helping. >> reporter: maybe he would have gotten away with it if he wouldn't have brought in the exact same eyeglasses for repair or wore the same jacket but he did do those things. contrary to outward appearance. >> he was very slick about it. >> reporter: this guy is not the brains of the operation. >> right now he has three frames in his possession. and he only end up putting one back on the board. the other two have been slipped into his jacket. and he repeats this process a couple of times. >> reporter: kim watches it all from a back room. all totaled $3,000 in merchandise. the latest slipped into the same jacket as tuesday. >> they went for the high end. they went for the tiffany, the bolgar, the coach. >> reporter: kim believes the woman to the left of the frame is working as his accomplice. >> she had a frame that required adjustment. so they kind of tied up our optical department. >> reporter: today the technician also noticed the

frame was the same one she had seen tuesday. so kim and her girls swung into action. >> i brought them to the back to verify the insurance. i called my cell phone and i acted as if i was talking to someone so i could talk longer before the phone cut off. >> reporter: while she had the suspect tied up, they called the police and did one more thing while she waited. >> while they were doing that, i went outside, got the tag number, came back and gave it to the police. >> reporter: and the montgomery county police promptly arrested the suspect. their surveillance system earned its weight today. >> thank you, andrew. >> thank a lot. this just in. democrats have pushed sweeping health care legislation through a key committee. democrats on the energy and commerce committee agreed to a last minute series of changes, including limits on how much

health insurance companies can raise premiums. the vote 31-28 and it goes to the september shoe down. let's move on to the weather situation today. severe at time. but looking at the sky, it appears we're in the clear. it was a drastic difference from the pounding we took a while ago. we're going to take a look at the weather in a moment. a tree crushed a car on 44th street and northeast. and trees also came tumbling down in maryland and along i66. >> let's get right to your 9 forecast first on a friday night. tony pann. >> hi, anita. two dozen or so wind damage reports filed in the national weather service office. and, of course, that includes the possibility of tornado in frederick and carroll counties. we can't say for sure that they were tornadoes just yet, but by looking at the preliminary damage, you can guess that it was. but they haven't sent a crew to survey yet. the official word will come out

leaves started blowing. and then there was a heavy, windy downpour like a horizontal rain. it almost was similar to a mini tornado. >> reporter: broughtfa down trees. this one on two suvs on route 109. passengers pulled out. no major injuries. >> oh, my gosh. as soon as i crossed the bridge and started coming up 270, i drive a tractor-trailer, and it just dumped. >> reporter: frederick county was hard hit. it destroyed the roof on an adjacent house. >> everything started going up and when we were up there we can see it going around. >> reporter: the wind and rain on the whiskey creek golf course. this house nearly escaped the downed trees that ruined her

yard. what was here before? >> garden. lots and lot of beautiful flowers. >> reporter: her biggest concern, her dogs. they're okay. neighbors lost shingles on roofs. it was over in minutes. the cleanup will last weeks. gary nurenberg, 9news news. >> gary also tells us one tree found a new home after the storm in somebody's hot tub. well, now to another type of damage done tonight. and what we are going to show you now was all caused by a car that backed into a gas meter. that meter sat in front of his apartment building and look at the damage here. the gas line ruptured. it caught fire. flames spread to the apartment. these are all in the silver wood farm apartment. the fire actually damaged 19 of them. good news, nobody hurt. now a follow-up on a story you saw first on 9news now. as expected, the dc council has shown a deal of increases all to help deal with a budget deficit. the district's gas tax would

jump. the tax on a gas of cigarettes would go from two bucks to 250. and the city's sales tax would climb from 5.75% to 6% even. >> any time they raise taxes on anything that people use, all people do is they quit using it. it does not work. >> i think they can probably use all of the money they can get. and if i didn't know what it was before, it only went up a quarter of a percent. i'm not going to cry about it myself. >> congress needs to sign off on these tax increases. if it does, the mayor plans to add his signature and the increases would take effect this october. another 9news now follow-up for you. the dc council member jim graham has called a hearing to look into the maintenance and repair of fire hydrants. all of that because of a home that was destroyed. firefighters lost water pressure while they were trying to fight the flames and today during a pressure test the water in the neighborhood was turned off. but whent idurne turne back on, some neighbors said the pressure

seemed normal for the first time in years. >> that's kind of the best flow we've ever had. we've been in the house here for four, almost five years and that's pretty goodor fd us. >> today insurance adjustors were inspecting the damage. congress is scrambling to put new tread on the popular cash for clunkers program. the program's $1 billion budget has been nearly wiped out. and that news has only added to the rush. >> we have people that were putting it off a few days already in our showroom looking to take advantage of deals. i think today is probably going to be one of the largest days in the automotive business we've seen. >> today the house voted to add another $2 billion to the program. the senate chimes in next week. and the white house says at the very least, all deals made this weekend will be honored. today the house approved new rules governing executive pay on

wall street. those rules prohibit large companies that encourage employees to take financial risks that could threaten the economy or the company itself. it also prohibits directors on compensation committees from having financial relationship with that company. it also gives shareholders a binding rule package. new tonight, another example of horrible animal abuse. a new york city man is accused of throwing his one year old carrier mix off a six story building. the dog is in critical condition. his front leg had to be reassembled. the 19-year-old owner has now been charged with aggravated cruel to animal. >> when you hear a story like that one and the one that broke several weeks ago about the poor dog that was set a fire, it breaks your heart. and e-mails poured in for days. but last night we told you about a 76-year-old man, a former boxing champ literally beaten to death in his own dc

neighborhood. and we heard from one of you. there something wrong with that picture. >> dr. randall lock wood's comput ser ser a window on one - computer on 150 years of dog fighting history. >> this goes back to 1884. >> reporter: and for the last 25, his job has been to help law enforcers crack down on the vicious game. including the michael vick case. >> it's not unusual for a high profile animal cruelty case to generate tens of thousands of e-mails from around the world. >> reporter: and he says prosecutors have often asked him why when there is no shortage of human tragedy. part of it, he answers, could be fear. >> these are dangerous people. and a lot of science now documents the people that hurt animals are certainly capable of hurting other human beings. >> reporter: but those who want somebody like michael vick banned fwr the nfl don't -- from the nfl don't seem afraid, they are furious. >> in general, people can relate to the suffering of animals. almost everybody has had a pet at some point in their life. so at the core of this, dogs are

welcome back. i'm tony pann. the weather is pretty quiet right now. so let's start with the three day trend going into the weekend. it looks like we're going wind up with a decent day tomorrow.

but if you have outdoor plans on sunday, you might want to keep an eye on the sky. thunderstorms are possible. i don't mean it's going to rain all day on sunday, because i don't think that's the case. but certainly if i was going to pick one of the two weekend days, i would pick tomorrow to do something outside. particularly tonight partly sunny skies. there is still a slight chance for a shower. no big deals. low temperatures upper 60s to around 70. during the day tomorrow partly to mostly sunny skies. a typical start to august with high temperatures in the upper 80s to around 90. sunrise tomorrow morning at 6:09. here is the weather setup, we still have a little front that has to come through here. it's a very weak one but the air behind it in a little less humid. and because of that there might be convergence along the front. so maybe a shower will pop up. you can see a little bit of that activity out there in the mountains. so that's why i said a slight chance for a shower. but basically it's going to be quiet now as we head into the beginning of the weekend. 74 degrees at the top of the hour. at national airport the dew .65.

so it's still kind of muggy. that produces a relative humidity of 76%. and most areas are in the 70s right now. there could be a touch of fog as well. 67 in winchester. 70 at bwi. 71 at the top of the hour at the nave al air station. let's expand the view and look upstream. the weather is coming from west to east. and you see a line of thunderstorms out in the northern plains. this will be the one that will likely come through on sunday with a chance for showers and thunderstorms. and you can see a lot of dry real estate in between the system that came in today and that one. so we should wind up with dry wet tore start the weekend on saturday -- weather to start the weekend on saturday. seven day forecast looks like this, thunderstorm on sunday followed by a dry monday it looks like at this point. and the temperature is all the way through the middle of next week is not going to change all that much. upper 80s to around nine so degrees. we're turning -- 90 degrees. we're turning the corner to august. stronger front will come through

on wednesday and that will drop the temperatures back into the mid 80s by the end of next week. but just typical summer weather for us next couple of days. >> right here on the cusp of august. >> thanks. >> thanks, tony. talk about the example of a wrong justice system. today a judge dismissed a man's case after he has been in jail for 20 years. his brother confessed to the crime or his dann is a match. >> the facts of this case is unusual as a 500-year flood. but the prejudice to the defense was not an act of nature. >> i think the judge really explained it. this is really a landmark decision. the prosecution would go to such lengths to hide evidence of innocence. >> the da's office in madison wisconsin had no comment. a jury today has ordered a

boston university student to pay $675,000 to four record labels for illegally downloading and sharing music. he admitted that he downloaded and distributed 30 songs. his case is only the second to go to the trial in nation. and amazon.com is being sued for deleting ebooks and doing so without warning them. that lawsuit seeks unspecified damages and it seeks a ban on future deletions. amazon recently removed classic and the other one animal farm after it learned that the electronic editions were pirated. so many of you are headed to the beach or pool this weekend. in living well tonight, how to keep your abs looking their best in a swimsuit. a slow digestion system can lead to bloating and it's especially common in women over 40. preference magazine offers tips on beating belly bloat.
