbing today, just as warm, not as humid. nice and comfortable. low clouds and fog especially along the coast. 78 south and east. i is a little cooler today with just a few more clouds. our seven day forecast of could have the return of a humidity and the storms. coming up in just a little bit. > sounds good. thank you very much. not a the lot of rain in our area, but did you see what's going on in west virginia. >> horrific. west virginia is currently experiencing some of the worst flooding that the state has ever seen. > can't get in, can't get out. coming up how they are dealing with the deadly floods that have at least 23 people dead. a quick way to get from one floor to t another. look at that. a great view of the city.

7:26 am
i got a lot of pressure. i'm used to it. as long as i work hard that's all i can ask for. there's got to be some patience to this whole process, i think that any young player coming into the game is going to feel that but we're go try to tread that across the entire team so it's not just on ben's shoulders to bear that weight.
7:29 am
7:29. a respect lful song, mouthing the words. over at the manassas music center. that should be a great concert. we should go. we should. we have a bar mitzvah tonight, though. > let's take a look at some of the headlines that are making news right now at the bottom of the hour. we know that there has been horrific flooding. 29 dead. the fear is that number is going to up. water running down the hills. they're dealing with the emergency flooding situation. they're calling it catastrophic, washing away as you can see roads. more than # 100 homes have already been lost and the power
