>> we're not done with the rain but i can tell you this, it's not going to be a wash-out of a weekend. that will be good news. but we do have cloud cover out there and some rainfall chances for today. so still kind of damp and gloomy out there. drizzle, fog this morning, let's talk about the temperatures. right now, it's a little cool upper 50's in philadelphia. look at the winds, still out of the northeast at 13 miles per hour. so it's been above average with a temperatures breezy, kind of nasty over the last several days. weather with the number, scale of one to ten, definitely not a ten. so we'll kind of go in the middle there for today and give it a five. weather by numbers. as we focus in on the weather headlines, it's going to stay a bit unsettled. once again, it's not a wash-out of a weekend and then hurricane matthew a powerful monster hurricane in the caribbean. we still have the upper level low off to the west. cloud cover also more showers in the forecast for today. temperatures top out upper 60's, by tomorrow, more sunshine.

tomorrow morning for fox 29 good day philadelphia weekend. it is 7:03. two firefighters killed while battling flames had a row house fire a week ago on this day will be remembered at a puck service in wilmington >> it will be the community's chance to say good-bye to fallen heros and and jennifer joyce is live in wilmington. >> reporter: good morning, karen and bill. more than firefighter how to people are expect to attend. looks like we're having a little bit of trouble with the video. jenny are you there? . >> reporter: good morning, bill. so funerals for both firefighters were held earlier this week. today's public service will honor the lives of wilmington fire lieutenant christopher leach and senior firefighter jerry fickes junior who died in the line of duty on september 24th. lieutenant leach was working for a friend the day he was killed. he rushed into a burning home on

lake view road thinking there were still people inside. the four collapsed trapping and killing leach and senior firefighter fickes four other firefighters were injured. >> jerry will help us, they made us strong in life. we love them and they loved us. >> from that day that i met him, we've been friends ever since. he's that kind of guy. just want to be around him. he's the lieutenant you want to work for. >> reporter: murder of both firefighters, officials say she was temporarily living at the home back live outside the chase arena, doors will open at 11:00 this morning, the memorial will begin at 1:00 and both firefighters leave-hand family, so there is a gofundme page set up for the families of the fallen. it is also posted on our website, fox29.com.

karen and bill? >> thank you. firefighter officials say everyone is ok this morning after a car fire spread to a home in west philadelphia. crews were called out to the scene of the 3900 block of poplar street just before 1:00 this morning. there was a pickup that caught on fire. there's the remnants of it right there. it spread to the house next to where that truck was parked, but it was all brought under control a short time later. no injuries reported. also, in kingsessing, a man in the hospital of a being shot twice on the 5300 block in chester avenue. a 54-year-old was taken to presbyterian medical center in stable condition. investigators are still looking for a gunman. in a north philadelphia, police are looking for three men who broke into the home of temple students. these students are on the second floor along the 1500 block of west thompson street when they say the men broke not house, through a window around 3:00 a.m. wearing black hoodies, armed with a gun, they did get away

with electronics. police are warning parents and children in this area to be on the look-out >> creepy clown sightings have been reported across the country. radnor township police say someone spread the threats on various social media sites under different hash tags, this one threaten to either kidnap student or kill teachers, police posted on their website and crime alert that the posts are being identified as a hoax, 17-year-old mary nailer said student were so concerned a police officer showed you wanted for reassurance >> he was clowning around and they were talking about how they were going around to schools >> nothing has been founded in this area. but somebody play an evil trick on people and actually getting people legitimately upset. >> everybody unfounded but people are concerned. the threats forced other areas to issue similar warnings.

more questions this morning over police response to a dangerous suspect. police shot and killed a man identified as christopher soul after he allegedly stabbed two children and two adults on wednesday. >> police right now are confirming they did fire a large number of shots. more than 100, 109. police now say that man was unarmed, although he repeatedly ignored order to take his hand out of his pockets. evidence circles on the shooting scene number up to 69 with thrown hor circles not numbered. some neighbors say even if this was a bad guy, this type of gunfire makes them feel uncomfortable >> those shots were primarily contain to do the two house, one of which he was in front of in the house next door. they largely served as a backdrop. unfortunately for the people in that home, did it kind of put them in jeopardy. they were not harmed, but it of serious concerns to us the number of shots fired.

crash of new jersey transit train 1614 at the hobocken terminal. they're still waiting for debris to be cleared to gain access to the front car. contractors are working to repair the roof collapse and to be sure that there's no asbestos hazards before they can recover the other data recorder and cameras mounted to the front of the train. they're hoping to find information about how fast it was going when it failed to stop in the station. smashing over a bumper and into a concrete wall. >> that's the question of the hour. everyone is speculating on this. we don't do that. we're going to wait for the actual information >> train's engineer 48-year-old thomas gallagher has been with new jersey transit nearly 30 year, operating trains 18. he was reportedly found slumped over the controls after the crash. we don't know if that's because of injuries or if something else happened prior to that. that the part of the investigation. weather the liabilities? joining us by skype, ken rothweiler. good morning, sir. >> how are you doing, bill?

>> good, always a pleasure. when you hear about this going through barricades and bummers into the station, seems like there would be some immediate liability. but when you look at this, is there necessarily someone at fault or is it just mechanical? >> we don't know right now, bill they don't have information from the recorder. they were trying to download the event recorder and couldn't do it. so they had to send it to the manufacturer in order to get the information out of it. there's actually two event recorders, there's another event recorder near front and they're trying to dig it out right now. look, there's two possibilities. it could be a mechanical problem. maybe somehow, the throttle got stuck or could be human error, but the event recorder will let us know exactly what happened. as soon as that's gleaned we're going to know a lot more than we know right now >> from a liability standpoint

you got one person tragically killed. hundreds injured. does it even matter if a conductor or user error in terms of whether or not there's going to be some sort of legal accountability >> it makes it a lot easier if there was some type of human error. let's closed the engineer fell asleep or something like that. makes the a lot easier to prove. you're right. if it's a mechanical error, there's legal theories, which would make the new jersey transit, you know, liable. we really have to find out more information. the recorder is going to tell you a lot of things, bill. it will tell you the train speed, whether there was brake use, whether there was a throttle problem. i would think within the next couple days, a lot of these questions we have will be answered >> once again, we're hearing no ptc, the positive train control that would automatically or supposed to automatically shutdown the trains as they approach. at what point from a legal standpoint do people start demanding this has to be in

place? this is the third or fourth accident we've heard of where ptc at least in theory could have prevented it >> that's also what happened at the amtrak crash in philadelphia, i'm handling a number of those cases, that's the theory in that crash. let me tell you what's interesting that a lot of people don't know. this same accident happened at the hobocken train station back in 2011 and it happened before because there wasn't positive train control on those tracks. and they said at that time, remember, this is five years ago they would, in fact, place that positive train control on those tracks. it didn't happen. had they put it on there, i think this accident would not have happened. there's been kind of a mandate across the country to put these on all of the different train stations, and to date, it has not been done. >> again, does it matter in terms of legal terms that you promised to do something that, in theory, could have prevented an accident. you didn't do it. another accident happens, is

playing a little bit of george and michael songs, michael jackson, pretty young thing on this soggy morning, but we're all in this together. we'll have a great one. >> we're all in this together unless you're trying to get a ride with uber or lyft. the ride share aps are back in legal limbo in the city, now that a temporary agreement to allow drivers with companies like uber x and lyft operate in philadelphia, in agreement expired. technically, it's illegal again. the agreement was struck in july in time for the democratic national convention. the philadelphia parking authority could enforce regulation that is could restrict the ride sharing drivers, the agency has been known to impound uber x drivers in the past. it has applied for an emergency extension but uber x will still operate despite the ban. they're going to keep going.

the philadelphia orchestra this weekend, consider your plans cancelled. musicians are on strike. the musicians of the philadelphia orchestra are members of the philadelphia musicians union local 77. the biggest bargaining is compensation like it is for so many. friday they collectively represented the orchestra leadership salary offer. negotiations will continue on october 4th. meaning the concerts for the weekend, including october 1st and second have all been cancelled. on septa returning to a regular weekend schedule starting monday, bob kelly talking about this. three months after the transit agency sidelined all those cars 120 of them because they had structural problems. regional rail has been forced to run on its modified schedule ever since early june, which caused delays, headaches for commuters and dropped obviously septa's ridership >> we were just talk about, is it time for vacation? halloween? a little chilly out there. in the too bad with the weather.
