he certainly not happy about that. now the national retailer walmart weighs in. >> come to open it up, and this was what was inside. >> reporter: it's a 48-inch samsung television. that's what len green of northeast philly says he found in the box after his februar february 23rd purchase at the philadelphia mills walmart. but there's a catch. he paid for a 65-inch. >> what did you think? >> i was in shock. literal until shock. um, i thought i was losing my mind. i took my measuring tape out measured it from corner to corner. dam near 48-inches. >> reporter: green the father of two small children and a dealer at area casinos had a spot for tv in his new apartment. he returned to walmart where store managers watched the purchase being made on video. and received some bad news. >> they said since the box wasn't tampered with on camera that they couldn't do anything

for us. >> reporter: green paid just over 1,000 bucks for the television and service plan. the box clearly states there's a 65-inch tv inside. the 48-inch set looks lost in there. green made a call to samsung and gave them the serial and model numbers. >> come to find out they told us this tv is from 2014. >> reporter: green says and his fiance' traded calls with the national retailer but couldn't seem to find a soluti solution. he claims walmart tells him it has no record of a tv being purchased and returned allowing for someone to switch sets. green thinks it may have happened in the store but says all he's looking for is the tv he paid for. >> all i want is what i paid for. that's all i want. i don't want my money back i just want what i paid for and i don't want it to happen to anyone else again. >> reporter: this afternoon spokesperson for walmart called fox 29 and said all mr. green has to do is speak to the manager in the walmart behind me and get his new tv. he did that early this after

evening. asked how this could happen the spokesperson said walmart is a retailer not a manufacturer. it couldn't have happened with them. jeff cole, fox 29 news. sky fox over the scene avenue deadly fire in philadelphia. it started just past 9:00 this morning in a house on the 2600 -- 2500 block of newkirk street in north philadelphia. police say a 71 year old woman died inside the home. three other people were hurt. two of them a 69-year-old man and a 70-year-old woman are at the hospital in stable condition we don't know yet what started that fire. students at cherry hill east high school walking out this morning in support of their teacher. that teacher suspended after comments that he made to a class about that florida school shooting. our shawnette wilson has the story from cherry hill, new jersey. >> reporter: the issue has spilled over on to social media. parents and students are posting that they plan to attend tonight's meeting. they want to talk about reinstating their teacher and possible security concerns at their school.

today was day two of student protests at cherry hill high school east. skyfox flew over the school when students walk out in support of ap history tee which are tim moth lock had they say was suspended last week. students say lock was placed on administrative leave after discussing the deadly parkland school shooting in class and allegedly expressing his concerns over safety at their school. yesterday students gathered in the hallways to rally for mr. lock who they say was simply expressing his opinion. students claim administrators stopped the protests and threatened punishment. tonight they'll take their concerns to the school board. >> he's always -- he's always been there. he's just such a great teacher he listens to us. um, he -- his class is like an open forum because you know with history there's a lot of current events going on. >> reporter: the mayor and township council are urging the board of education to take immediate action to improve security at township schools and the chief of police is recommending the board of education have armed police officers as part of any plan they plan to implement. meeting starts at 7:00. we'll have full report tonight at 10:00.

in cherry hill, shawnette wils wilson, fox 29 news. >> the students from marjory stoneman high school are set to return to class tomorrow 22 weeks after that deadly shooting left 17 dead. fox's darrell nail shows what students and teachers can expe expect. >> reporter: douglas senior jenna corson visited the memorial outside her school every day for week but she knows going inside tomorrow will be difficult. >> all of us heard gunshots. those lives were taken. and some of us don't feel safe any more there's many kids who aren't coming back. many kids who are now in heaven. >> reporter: to ease the burden of returning, retired columbine high school principal frank deanne gel less reach out to the principal of douglas high school with some lessons he learned during the 1999 massacre at his school. the columbine principal advised against allowing balloons at the welcome back ceremony because when some popped at columbine it sent some students diving for cover and change the sound of the fire alarm which was used against students at columbine

and douglas. and finally, have lot of substitute teachers on hand. in case douglas teachers need a moment to compose themselves. >> i believe in them. >> corson notice her teachers and staff will be hurting tomorrow, too. but she believes in them. >> um, it may be different in on thes minds especially teachers in that building and heard every shot. but i think they're strength has grown and their minds have changed in different perspectives. i think they can do it. i'll really think they can do it. >> be sure to stay with us here at fox 29 for continuing coverage as those students return to school in parkland, florida. one man is dead and two others are injured in a shooting in fair hill. investigators say two guys walk out of a store on the 66 s hicks hundred block of clearfield street when a masked man opened fire. one man was hit in the head and died at the hospital the other was hit in the arm. an innocent bystander was also hit in her back and both of them are in stable condition tonight at temple.

the bars called the crime and punishment brew pub. well two guys commit add crime there and philly police would like to punish them. robbers targeted customers at the north philadelphia pub back in december with one waving around a gun the other took wallets, money and phones from can you ever mers. the robber with the gun fired a shot into the ceiling before running away. if you've got any information please give police a call. all right. let's check in with your fox 29 winter weather authority as we take live look at wilmington. kind of a mild day out that. you can almost feel spring in the air, kathy. ball you know what, what can we expect as we head into the night? >> it's going to be great. i mean what you see is what you get iain. >> beautiful. >> talking about mild temperatures. temperatures running 10 degrees above normal. look behind me. upper 50s in read, wilmington and ac. philadelphia and trenton in the mid 50's in the poconos close to fife tee degrees. a little bit too early for spring skiing. 51 in wilmington and down to 46 in millville and ac.

44 in mild wildwood we do have that southwesterly wind it's a warm wind for us we do anticipate temperatures to be mild through the evening but with clear skies and light winds it will get colder overnight. february already one for the record books. how about the third warmest february ever since records have been kept and that goes back into the 1800's. average monthly temperature near 42 degrees. that's 6 degrees above average. overnight it gets cooler. we'll talk about a storm moving our way for the late week period.& march comes in i've can i kind of like a lion. we'll talk about that in a few minutes iain. >> kathy thanks. developing us in out of washington right now. the president's son-in-law an vied adviser jared kushner stripped of his high level security clearance he's been operating with a interim clearance for more than a year according to politico that's been downgraded. the chief of staff john kelly ordered that all white house officials with interim clearan clearances lose their high level access if they didn't get their permanent clearance by friday.

happening now in burlington county where police released a sketch of a man wanted in connection to a road rage incident. he reportedly tailgated and taunt add woman from mt. laurel to lumberton and then into medford township. that's where the woman lost control of her car along ark road and crashed in a tree and was ejected from her vehicle. the woman admits this all started as an he can change of words that got out of hand. >> she did not sustain life threatening injuries however just the trauma of the incident and having someone come after you in that fashion has really terrified our victim. >> again, here's a sketch of what the suspect looks like along the type of car he was driving. if you know anything about this, police would love to hear from you. the parking authority is cracking down on drivers that are parked in bus stops. one proposal is using septa buses to catch drivers in the act. fox 29's dawn timmeney has the details. >> reporter: see these giant xs behind me markin marking thes zone? and this sign right here, no stopping, bus zone, drivers

are parking here any way and the philadelphia parking authority says it's not safe and it needs to stop. >> they park wherever they want. >> reporter: ed kipp is referring to cars and delivery truck illegally parked in bus zones and bus stops all over the city. he use as cane to get around and says maneuvering around them makes it harder to get on and off the bus. >> that blocks everybody. you have to walk around to get to them. that's i guess that's part of life. i've only lived here in philly since may and i've just learned to it that way. >> reporter: the philadelphia parking authority says it's not safe for riders and not legal and it wants to ticket drivers who park at bus stops. >> i don't think people often think about how dangerous it is for passengers of septa buses and it is a major congestion issue. >> reporter: ppa says the man would be to use cameras already mounted in septa some 1200 bus buses. drivers would just hit a button and the camera would take a picture of the violators license plate. >> we believe that there are

over a thousand tickets per day of these type of violations. it would be very similar to red light camera. you would receive a ticket in the mail. >> reporter: the hope to eventually curb this type of behavior. but long-testimony septa rider brian harrington says, parking is already at a premium in the city and he thinks it's an awful idea. >> sometimes you park there for a minute and just jump out and nine times out of ten even if the bus lane is open, the buses don't pull n you still have to walk into the street so it look like the pp a just trying to get more money. >> reporter: tickets would be $76 in center city and $51 in other parts of the the city and the ppa says the program could generate millions of dollars. the parking authority says it would probably require new legislation in harrisburg but says it believes it's a no brainer. dawn timmeney, fox 29 news. it's a problem across the city. trees planted to make neighborhoods look more inviting but now it's hurting homeowners. kristen. >> iain we're starting to see

♪ it is problem all over philadelphia. trees planted by the city to beautify neighborhoods out grown their usefulness creating big and expensive trouble for homeowners. our bruce gordon joins me in studio now. bruce it doesn't take tree surgeon to figure out something is wrong here. >> no it doesn't these street trees are planned in the all too narrow strip between curb and sidewalk they look great, until they start to grow. what's not to love about the big beautiful trees that line the 7500 block of walnut lane in mt. airy? plenty says the homeowner

at 7528 brenda simmons. >> they can take the tree down. they need to get rid of it. >> reporter: we met the simmons monday night as we watched work being done to repair broken sewer lines caused says lewis by every expanding roots from their city planned street tree. >> it started off as 8,800-dollar project, now it's going to turn worse because my retainer wall has to come down and they have to go deeper on to our property in order to get to the actual pipes. >> reporter: simmons say the broken sewer pipes forced them to limit the use of that are toilet for fear of backups. they say it's happened half dozen times. >> you do the wrong thing you wind up with sewage in your basement. >> yup. that's why we got to use a wet vac to get it all up with. >> simmons have been asking for several years now that the city's department of parks and recreation remove the tree and -- >> they have have been here. they look at the tree. to them the tree healthy there's nothing wrong with it there's no reason for them to take down. >> reporter: in fact, parks

and rec tells us they rated the trees condition as fair and placed on lengthy list for removal but with no guarantee when they'd actually get around it to. they did send the simmons this letter last year. saying if they wanted the tree work performed immediately, they should hire a private tree contractor. in other words, you're on your own. city tells us there's no way of knowing for sure it was the tree root that is broke this sewer line but brenda says several of her neighbors have had the same problem. >> like her her pipes replaced. he had to do his. >> at the very least the decades old street trees up and down this block have out grown their narrow planting beds. uprooting sidewalks they too are the homeowners responsibility to fix. these street trees look nice. from a distance. but up close, brenda is no fan. >> if i was a lumber jack myself i'd take it down. [ laughter ] >> reporter: there's no doubt the city planned the wrong kind of trees in some of these neighborhoods years ago. and now it doesn't have the money for the staff to remove the problems.

parks and rec spokeswoman claims in most cases these trees were planned long before the homeowners moved in in he is says sense they knew the risk. louis simmons tells me he remembers the city planting their tree back in the '90's if he knew then what he knows now, he would have said no thanks. iain. >> all right, bruce, thank you. back to your fox 29 weather authority now. as we take look at doylestown in bucks county nice mild day today. we're easing into chilly night though but after that there's a storm on the way. kathy has got your forecast in 15 seconds. in most locations high temperatures are in the 50s today. but it's going to be chilly night. a pretty sunset across the delaware valley with that pink sky really pretty on the parkw parkway. lighten things up tonight much the temperature right now is 52. the high for the day 56.

we still have that south southwest wind keeping it really nice for this evening. 50 degrees right now in allentown. 52 in philadelphia. southwest winds keeping it mild at wilmington at 51. temperatures pretty decent throughout the and tire northeast all the way down to richmond. 50's are wild. cleveland 55. toronto and rochester new york at 50 really unusual for this time of year. that chilly airy treating well to the north. high pressure were you off the coast keeping it mild for the next couple of days but we have a storm that's brewing. that storm doesn't look like much right now over texas but it's going move these high cirrus clouds our way tomorrow you'll see that milky white sky with warm temperatures but then a coastal storm develops and this is how it's going to unfo unfold. we'll start the clock tonight at about 8:00 o'clock. you can see the beginning of this storm. then by tomorrow afternoon it's still well to the west. you can see right there over kansas and the panel handle of oklahoma by the time we fast forward thursday morning you have a strong low over chicago, mainly rain out in front of it. we see the rain by the midday period. then the storm really begins to

take shape. thursday night here is one area of low pressure. that's circle with some snow in the midwest even through erie and along the pennsylvania new york border and some redevelopment starting off the coast two areas of low pressure that secondary low off the coast good thing because that could be a snowstorm if it was farther to the south but the air too mild maybe ending as few snow showers through the lehigh valley and poconos on friday morning. you see these isobars lines of equal pressure when they're that tight it means wind so that mean a wind advisory friday maybe even some beach erosion and some whipping winds down the shore some flooding as well along the coast. we have to keep an eye on this timeline is thursday night through early saturday morning. overnight tonight lows in the 30s. 35 in millville. 34 in pottstown and allentown. 36 in lancaster. and 37 in dover. tomorrow we'll see the high clouds building in but high temperatures near 60. it will be a really nice day. a great day to get some gardening in and be outdoors because guess what, by the time march moves in on thursday, the
