right now, a search is underway for the suspect or suspects. >> the murder trial of jacks is now officially underway. opening statements wrapped up a short time ago. after the judge made a key ruling in the case against the woman accused of killing her father daughters. audrey barnes spent the day in the court and joins us live with what happened there. audrey. >> she spent much of the last two days in a holding cell in superior court. she said she didn't want to hear those interrogation tapes, which the judge ruled today will be submitted as evidence in this case. now jacks did return to the courtroom for opening arguments. defense attorney, lloyd nolan says there is no evidence that shows she killed her children in their row house on 6th street and southeast. the only story from witnesses who didn't see anything. prosecutor, debra signs said the bodies of a little girls will speak for them. four different medical experts will lay out a time line of the

killings, which started with 16- year-old brittany. the last time she was seen alive was in april of 2007 after a boyfriend came to visit, which angered her mother. the stench of death next door. and slowly, one by one, the three other little girls disappeared too. their bodies discovered by marshals who came to evict the family in january of 2008. that's the sight the prosecutor says they will never forget. in the words of one, brittany was so decomposed, it was as if she was melting into the floor. and all the while her girls were upstairs rotting, prosecutors say jacks went to neighbors to ask for water, to ask for food, toask for cigarettes. she never asked for help for those little girls. now the prosecutor says it will be jacks own words that will solve the mystery of how these

little girls were killed. she tells detectives that no one came in her house, no one touched her girls. she was the only one they ever saw and that was the evidence her defense attorneys tried unsuccessfully to suppress. back to you. >> audrey, sad story, thank you so much. >> we have an update on the search for a missing swimmer in the potomac river. no sign tonight of 32-year-old grenado. rescue teams continue to comb the waters where he disappeared yesterday. his friends say they were on a fishing trip when he decided to go for a swim. >> a one-year-old toddler taken during a carjacking in virginia beach is safe tonight. naomi was found unharmed in a parking lot. investigators say her mother was pumping gas when a man pushed her out of the way and took the family minivan with naomi still in her car seat. police have identified 24-year- old matthew gnash as a person of interest. they are still looking for him and the family's dark green

honda odyssey with florida plates. >> speeding cops have to pay their speeding tickets just like the rest of us. a judge says no. he just thrown out speed camera tickets for four on duty officers. bruce leshan has the story. >> the camera flashes, your heart sinks, you realize you are out $40. but maybe not if you are a cop. >> that doesn't sound very la git. i don't lagitamate. it's not fair. >> no one is arguing about emergency calls, but the montgomery county police department does think officers who speed through the cameras without a legitimate reason should have to pay. >> we have rules, you know, and rule one, in our police department is obey law. obey all laws. >> but the judge tossed out the four tickets, finding the

department violated the officers due process by trying to collect without having a specific written policy on when officers can and cannot speed. in two cases, the officers were snapped going twice the posted speed limit. >> police union officials declined to talk to us on camera, but sent an e-mail saying they suspect the department to follow the law. their lawyer says speeding is a natural parted of an officer's duty and they can't be expected to remember months later why they were speeding. >> i have been doing this for twenty years. it doesn't hold water with me. >> the court reports suggest that three of the four officers offered no explanation for why they were speeding. the fourth was going 51 miles an hour in a 25-mile an hour zone. he said he was on his way to training. in rockville, bruce leshan, 9news now and wusa9.com. >> the police department says the vast majority of officers caught speeding pull out their checkbooks and pay up. the judges ruling is not binding on other cases and

plans to keep sending cops those tickets. phil andrews is urging the county executive to appeal. >> police believe a man they found lying overnight in the road might be a victim of a hit and run. officers responding spotted the victim at the intersection in upper marlboro. this was about 12:15 this morning. police say it looked like he had been hit by a car. the victim is hospitalized with life threatening injuries. >> a fallen tree tied up rush hour traffic on the george washington parkway this morning. the northbound lanes were shut down while crews moved the tree out of the roadway. but that portion of the bike path will stay closed until the tree is totally and safely removed. >> here something you will want to know if you drive e beltway. beginning tomorrow morning, the right lane of the outer loop in alexandria will be diverted on to the eisenhower avenue connector. that road will not be open to other vehicles and pedestrians.

and this will keep on going until september. >> the metropolitan council of government voted unanimously today to support a plan for a network of rapid service bus lanes. the buses would operate in dedicated lanes in the city and the suburbs to avoid congestion. they would then travel on to existing high occupancy highways where exclusive toll lanes are being built. an important part of the system would be k street in northwest dc and the agency will seek federal funds to pay for the system. >> president obama is not letting up on his push to get a healthcare reform bill through congress before summer break. the president says the landmark bill will help families, entry, and the government itself. >> hello everybody. >> president obama prodded lawmakers to finish healthcare reform. >> to defer tough decisions for another day. or we can step up and meet our

taking off from tehran to armania. the plane smashed into nearby farmland, creating a crater and leaving a trail of wreckage. witnesses say the plane's tail was on fire and the pilot was looking for a place to land. the plane fell out of the sky and exploded on impact. most of the passengers are armanian. eight members of the team are among the dead. this is the world's third major airline disaster in less than two months time. killing a total of more than 500 people. >> we are less or rather we are standing by as the space shuttle endeavor is set to lift off in less than an hour from now. you are getting ready to look at a live picture at kennedy space center where e endeavor is scheduled to blast off. the mission to the international space station has been delayed five times, three for weather, and twice due to hydrogen gas leak. astronauts will deliver and install the final piece of the

state. so yeah, cause some damage and everything. it is unusual to get them that far north. there it is. so while we have been enjoying the quiet whether here, things have been active out in the central part of the country. for us, i think there's going to be a couple chances for showers and thunderstorms. the temperatures will be a little warmer tomorrow, but cooling off going into the weekend. so overall, our cool weather, quote, unquote, cool weather for this time of the year. i think will continue. it won't be as cool as last night. last night we dropped into the 50 eds. tonight we'll stay in the 60s and a slight chance for a shower or thunderstorm. during the day tomorrow, a mix of sunshine and clouds. a 30 or 40 percent chance for a shower or thunderstorm. don't expect big coverage. i know some of you are rooting for rain. 34% chance tomorrow. the temperatures upper 80s to around 90. right now we have high, thin clouds out there.

no precipitation showing up on the radar. we could see a little bit of stuff coming into west virginia and again after midnight tonight, there's a slight chance that we could see a couple passing showers. generally dry conditions tonight. 86 the top of the hour. that's not bad, but it is higher than yesterday. yesterday they were in the 40s and continue to climb overnight tonight. so it wellwi get a little more uncomfortable as we go through the night. 90 degrees at the top of the hour and see the warm temperatures off to our south and west and this is where the flow is coming from over the next 24 hours. we will get to keep the warm conditions on thursday and see a lot of activity off to our west. i think some of that will catch up to us during the day on thursday with this cold front as it sweeps through late in the evening. 30, 40 percent chance of thunderstorms. i think the best chance for rain actually be friday night and saturday morning. an area of low pressure develops on that front. so the beginning of the weekend, we could get a good rain, at least that's the way it looks right now. a slight chance for a shower and the temperatures cool off into the low 80s again for a

out there. lindsey has the story. >> the loudoun county sheriff's department says diana faces racketeering, money laundering, and ten counts of mortgage fraud. they believe she fled the country. police gave us this address, but neighbors say she is no longer there. >> there are a lot of police here one day taking a lot of stuff out of there. >> this family is renting the place. >> how did the scheme work? police say she targeted people with bad credit. she would falsify documents, saying they made more money and had great credit scores. then she would take the commission. >> at closing, she would pocket some of the money. >> as for the victims -- >> their credit is ruined, they are bankrupt. they are fore closed, and that's the way the scheme worked. >> police believe she is in jordan. in leesburg, i'm lindsey mas

mastas. >> authorities are trying to locate her and bring her back to this country. florida police are questioning a real estate agent that they believe may be connected to the double murder of the billings. police in orange beach, alabama spotted pamela along at a marina. they are returning to florida for police questioning. the sheriff says she is a person of interest. >> we know that she was associated with leanard patrick gonzalez jr. up until the day of the murders. and so again, we would like to get information from her about his activities, where abouts, movements, those sorts of things. again, she is a person of interest. >> gonzalez is one of seven men charged in the double murder. police are also looking for another person of interest and that person may have been involved in the video taping system that led to the arrest of the men. the video system was never turned off and the pictures led to the arrest. >> a group of shark attack survivors are in washington this week.

it is warmer today, but you were outside, it doesn't feel that bad. >> right? >> great hair weather. that's what i'm concerned about. >> she has her priorities in check. good hair weather. it's going to get more humid tonight, so that may not be the case after midnight or so. but for now, it's nice. let's see what is going to happen as we go into the weekend. start with the three-day trend. it will be more humid tomorrow. i can guarantee you that. the temperatures upper 80s to around 90. it doesn't last long. we will drop into the low 80s to start the weekend and a couple of chances for rain. we'll talk about that momentarily. partly cloudy skies through the rest of tonight. a slight chance of a shower or thunderstorm. the humidity will be going up overnight. low temperatures between 65 and 70 as opposed to the 50s like last night. mixture of sunshine and clouds. warm and humid, nothing unusual for this time of the year. a chance for a shower or thunderstorm. i know it's getting dry out there. a lot of you are rooting for rain. i put a 30 or 40% chance on the storms for tomorrow.

sunrise tomorrow morning at 5:56. right now, we have high, thin cloud cover out there. there's no precipitation in this cloud deck. rain showing up on the radar out in west virginia. later on tonight, this system approaches, there could be a few showers developing, but that would be after midnight. this evening, it will stay dry. 86 degrees the top of the hour. the dow point is 59. that's higher than yesterday. yesterday it was in the 40s. that's still good. south wind at 17. a good breeze coming out of the south. temperatures elsewhere, mid to upper 80s in most spots. 90 in fredericksburg. 84 in winchester and 85 at the naval air station. if we take a wider view, we can see a lot of hot stuff off to our west and south. this is the direction of the flow for the next couple of days. we plan on getting the temperatures into the upper 80s to around 90 tomorrow. and we can also see activity up stream as far as showers and thunderstorms go. we'll put a 30 or 40 percent chance in for tomorrow as the cold front approaches. the front will go through

thursday night or friday morning and then after that as we head into the weekend, an area of low pressure will develop and that will give us our best chance for rain friday night and saturday morning. if you are rooting for rain, that's the best opportunity to take the stuff thursday and friday and the high temperatures fall back into the low 80s for highs over the weekend. so still no heat waves in our seven-day forecast and i think this pattern will hold, like i said, for the next ten days or so. no big heat waves on the horizon. >> thanks a lot. we have breaking news to get to now from the capital. we are monitoring a shooting involving u.s. capital police. it happened at new jersey avenue at c street in northwest dc. we are hearing that a 35-year- old man has been transported to the hospital. the associated press is reporting police sealed off some of the entrances to the u.s. capital after reports of gunfire a few blocks away. we have a crew heading there and will bring you more information as soon as we get it in the information center.
