the face. so now police trying to figure out how did he get his hands on the gun, whose gun was it? a lot of questions, jenny. >> yes, there are a lot of questions, police tell us they're wait to go get search warrant to go into the home and get their hands on this gun, figure out who it was registered to, there is still a police officer, here on the scene, on the 2600 block every south hick street. the boy's family is with him at chop, as he continues undergoing treatment, while he was transported in critical condition. we are told he is expected to survive. investigators tell us, that this 11 year old boy lives at the home with his parent, and his four siblings, and police tell us just before 12:30 this morning, they found out that a child was transported in a private vehicle, first to methodist hospital, after he was shot in the face with a revolver, the child was then moved to chop for treatment. the shooting happened in the child's parent's second floor bedroom, according to investigators, at this point, police believe that this was an accidental shooting. >> doctors at methodist

hospital initially put him in critical condition. and they had him transferred to children's hospital, since methodist hospital is not a trauma center. once the child arrived at children's hospital, he was treated by doctors, now, he is still in critical condition, with a gunshot wounds to his face, however, doctors at children's hospital do expect him to survive. they also say this 11 year old boy is conscious. >> and police say they found the gun that was used again, in the shooting, in the bedroom, wear it all happened. investigators tell us that the boy's family was home at the time of the shooting. right now, those family members again are at chop, with the child, they're also beginning to talk with investigators so investigators have a lot of questions, they're trying to figure out how all of this happened out here, mike and alex. >> thanks, jenny. 7:06. >> teenage girl hospital in the critical condition after police say she was hit by a car while using face time on

her phone. abington police say the 14 year old girl was head today cheerleading practice at abington high school, was talking to friends via face time when she crossed highland avenue, running into the path after passing car. this happened before 3:00 p.m. yesterday. police say the driver stopped, did help the victim. her friends are just stunned. >> it is kind of surreal. because she was just going along, face time ago friend, who ever it was, and the fact that that could happen to you, in 102nd, is very scary. >> investigators say the driver was released pending further investigation. police are trying to find more witnesses, as a girl gets treated for her injuries at chop. >> yell, straight on her phone, walk in front of her car. >> the man charged in that deadly road rage shooting, that the whole nation was covering, will be in court today. >> it is a case that, like you said, captured national attention, especially here in

our community, so many people feel very strongly about this case. sabina kuriakose at the chester county courthouse in west chester with more on what's happening this morning. >> reporter: good morning, mike and alex. well, here, at the chester county courthouse, the trial is set to start. it will be the first formal arraignment for david desper, now, last week he had preliminary hearing, it was the first time he came face-to-face with his alleged victim's family. at that hearing he waived his right to it, so it really on the lasted few minutes, let's go to his photo, mugshot provided by police, cameras were not allowed in the courtroom last week, but desper entered with his handcuffed, and shackled, he did not look at bianca roberson's family. let's go to photo of bianca. this was the alleged victim. prosecutors say desper shot 18 year old roberson in the head as two merged lanes back in june on route 100 in west goshen. now, surveillance video caught what cops say was desper's red pick-up truck leaving the scene shortly after bianca's car crashed.

it was later found dumped in a neighborhood. after a three day national manhunt with police getting thousands of tips from across the country, desper turned himself in, with an attorney, by his side. now, last week at the preliminary hearing bianca's family of course very, very emotional. now, prosecutors say they believe this motive in this case may have been road rage, but bianca's family has said they believe it may have been something more than that. let's listen to her father speaking to us from last week. >> would you raise issues that you were concerned that you believe that this was race-based, that he shot your daughter because of the color of her skin. >> yes, because i can't think of no other alternative he would have done something like that. my daughter wouldn't have did anything to him that would have caused him to want to shoot her like that. she wouldn't have been jog egg for no position on the road, from what i understand, she was already in her lane. >> so should prosecutors mover against him in a number of ways including a race-base

prosecution? >> well, i can't really speak on how they should do it. but i think they pretty well have it underhand. >> bianca's father there speaking to our jeff cole. so as you heard there, their family is putting their trust in the justice system. now weaver not heard much from the defense attorney in all of this or from the suspect, david desper, we don't know exactly what defense they'll mount. now desper faces first and third degree murder charges, and that's what what we believe he will be arraigned. hearing set for 9:15 a.m. this morning. as you mentioned earlier bianca set to start college, moving into her dorm week this week, that's according to her father. >> cameras be there there. >> makes it so sad, she had so much life ahead of her. >> for sure, only 18. let's get to st. louis here, something happened overnight. >> well, a driver hit three protesters while he was trying

there was a lot of circumstantial evidence pointing in to his guilt the. >> yes. >> just wasn't enough evidence to convict him the first time. prosecutors could have much like, you know, other case that is we talk becomes high profile cases could have decided to try him again. i think this community would have appreciated the camden county prosecutors office going all or none, you know? if a jury acquit him, fine. but i don't think that you sends a very good message to the general populous when you allow a person of this magnitude, did such a haneous crime to his own seed link, to walk away with ten years. >> well, who gets -- who would they ask? i mean, would they talk to the little boy's other family members to see what they wanted to do? >> absolutely. the reason this came as a surprise to all of us, there was no news conference called, because they talked to the family, in private, to make sure this was done with their blessing. and for whatever reason, not having to go through the rigors of another trial, the family agreed it. >> get it over with.

>> absolutely. there is some value in that as well, make no mistake about it, the pressure, anxiety goes through sitting through that kind of trial couldn't be described in words. >> so many people though, i mean, we don't know what the family has gone through, but a lot of people feel strongly about. >> this they say ten years? how do they only, you know, how could they make a deal for only ten years? >> what i mean. so when the camden county prosecutor's office goes to negotiate cases, you know, in the immediate future, people will be thinking wait, that dad killed his son and got ten. i only did xyz there is will be looming large in people's minds going forwards. >> do you think they just had no evidence, they didn't think they could convict him with a trial? >> but if that's the case and i'm david creato, why don't i roll the dice and see if i can get off again? >> the problem is if he doesn't, he looks at minimum 35 years. life quite frankly, or life. >> yes. >> so that was -- this was a very good sentence for mr. creato and his defense team. >> i'll be out before he is
