her mom said a dr. misdiagnosed her. this portrait was drawn by the girl before her death. she was described as a smart and respectful. >> i'm lost without her. she was my best friend. >> she took her to the hospital on january 12 after she complained her stomach and throw was hurting. doctor alexander -- prescribed tamiflu since she was exhibiting flu like symptoms. the mother requested a strep test because her daughter had a history of strep throat. the child was discharged return two days later after excessive vomiting followed by heart-lung complications. >> she said please don't let me die. >> and i said of course you will not tie. i will let that happen. >> staff eventually told her the strep throat turned into pneumonia. the child went into cardiac arrest and died hours later.

>> she clearly died of cardiac arrest because of the infection. this should not have happened. >> there filing a wrongful death lawsuit and requesting the department of health investigate in a statement they said the untimely death of any child is always tragic. our heartfelt thoughts are with the family. the spokeswoman also said the dr. has been in good standing with the hospital for 18 years. he is never had disciplinary action or patients who filed against him. >> a bizarre twist in the murder of a 10-year-old at the jersey shore in asbury park. last week we brought you the story of a tenure old who shot to death and his mother wounded. the accused killer is found 100. ashley has the story.

operator program in 2013 spent about two months in classes with small groups and railroad yards. there is a program called yard extra where they go back into the field but the veteran say it's simply not enough. people can get hurt. the new program doesn't go far enough to train a real world situation. >> maybe they need more training and stop concentrating on writing people up on something happens. instead they should have a person there, retrain them and have it corrected so doesn't happen in the future. >> the mta says this is not a story. out of all of the delays only 2.7% were attributed to human air directly caused by all employees. and it's smaller for even newly trained operators.

overseas and been in situations where there is gunfire. i know how disabling it is to people who are not armed. i can only imagine how the kids in the school felt when this guy shows up and starts firing at a rapid pace. >> the ar 15 the bottom stock is the base of a lot of hunting rifles. a lot of people out there using similar style weapons that don't have that capability. >> i think military style weapons should be banned. these are not traditional hunting weapons. that military technology. adjustable stocks and pistol grips. although you can't buy those here. >> i want to bring in a special guest, congressman tom macarthur has joined us. he's one of the leading voices on making sure that all of the states comply with background checks. welcome to chasing news.

>> this is not new for me. i call for beefing up background checks in the last congress. it is high time that we have a smart resource and get serious about keeping guns away from those who are a danger to themselves and others. >> many of the media are trying to spin this is a rift between you and and the nra. seems to me the nra is not a post, millions of their five plus million members are not opposed to having strong background checks that identify the bad guys. >> for my perspective nra members, they don't want it they want to keep guns away from those who are a danger to themselves and others. not focusing on others were mentally sound. >> let's bring in our panel.

and estimate three to make 5 million weapons in the country. do you ban it? >> i don't think they should have military grade weapons. their weapons of war. there used to kill in mass quantities. >> serena, in new jersey you have governor murphy looking to make it more strict to state that already is incredibly difficult to get a firearm. why are you prepared to vote against? >> i like to hear what he's proposing. we have the third strictest gun laws in the united states. you talk about background checks a mental illness then i would probably vote for stuff like that. i'd have to see what he propos proposed. >> ten years after we went into the prosecutor's office were still talking about data and intelligence led policing across the federal, state and local levels to share various data points. we're talking about that 11 years ago.
