digital correspondent lindsay mathis is on the story and she joins us from police headquarters in rockville with the latest. >> reporter: it all started early this morning when someone called 911 and hung up. now, one man is dead and two montgomery county police officers are on paid leave. >> he has been identified as hernandez. >> reporter: lucille bauer says one officer fired his gun twice at hernandez. one of those bullets killed him. she says police found two weapons near hernandez's body, a knife and what appeared to be a gun. >> the knife is a carving knife with an 8 to 10-inch blade. the gun is identified as a bb pellet repeater air business which is a replica of an authentic semiautomatic weapon. >> reporter: bauer says they do not know whether hernandez fired the bb gun and they do not know what could have prompted the initial 911 call or even who made it. >> we ruled out a burglary, we

ruled out a domestic violence incident and we do not believe the subject shot himself. >> reporter: the incident has shaken this once-quiet community. >> it's very scary. this is not why i moved up here. i moved from pg county to montgomery county to avoid stuff like this but i guess it happens everywhere. >> reporter: police say they are trying to gather even more information about hernandez. >> if there is anyone in the community, anyone who knows mr. hernandez who could provide information to help us advance this investigation, we ask that they call the montgomery county police major crimes division. >> reporter: there was one other officer at the scene. anna hester did not fire her weapon but the two officers are on paid administrative leave during this investigation. in montgomery county, i'm lindsay maskis. president obama has taken his health care reform message

on the road. right now he's meeting with people at bristol, virginia, inside a kroger supermarket. earlier today he addressed about 2,000 people in raleigh, north carolina, and he took on critics who say he wants to socialize medical care. >> nobody is talking about some government takeover of health care. i'm tired of hearing that. [ applause ] i have been as clear as i can be. under the reform i've proposed, if you like your doctor, you keep your doctor. if you like your health care plan, you keep your health care plan. >> the president has also tweaked his message a bit. he's putting more emphasis on protecting our access to good health care by uncluttering the insurance process. five republican senators have said they will vote to confirm judge sonia sotomayor to the u.s. supreme court. the senate judiciary committee voted yesterday to approve sotomayor and just one republican joined democrats to

support her. the full senate vote comes next week and sotomayor is expected to easily win confirmation and become the first hispanic on the high court. the cuz mother accused of -- d.c. mouth accused of killing her 4 chipper has been found guilty. banita jacks could be life in prison when she's sentenced. audrey barnes who sat nearly every minute of the two-week trial joins us with more. >> reporter: the judge says this was a lonely assignment, one of the most challenging and difficult he's faced in his 32 years on the bench. but this seasoned veteran says he had no trouble with one thing, finding banitta jacks guilty of starving, torturing and killing her four daughters. it was a case of child cruelty that rocked the region. the decomposing bodies of four little girls, ages 5 to 16, found in their home. their mother, by her own admission, the only one who had access to them.

now banita jacks has been convicted of starving, torturing and kill can all four. >> we're pleased with the verdict. >> reporter: but prosecutors say it won't erase images of what the children endured for months. >> there's no joy in coming out of this courthouse. >> reporter: jacks was found guilty of 11 of the 12 counts of murder and child cruelty she faced. the evidence showing the three youngest girls were strangled with a ligature. judge frederick wiseberg said he couldn't rule that 16-year- old britney jacks, who he said was likely intensely depressed because of her mother's mental and physical abuse didn't stab herself. he found jacks not guilty of premedicated murder in britney's death. >> he found her guilty of felony murder, which is first degree murder. >> reporter: the defense attorney says they will appeal. >> whenever someone is looking at life in jail, it's a difficult case. >> will you try to get less than life for banita jacks? >> i'll try to get as little

time as possible. >> reporter: banita jacks will be sentenced october 16th. she showed no remorse when the verdict was read. her only emotion was when she argued with her attorney to try to get her sentencing pushed back until november. >> audrey, thanks to that. dozens of montgomery county police cars will soon have dash cams. the county council has accepted a federal grant to put 100 cameras in patrol cars. they'll be out starting in september and police hope to have cameras in all 800 of their patrol cars within the next three years. the mess is cleaned up, but everybody is still talking about a truck that overturned and caught fire on the beltway this morning. it happened at the height of the morning rush in alexandria between the eisenhower avenue and van dorn street exits. one person was hurt. at least some of the suspected stolen goods seized in a raid yesterday at a secondhand dealer are back in the store they were allegedly stolen from. digital correspondent scott

broom is live from prince george's county police headquarters with this follow- up. scott? >> reporter: well, as this raid in cheverly was unfolding, there was a worker from walmart standing by that had a bar coding device. he was checking the inventory numbers and bingo, it does appear that police found at least six hd tvs that had been stolen from that nearby walmart store back in june. the tvs were taken back by walmart. they were among hundreds of items seized by prince george's county police when they raided the maryland computer exchange on landover road in cheverly yesterday afternoon looking for suspected stolen goods. the tvs had been stolen from walmart by shoplifters who bolted through fire doors to waiting getaway cars between june 24th and june 28th according to prince george's county police. police are investigating now how maryland computer exchange got the tvs. investigators were back at that shop again today scouring the store for more items.

they are trying to match up the stolen goods reports from around the county. all of this part of a crackdown on pawn shops and secondhand dealers promised by county executive jack johnson. there have been no charges in this case. a lawyer for maryland computer exchange called it all a publicity stunt. he said his client bought all of this merchandise legally, whether it was stolen or not, because he checked the i.d.s of sellers and he reported the purchases to a computer database maintained by the county that police can check for stolen items. regardless, police say stores like this one get their attention because they say there were a large number of items inside the store that were still in their original packaging, indicating they were stolen. the investigation continues now and police say the warning goes out to pawn brokers and secondhand dealers all around the county that they are watching carefully and that trading in stolen goods will not be tolerated, whether or not the pawn brokers or dealers

u.s. coast guard helicopters are searching the shores of the turks and caicos islands for survivors of yesterday's boat rescue. 70 haitians are still missing when a boat carrying about 200 of them capsized. most of the victims were rescued. they were trying to escape the poverty in the western hemisphere's country. 60 people were hurt in this bombing in spain. it is believed a separatist group is behind it. the blast from the car bomb left a huge crater in the ground and sent glass flying everywhere. this is the eighth bombing carried out by separatists this year. president obama says u.s.

combat troops now serving in iraq will be home by next fall, but some soldiers may leave the country even sooner. defense secretary robert gates made the announcement on his last day of his visit to iraq, and 5,000 troops could head back ahead of schedule. the woman who called police to the home of a black harvard scholar is speaking out today, happy that she's been vindicated. that's because newly released 911 tapes prove that race was not a factor when police went to henry louis gates' home on a burglary call. gates was trying to get into his home when he got into an argument with police and was charged with disorderly conduct. lucille whalen says she's just relieved everything is out in the open. >> what has made me feel better is that the truth is out and that i feel good about. >> president obama has invited professor gates and cambridge police sergeant james crowley to the white house tomorrow for a beer. a houston boy scout troop is being praised for rallying together during a very serious
