7:14 am
> we're continuing to follow breaking news this morning. seven people, including two police officers were shot
7:15 am
overnight in our city. here is what we know this morning. it all began at 116789. 19 last night much. that's when sergeant sylvia young was sitting in her police car at 52 and seventh streets when a gunman came up and ambushed her. she was shot several times in her arm and her protective vests. other officers gave chase and that's when a gunman fired into a bar at 51st street. there was a security guard wounded there. then the woman grabs the woman and uses her as a human shield. eventually he shoots her in the leg. he runs down samson streets and shoots several shots. there was a man and woman sitting in the car. the woman who was shot in the chest did die at the hospital. police eventually cornered that gunman at 48th and samson and that's when he shot an officer by the university of pennsylvania, his name is eddie miller. officers returned fire striking and killing that gunman. and happening now, a massive vehicle recall to tell you
7:16 am
about. if i at chrysler is pulling back nearly 2 million vehicle also because of an airbag defect that could keep them from deploying in a crash. three deaths and five injuries have been linked to the defect. the recall includes a number of models sold between 2010 and 2014 including the dodge caliber, avenger, jeep patriot and come pass uvs. samsung is in the midst of its galaxy note 7 because they might catch fire. the company has offered to offer consumers a full refund or a replacement phone. so when a recall is issued do you lose any legal rights. we haven't whatted to talk about it, dig a little bit deeper, joining us tonight, ken rot while. tell us about this. you're talking about a million phones. to me, i'm not an attorney which is almost an admission for guilty. this is opening the doors for
7:17 am
the lawsuits to begin? >> i think yes and no. once the company finds out there's a problem with their product they're duty-bound to tell the people that bought that product. for somebody that was injure, that recall may or may not be good from a legal standpoint. what would happen is the case would go to court and then a plaintiff's lawyer who represented the person who was injured would want to bring that recall into court as evidence -- as evidence of a defect that the company now admits their defect. it's questionable whether that actually would come in or not because there's an evidentiary rules of the courtroom that may not allow it because there's something called a remedial repair, which a company is supposed to do. in other words they're supposed to repair their products, so under certain circumstances it may not come in. it'sens of i question so it depends on the trial judge. it's almost like saying oops, my bad, but at the sam time you're admitting that you did it. legally does the recall protect
7:18 am
you from the lawsuits or is it a case by case? it really is case by case. let's suppose you get a recall, let's suppose you owned one of the cars and you got a recall from the company and you you know what, you said my car seems okay, i'm going to keep on driving it and you keep on driving it for let's say six months or a year and then the defect kicks in and then you're injured. that recall could be a bar to you bringing a lawsuit actually. actually a defense with regard to the company because they would you assume the risk. the company would say we told you about the defect, you you didn't do anything about it. therefore, it's a defense for us. you assumed the risk, therefore we're not responsible. it really depends on the the facts of the case and it really is a case-by-case basis. they have issued the recall. wrapping on this, ken, in your experience when something like h this happens, a huge damage to the company or do they move on? we saw something similar with ikea. it could be huge damages to a company. in ikea's case they recalled
7:19 am
29 million dressers. this is a big, big potential liability for the company. the first thing they have to do is tell the consumers about it and let's see what injuries there were and there is potential big exposure for the company, both for ikea for their recall and also for samsung because their batteries are over heating and those phones are exploding. rot while making it clear like you always do. have a good one. > 7:19 is the time right now. let's take a live look outside because it is going to be a fabulous day. look at the morning. we have a nine on tap on this day. scott williams we had a beautiful moon this evening. we called that the harvest moon or the and it basically is the full moon closer to the echoy knocks. as we take a live look outside our studios, it's dry. folks are out and about and running some sat morning errands, getting some breakfast, grabbing the paper, you can whatting the doing.

intern and now a junior reporter. for having me. our athlete of the week was very, very exciting. his name is d'andrej swift. he's currently a senior at st. joe's prep but he's already made quite a stir on the college recruiting process. take a look. deand asmith is not a name you'll want to forget. the young running back is training for his final season as a high school season. the philly native is just 17 years old, but his coach will tell you he has made quite a mark on the high school school football team as captain. he combines both strength and speed. he's got great ability in the slot to catch the football and running great routes. it's very rare that you find a running back who has all those attributes. the five foot ten senior can bench over 340 pounds and
7:56 am
averages 6.2 yards. if that's not enough he's a two-time state champion and was selected to the u.s. army all bowl this year. football is my favorite sport. d'andrej's teammates also feel the passing. he's the best player i ever played with. much whatting him i'm watching greatness. i'm going to enjoy every second of it. he's getting ready to play football at the university of georgia. he was named the number one high school running back in the the nation by some experts and his coach knows firsthand how georgia is lucky to have him. he's a very special young man. he's a culture change. he's someone that will help your culture develop. enjoy him for as long as you you have him. i have. > that's why we are naming deand dry fox 29 athlete of the week. > good story.
7:57 am
you got to spend a little time with him. he doesn't have an nfl time. that's correct. i did ask hip, nfl season is upon us. do you have a favorite team? he said, no. of course he will be rooting for georgia. it's clear to me that the bulldogs have gained one of phillies finest. > enough for a first story. good to see you. do you have an athlete of the week that you would like us to feature? all you have to do is send it to us. all you have to do is tweet us, instagram, twitter, you name it, just make sure you use our hashtag, fox 29 good day and we'll he be right back.

chaotic night as violence unfolded across several city blocks. here's what we know so far this morning at 11:19 last night, sergeant sylvia young was sitting in her police car at 52 and sansom when a man came up and ambushed her. she was shot several times in her arm and her protective vest. others of oners ran after the suspect when the gunman ran into a bar. the man grabs a woman, uses her as a human shield and shoots her in the leg. he continued running down sansom when he shot several shots in a car where a man and woman was just sitting in the car. they were both shot in the chest and the later eventually died. officers cornered the man and that's when they shot a university of pennsylvania security guard. sabina kuriakose is live at penn

presbyterian hospital. >>reporter: officer young is in stable condition. authorities are calling that nothing short of a miracle. sergeant young barely had time to look up from her police crewser when bullets came flying in from her crewser. last night we were told that officer young was in stable condition. officer miller was awake and joking with his family. all of this release tainted by news this morning that an innocent bystander has died. she was a 20 year old woman. she was shot in the chest by the gunman as he ran from police and another man sitting in that same car as that victim was also hit in the chest and he remains in critical condition. we do have calls out to penn presbyterian to confirm how he is doing this morning. we do know that those victims were in the the or as of last night. one of them has died. two other victims were shot in the leg after the suspect shot at the bar as he fled. this all started again at 52 and
8:02 am
sansom. it ran for four blocks as the suspect ran from police. he was cornered and killed in an alley. in fact, that is where officer miller was wounded after he was the first person to spot the suspect and open fire. again, the suspect is dead, but he has not yet been identified by police. though police are releasing a motive in all of this. they say a letter was found allegedly by the suspect indicating anger at police. that letter that he has is a bunch of rambling which indicates his hatred for police officers and probation officers. he clearly was trying to target a police officer, as he did. that was the initial shooting victim, the sergeant. we have no reason at this point to believe that it's related to any beliefs of a religious nature or anything like that, just his feelings about police departments and police officers in general and probation
8:03 am
officers. > now, that question about religious beliefs came up after officer jessie hartnett was shot in january in the same district by a self-proclaimed isis supporter. again, police are saying that religion had nothing to do with this motive and this was solely based on an expressed hatred the at police. authorities say that they believe this is the only suspect that was involved. they believe this is was isolated to this one man. he is now dead and we are still waiting for police to identify him. again, the officers here expected to survive, in stable condition. we do have two civilians still injured. a third man also in critical condition. he is still fighting for his life. again, one confirmed fatality, an innocent woman just sitting in her car after all of this violence began. it is just so sad, of course exactly where sabina is, that's where we take all the victims. i was out there when we had this

i'm kind of into social media. silly science we're looking at what researchers are up to this week and h week we're talking about social media. we're finding out that you may be able to teach an old doing new tricks. don't call seniors an old doing. they may not be too old for technology after all, some people say. according to researchers the at michigan state university, more than 90 percent of senior citizens said in a survey that they were either somewhat or very satisfied with social media and nearly a quarter said that they still wanted to learn more. they're excited about it. they also found that using social media was associated with a lower risk of loneliness and was tied toette abouter physical and mental health. there's health benefits ting being online. the study did not prove that social media improves a quality of life. it only provided a link. however, it does explain why you may have gotten a friend request

she'll test us now how the officers are doing. >>reporter: bill, this morning we know that those two officers, sergeant sylvia young and officer eddie miller are both stable here at penn presbyterian hospital, although we do know that a young woman in her 20s is dead. she sat in a car with another man who was also shot. that man is fighting for his life. he is in critical condition. two other victims both bystanders also injured in the leg. one was a suspect used as a shield. all of this started with the ambush on sergeant young at 52 and sansom as she sat in her patrol car and spread across four city blocks as the suspect fled and chased by police. he was later cornered and killed in annally. later a letter was found
8:31 am
including rambling of hatred towards police. i remember standing right here outside of penn presbyterian hospital when the last ambush hospital. here's commissioner richard ross talking about the unprecedented violence against police officers that we have seen in recent months. you'd have to go back to the of 60s and 70s when stuff like this was occurring. even in this district we've had at least two, p if not three. in every instance we are very blessed. at least with hartnett and now with sergeant young, i mean, you got an individual who is walking right up on their police car unprovoked and just starts firing multiple rounds into the car. it is absolutely amazing that she is here. > now, police have not release an identity on this suspect just yet. they do believe that he acted alone and as of last night police were actively searching
8:32 am
for other victims. in fact, in the letter that the suspect allegedly left behind he actually named a probation officer and police were tracking down that probation officer as of last night to make sure that that officer was okay. now, again one completely innocent bystander has been killed. another man in critical condition, two other bystanders injured in the leg. a police sergeant and officer shot, one of them sergeant young, the intended target but they were able to escape with their lives. one other thing that i wanted to mention to you, bill and karen as we rap this up. sergeant young as our dave stress wiser reported yesterday, she was on special assignment here in this district. police have been stepping up efforts to combat recent spikes in violence that the city has seen. that's what sergeant young was addressing when she was ambushed if her what troll car. just doing her job when all of this happened. > back to you. >> this has got to stop. > scott, we continue to look at
