park and totin park where the trains are still on manual moving slowly, 10 miles per hour, while the investigation continues to unfold. he pointed out if there are any confidence problems it is not turning up in the ridership numbers. they have stayed steady in the wake of the accident. in fact, there was one day last week where metro had its 11th busiest day in history. people still are riding the trains despite all of these issues. reporting live from near port totin station, scott broom. >> metro says it won't have to close the tacoma station because they won't be working at the site. it is unclear when investigators will return to the tracks at tacoma. a young girl was spotted by friends at the bottom of the upton pool on wilson boulevard. four jumped in, pulled her out and life guards performed cpr.

by the time paramedics arrived the girl was conscious and breathing and is being treated right now at an area hospital. a follow-up to a story we told you about earlier this week about two u.s. supreme court rulings that are jeopardizing criminal dui prosecutions in virginia. tim kaine announced he is calling lawmakers into special sessions to address the issue. >> in the aftermath of both of these decisions by the court most states have been wrestling with, okay, how do we make sure that court proceedings that are now going forward in which this kind of evidence needs to be used. >> the session will be held august 19th. now back in june the supreme court ruled prosecutors must make forensic examiners available for defense cross- examination about lab reports or evidenceevidence and that clud es blood alcohol tests. also this inrnmog governor tim kaine anunced missing medical

records were found. a former employee at the school counselling center apparently had the records, tim kaine says they will be released as soon as possible. gun control advocates scored a rare victory on capitol hill today as the senate rejected an amendment to allow guns to be carried over state line. the measure would have given people with concealed weapons the right to carry their firearms into other states. it is an unusual setback for gun control opponents who opponents. jim west is one of those democrats. >> the violence we see in our streets and in our neighborhoods must be addressed but very little of that violence has ever been caused by those who seek permits to carry. as i mentioned before the people that are perpetrating that kind of violence already have their guns. >> despite west's support it failed by four votes. it would force states to

recognize permits from states with few restrictions. president obama will try to win back the support of congress and the american people on health care reform. as joel brown reports, despite his urging lawmakers, they may not be able to meet the deadline of having a finished plan before leaving for their august recess. >> reporter: president obama has a lot of convincings to do. opponents in congress painting health care reform as a budget breaker that is being rushed through. the president will attempt to retake control of the debate. >> i have no interest in creating a bad bill. that doesn't serve me. and it certainly doesn't serve the american people. >> reporter: he will have his work cut out for him. polls show declining support for president obama of his handling of health reform. some are urging him to back off his deadline for getting a bill through congress before the august recess. >> this is too important to be rushed. we need to take our time and do

is one of eight federally funded support vaccine and treatment evaluation units. university officials say these units can rapidly enroll a whole bunch of volunteers with the studies to deal with emerging health concerns like the h1n1. prosecutors will rest their case in the bonita jacks trial. today it played out about a sad script from a novel about kids slipping through the cracks. audrey barnes now with the latest. >> reporter: the signs were there that 16-year-old britney jacks needed help. her grades dropped from as to fs the next quarter. then her attendance plummeted. it is a case one homicide detective said he found so disturbing he told his supervisors he couldn't do it any more. a social worker noticed that britney jacks stopped coming to

school in march. when phone calls and letters to home went unanswered she went to the home on 6th street with the special education coordinator and dc police officers. she said jacks was hostile andd agitated. there were two other girls in the home. that visit triggered a barrage of phone calls to police, court, dc child and family service agency to try and get someone to check on the welfare of the kids. a sergeant did go to the house three days later. he says he never asked about britney unaware that jacks even had a teenager. he called the social worker to say the kids were fine. marshalls discovered britney's corps in the house along with her three little sisters. in one report after the bodies

were discovered the sergeant said he believed there was a teenager at the house. a few days later he said there wasn't. sergeant, are you still haunted by this case? in court the prosecutor asked him to explain. and when she did that the sergeant took a deep breath and then he said i was tired, i was burned out, my wife threatened to leave me, i told my supervisors i didn't have the heart to do this any more. six dc social workers were fired as a result of this case and there was major reshuffling in the department of child and family services as a result. now, the prosecution is expected to wrap up its case in this trial tomorrow and then the defense will take over. lesli, back to you. >> just more heartbreaking by the day. audrey, thank you for that. the maryland board of public works has unanimously approved $280 million worth of budget cuts to help close a $700 million shortfall. health care and higher

education absorbed the brunt of the cut backs including reducing medicaid payments to hospitals, nursing homes and other health care providers by $34 million and cutting $40 million from state colleges and universities. the prince george's county council approved a 10-day furlough plan. they are proposed to help close the $13 million budget gap. at least three of those days off without pay must happen in the first three quarters. the county council will revisit it quarterly to see if the full ten days will be necessary. cutting the ribbon on the board's new election offices in gait gaithersburg today. it will provide more training facilities. it had been located on twinbrook in rockville for more than 20 years. today announcing a summer crime initiative targeting

145 years ago this month 40 union soldiers died right here in dc during washington's only civil war battle, the battle of fort stevens. >> a national park service ranger made a discovery that would change his life and the life of those 40 men forever. our digital correspondent has the story on this special report. >> reporter: just off georgia avenue in north west washington ranger ron harvey walks into one of the smallest cemeteries in the entire park service. battleground national cemetery. >> we are standing on the battlefield quite literally. if it wasn't for these men right here dc might have fallen. this is extremely holy ground. >> reporter: he began to question the names ten years

ago. >> i wanted to find out more about these names when i started reading the headstones. i knew they were killed during the battle. that's all i knew. once i start researching, five headstones kept giving me problems. the names weren't adding up. >> reporter: for the past decade he has been trying to find out who really died during the battle of fort stevens. >> i would wake up in the middle of the night wondering about this guy, that guy. i drove my coworkers nuts. >> reporter: last summer it paid off. >> i was able to find out who they were. >> reporter: he found the five names. >> finally to have them recognized. i got pretty weepy. so, yeah, hopefully they will rest in peace and their stories, their lives, their names will never be forgotten

performing the procedure when the surgery went horriblely wrong. >> i wasn't aware that a resident was going to be doing part of the surgery. >> reporter: surgeons on travis air force base tried to repair the severed valve. >> why was his quality of life not more valuable than that? >> reporter: we are told it took travis 8.5 hours to transport the 20-year-old airman to the uc davis center in sacramento. >> we were told had it been within a six-hour period the limbs could have been saved. he might have had muscle damage or damage but nothing to this degree. >> why did it take so long to get my husband help? why did they wait so long? >> reporter: a spokeswoman from travis air force base refused it talk about the specifics of the medical procedure. but lieutenant holly hess did say this a serious medical

highs 84 to 88. next seven days. 86 tomorrow and friday. we are looking at 90 over the weekend. chance for a thunderstorm on sunday then we are kind of in sort of the pattern if you will of showers and storms possible each afternoon. high temps monday, tuesday, wednesday right around 90 through the middle part of next week. >> sounds good. >> got a theme going here. we don't really ask brett what he will talk about we just asked him what did you do today? >> i went to visiting day at my son's camp, at the day camp and the parents got to do whatever the kids were doing. >> so what did you do? >> among other things i played dodge ball which i haven't played since i was 10. this is going to sound cruel. i nailed some kids right in the melon. >> and you liked that? >> first of all, the balls are soft. it doesn't hurt anybody. >> did you throw it really hard? >> i got some necks snapped from the kids. they loved it. i owned some of the disappointment that i had from when i was a kid.

>> the kids got picked up. >> they liked it. sports guy hit me in the head. it was awesome. back in the old days -- i just wanted to talk about that. when business owners would take summer vacations they would sign a shop on the front door of their shop that said gone fishing. back in june a virginia native a man and his son hung a gone fishing sign on their house. they are out to fish 50 states in 50 days. we caught up with them in iowa. >> if you had a month or a summer you could do anything you want what would it be? it always came back to i would like to take a big fishing adventure one day. >> when he first mentioned it i thought it was cool. i didn't think he was going to actually go forward with it but he made it work. >> for the past five weeks jeff turner and his son taylor have baited their hooks and cast their lines in a new state and a new body of water. their fishing adventure of a lifetime started in

pennsylvania. so far the duo have put more than 10,000 miles on their rv. >> you ought to take one of these energy drinks. >> reporter: the turners are chronicling their journey on a website with youtube video and diaries every day. >> it moved from vacation to expedition to mission. so this is not a vacation by any stretch. >> reporter: taylor will soon be a high school senior. he is sacrificing a summer away from friends to take the ultimate fishing trip with his dad. >> i'm not sure if it is a love for fishing. it is a like. i enjoy fishing. that's why we are only doing four hours a day because i don't think i have thrsstamina to do more than that. >> reporter: but at the end of the day and the end of this trip the journey is about leaving a legacy. and creating memories that will last a lifetime. >> i can't wait to be able to say that i've done it because it will be really cool to tell people that. we have highlights every day. but it is a tough, tough

out in the bright sunshine without any protection over us, you'll see how bright they get. >> reporter: we asked local mom nora burke to give the beads a try with her kids. >> unbiased evidence they are in the sun too long. get out of the sun or put more lotion on. >> if we were in really bright sun today, there is low cloud cover, i'm glad there is because people forget when there is cloud cover you are getting a lot of uv exposure. >> reporter: after testing out the beads for five days nora found them to be an eye opening and handy tool. >> friday morning i do an early morning swim program and when i get out of the pool at 7:00 p.m. they are in full color. this was at the shaded end of the pool at 7:00 a.m. in the morning. i wouldn't even considered putting on suntan lotion that early in the morning. >> it ends the argument if you need sun screen or not. if the beads are covered you are getting uv and you need to protect yourself. >> a portion of all proceeds from the sale of these beads go to charities such as the skin cancer foundation.
