with more. good morning. >> good morning, andrea. mr. barry says he's not going to let the matter drop. in fact he may pursue other avenues because he said u.s. park police held him for hours without being able to contact his attorney and he is very angry. marion barry will get yet another one of his many days in court. >> on behalf of councilman marion barry, his family friends we'd like to say our hearts are full tonight with thanks. >> reporter: that is because this time around the ending will be happy. >> we are grateful the office of the u.s. attorney has seen fit to not proceed in charging mr. barry for any criminal violations surrounding the july 4th event. >> reporter: events that led to stalking charges being filed by u.s. park police after a bizarre altercation between barry and his form per girlfriend in anacostia park. >> the arrest of mr. barry should have never taken place.

>> reporter: for the alleged victim, former barry girlfriend, donna watts the ending is not so happy. >> i hate the fact that i'm going down in history as one of the many women who he thinks he's defeated. >> reporter: the arrest also brought to light a $60,000 no bid contract that barry awarded to donna watts. now barry said it was done above board and legitimately but some dc council members want an investigation either by the county or by the attorney general peter nichols. stay tuned the reality show has more episodes to go. the question is when will all of us get tired of it. armando trull for 9 news now and wusa9.com. we have now learned the names of the men killed when a suspected drunk driver hit their car tuesday night. the car plunged through a guardrail over the outer loop and dropped 200 feet in to some trees. both men inside were killed.

the crash happened on the maryland side of the american legion bridge. police have also identified the other driver involved. virginia state police took her in to custody when she crashed after crossing the american legion bridge. court records she service driving with a suspended license and without insurance and she was involved in an alleged hit and run crash earlier this year. another video of a metro worker texting has surfaced on youtube. this time the video shows a metro bus driver. someone posted the video on tuesday. metro says at the moment it has no way to identify the driver. metro previously suspended a driver after a video showed him texting. a strain of rising foreclosures is so bad it is now taking public works crews off the streets in some places.

overnight asian stocks kicked off the day with losses. the nikkei down 1.3% while the hang seng lost 0.1%. the dow opens at 8178 after adding 14 points. it traded lower in the session. the nasdaq added just a point and the s&p was down 1.5 points. ben bernanke's future as the head of the federal reserve maybe in question. the "wall street journal" reports the treasury secretary timothy geithner is expected to play a key role in advising president obama on whether to reappoint bernanke when his term expires in january. the top economic adviser and a former treasury secretary could be a leading contender for the job. 180 homeowners in maryland are getting refund checks in the mail. that's after the state found their mortgage services company violated rules about applying penalties for prepaid mortgage loans. aqua loan services is refunding

the dogs will be treated for other physical problem and evaluated to see if they can be adopted. this morning trains are moving through northeast baltimore. that wasn't the case last night when a natural gas leak shut down amtrak and all other train traffic in the area. the leak happened under a bridge on north point road. it took several hours for bge crews to make the repairs. a former top aide to blagojevich is now cooperating with prosecutors in the corruption case. john harris was once blagojevich's chief of staff but he pleaded guilty on wednesday admitting he took part in a plan to sell the senate seat vacated by president obama. harris is expected to testify against blagojevich. a struggling musician gets back at the airline that "done wronged him "on-line. that's coming up on the web. and are we still in the clear. >> we are protected from rain.

>> reporter: it maybe good and bad news for the controversial former mayor. the stalking charges against marion barry will be dropped today for lack of evidence. >> we are thankful to the u.s. attorneys office for seeing through it and making the right decision. >> reporter: however, marion barry may not be willing to drop the matter as it pertains to his treatment at the hands of park police after the 4th of july arrest in anacostia park. >> he was held almost two hours before being arrested and he was held for almost four hours without having an opportunity to contact his attorney. mr. barry has said he has every intention on elevating these concerns. >> reporter: the alleged victim, former marion barry girlfriend donna watts said she never wanted to press charges against barry but had this to say.

flu virus. the discussion at the national institute of health will include the u.s. secretaries of education, homeland security and health and human services. the focus will be on preparedness and response ahead of this fall's flu season. more than 2 million americans have lost their jobs this year and now five months after congress passed the $787 billion package of tax cuts and spending there is talk the economy needs a second stimulus. watch dog agencies.out so far only 11% of the stimulus package has actually made its way in to federal, state and local projects. the federal agencies have to receive bids for contracts and then they have to analyze those bids and they have to write checks to those people that won the bids and that all takes time. most republicans in congress opposed the first stimulus package and appeared dead set against the second. it also appears the white house is not eager to fight that

battle again. time for another living smart report and digital correspondent jessica doyle is back with the new white house policy on hiring illegal imgrants. >> on this issue it is looking like what is old is new again. the obama administration is taking a hard line on contractors who try to hire illegal imgrants. it has decided to continue a bush era program that affects 170,000 contracting businesses. starting september 8th, companies must check whether employees are entitled to work in the u.s. through the government's e-verify program which compares names and social security numbers. if workers are found to be in the u.s. illegally, contractors are supposed to fire them. well, your next bottle of water may come with more information on the label. researchers and congressional investigators are recommending that bottled water be labeled with the same information that municipal water providers need to disclose. they say we know less about the bottle we drink than the water
