better news, an accident at route 28 is clear. however, going westbound another accident there off to the left shoulder so all lanes are getting by. wrap it up with 95 northbound and switch that camera to virginia. our buddy alex tells us near lorton to watch for construction. right now volume light. no incidents or accidents to report along the way. that's a quick look at traffic. andrea, over to you. some residents of an apartment building in capital heights, maryland are back home after a run in with bad weather. last night's storm sent a tree crashing through the side of their building leading to a mass evacuation. armando trull is live in the 41st block of southern avenue in capital heights with more on the story. >> good morning. the apartment building you see behind me here in capitol heights has some beautiful large ma churr oak trees. a combination of heavy rains that loosened soil around the

roots and strong winds that pushed on the canopy made sure that tree had enough. an oak tree weighing several tons came crashing down on the roof of a capital heights pardon me building damaging one apartment on the top floor as well as side windows. initially several dozen residents were evacuated from the building until emergency responders could determine the safety. once they did, everyone was able to go home and get shut eye. two were displaced. they are being held by the red cross. thankfully no one was injured an repairs are underway this morning. they are expected to be wrapped up by later tonight, at the latest tonight. andrea, that's the latest right now here in capital heights. reporting live, armando trull for 9 news now and wusa9.com. >> thank you. right now a water main break is causing some problems for residents and businesses in alexandria, virginia. the 12-inch main opened up 6:35

this morning in the 100 block of south reynolds street. three businesses and one residential building has been affected. the washington suites hotel has lost all of its water service also. right now the blocks are closed. repairs to the main are expected to last all day but could run in to tomorrow. service will be restored once repairs are complete. police in the upper region of montgomery county are on the lookout for a fire starter. around this time yesterday morning we told you about a series of hay bale fires in damascus, germantown area. someone set fire to a dozen bales of hay and three mailboxes. >> fire can spread to so much more and create so much more damage and you wonder how far are they going to take this? will they do it to homes and that is more disturbing. >> we feel safe in our neighborhoods so something like this is a little alarming. >> reporter: if you have any information which could help in this investigation, you are

asked to call montgomery county police. emergency workers in montgomery county could be weeks away from receiving money they lost when they were forced to take two weeks off without pay. the judge ruled the furloughs were unconstitutional. several unions sued saying the county could have found other ways to save money without resorting to furloughs. the county is expected to appeal the decision which will delay yesterday's decision. there are major happenings today at the state capital in richmond, virginia. governor kaine is expected to announce a reduction in the budget revenue. and they say this will be a whoer. $1.3billion. the governor is expected to announce what cuts he wants to make up for the short fall by early next year. then after this morning's meeting with finance committee members, a special legislative session governor kaine called

for last month begins this afternoon. he wants to address a recent u.s. supreme court ruling that prosecutors say could jeopardize some criminal cases. things aren't getting any better in maryland. governor o'malley is trying to find over $400 million to cut and he says everyone will suffer. >> it will come from state agency reductions. it will come from asking state employees to sacrifice once again in terms of furlough days or some other measures, and it will also be a portion of it will have to be shared by reductions in local aid at a time that many local governments are struggling themselves. >> reporter: governor o'malley will present his plan for a quarter billion dollars in cuts next week in annapolis. president obama is facing a my showdown over health care reform and this time it is not the republicans who have him concerned. several democratic lawmakers have expressed concern over the administration's efforts to abandon plans to create a government-run insurance

option. house speaker nancy pelosi said a government run public option is essential to ensure that everyone is entitled to health insurance and at reasonable rates. many democrats say they plan to vote against any health care which bill which does not include a public option. insurgents in afghanistan have unleashed a series of attacks on poll workers ahead of the election tomorrow. six have been killed by road side bombs. a suicide attack on a alternate convoyed killed eight and wounded 55. two u.s. troops died in another attack. earlier today the afghan government and alternate issued a media blackout across the country. they fear news of bloodshed will scare off voters for tomorrow's presidential election. back now to that ruling about furloughs that is causing an outcry in prince georges county. the ruling affects thousands of county workers. one question now is whether workers in other cities could be impacted. with me is the university of

maryland professor michael greenberger and also a former justice department official. thanks for joining us. when you heard this ruling, your first reaction? >> i think it is a very significant ruling because across the country, states are putting their employees on forced furloughs. just in maryland, for example. >> you heard governor o'malley. >> and i, myself as a professor at the university of maryland was put on a forced furlough last year. this decision focuses on unionized employees. they have a contract with the county that assures them a certain salary. and the judge ruled that the -- forcing them to reduce their salary in affect by going on these furloughs is an abrogation of their contracts. governments can't unilaterally without good cause abandon a contract commitment between a union and its employer, for that matter any other contract.

when you hear them saying there were alternatives, it's not an absolute prohibition, but if the government does have another alternative abrogating the contract they can't do it. governor o'malley has put people on purr furloughs in the state. some are nonunionized. some are unionized. >> reporter: the ruling specified the union contracts were abrogated. so county employees could still suffer furloughs. >> if they are not unionized. although the judge went on to say that certain personnel rules of the county were abrogated, as well. that is a clear-cut violation if there are regulations that say you can't do this or that. the county can't just ignore it. it will have to be studied. it is not just prince georges county, or maryland. across the couldn't, county commissioner and mayors are trying to save money by putting employees on furloughs. certainly those who are unionized will have a weapon to

prevent that from happening and it will put a further burden in the budget cutting. the further thing i would say about what why this is important, we are coming up to the flu season. i know governor o'malley personally is very worried, as is true of all federal and state officials about the swine flu epidemic coming through. and there are all sorts of concerns about having emergency responders work overtime to deal with the excessive patient care, et cetera. and there's a lot of concern about can you force unionized employees to spend additional time during an emergency. like there are some agencies that want to lockdown hospitals or something else, keep nursing working. this is a very big expensive -- extensive issue. it is not just 5900 employees in prince georges county this affects. >> right now the decision, as far as paying back employees

for the missed pay they had that is on hold but other jurisdictions won't probably institute furloughs until this is decided. >> it has been stay it's and will go to the forth circuit court of appeals. i think it is a very difficult issue. i don't know whether people will stop doing furloughs but there will certainly be losses brought -- lawsuits brought when furloughs are made to government employees who are unionized. let's talk about something that could get to the supreme court. an unusual september session for the supreme court will be the first for sonia sotomayor. what is the case about. >> what is at stake is whether congress, if federal government can bar corporations and unions from directly contributing to campaign advertising. it's been a long-standing proposition of campaign finance reform that corporations and

unions cannot give direct contributions. they can use so-called pacts or other federal election vehicles that are regulated. in 1990, the court held, yes, the congress can stop these direct contributions as part of the campaign finance reform. since that time, three justices, thomas scalia and kennedy have said they think it is an unconstitutional provision. it impedes the first-amendment right. >> even the chief justice has said that now. >> and now alito and chief justice roberts have joined the court and this is -- there are many issues in this case but this is the principal issue. if five judges get together and say, in affect, that corporations can spend all the money they want on campaign advertising and to do otherwise would internear with their first amendment rights it will unravel what we know as campaign finance reform. >> how does judge sonia sotomayor get up to speed on something that will be heard on september 9th? >> i think if we have learned

anything about the justice is she is a very smart, intelligent, quick study. i have no doubt she will be fully prepared and be a very aggressive questioner during those hearings. this is the kind of thing that judges get themselves ready to do and i think she is fully capable of being right up there with the other eight and active in this decision. >> reporter: professor greenberger, thank you for being with us. >> you are welcome. talk about wasting taxpayers ' money. you'll never believe what one local delicate did to impress a woman. and terrorist really targeting key government buildings. we'll be right back.

be hung up here the next couple of days. the other thing we are talking about with respect to the weather is of course hurricane bill. it is now a category four storm on the saffir-simpson scale. they go as high as five. this has winds of 135 miles an hour. gusting to 161. and as it makes a gradual turn to the northwest and north it should with a little luck put it east of the united states and west of bermuda. notice right here by 2:00 on sunday morning it is going to be forecasted to be around a category three but look, off the coast of the u.s. and approaching our latitude. so this will likely generate really rough surf as you think of the weekend and the latter part of the weekend but the latest computer model guidance has it staying off the u.s. coast and we will be watching this closely. we have another computer model we use. we dahl it adonis.

bars. he is doing -- he's a great performer and he's from here. >> in an hour and a half the big tent will be raised at pentagon city. we are talking about a really big tent. >> we are traveling with the biggest touring tent in the world. the tent 100 feet high and we created a big tent because we wanted a big stage. the stage is big enough, about 150 feet wide which is two or three times the regular theater opera stage. and we did that because we wanted the horse to have fun on stage. but when the horse comes on stage, it is like their playground. they come and play and they have fun. of course, because we have included a lot of aerialists it is a high ceiling, nothing traditional. when you enter it is not a ring. you don't see a ring.

woodworkers family and i created these chairs here to attribute that to him. and hopefully carry on the tradition of hand-crafted furniture. >> you have been doing this since you were 14 years old. how did you get in the process of making works of art, furniture that people can sit on but make their house beautiful how did you get in to this. >> i started making trinket and toys and picked up books and magazines and saw grit shapes i wanted to create. so i slowly taught myself how to build these things and apprenticed for a great couple of woodworkers so that helped. >> what is important, you can see the grain and the way you have created the back. where do you get your wood from? >> a couple of area sources in

sauce and a red wine. started to play with the italian variety and it is full of fruit, berry flavors, a touch of mineralty and soil flavors to it. it goes very well with the herbs, the herbs, the jalapeno flavor in the sauce. it will pair nicely with the wine. >> tell me about the peppers you add. was there jalapenos in there. >> a little jalapeno and crushed red pepper. >> so there is a little kick. >> there have a little kick but not overpowering. the flavors blend well together. >> okay. like i said it is very fresh. look at those beautiful tomatoes. >> they look delicious. >> you should have told me. we have tomatoes on our weather terrace and i could have picked you one. they seem to be doing well this year. >> what is that vinegar.
