commuting each day. 1% of us car pool and 13% use public transit, double they national average. today the dc city council is getting involved in the dispute over the southeast tennis and learning center. digital correspondent, alex trevnio is live with a preview. >> good morning. the fate of the southeast tennis and learning center could be decided here later today. the heated issue will be talked about and the council will be meeting today in an emergency meeting. >> a judge granted a temporary retraining order stopping the district from evicting the founder and chief executive from the nonprofit program. former dc first lady cora masters barry runs the center. >> tennis is the hook and education is the key. >> they are fighting for the tennis and learning center in city hall.

>> not only do they not get money for what they do they raise money for the kids. they provide educational programs, scholarships, and other support for these kids. >> reporter: dc leaders say they ordered the eviction because their corporate status expired. therefore theelol lease became void. chairman gray will introduce a bill at the legislative session to restore the lease between the dc government which owns the building and southeast learning center. it is not clear why mayor fenty wants the barry group out of the offices owned by the city and rented by barry. he says the tennis programs will stay under the direction of the dc rec department. live from the wilson building, 9 news now and wusa9.com. maryland gyming officials are expected to finally award the state's first slot machine gambling license. it is expected to be awarded tomorrow to the ocean downs racetrack outside of ocean city. the "washington post" reports the track is seeking to install

and operate 800 slot machines. we have to track slots operation and if it is approved it would require the approval of the lottery commission. it could open by next may. there's a paint ball fight in western loudoun county them board of supervisors would have to spend the next two months reviewing a zoning ordinance that allows pain ballparks to be built. residents complained about the noise they say comes from the paint ballpark. the 47-acre park just off of route 50 holds eight fields. opinion about the park is split. >> it is at patranya bhoolsuwan patranya bhoolsuwan. all day long. >> our games start at 10:00 in the morning until like 6:30, 7:00 at night. we are still in the noise perimeter. >> the board of supervisors decision will not affect the park. however, it will more than

government accountability office. parents preparing school lunches are scared after this and all ears. >> the federal agency that supplies food for 31 million children failed to ensure that tainted products are pulled quickly from the the shelves. if you take in to account the salmonella peanut scarey generallier this year where 700 people were affected. the problem was while the investigation was going on, no one told the schools you might have these products, pull them from the shelves. the story was reported by two people in our news department. >> which agency is responsible for telling schools there is a problem. >> the usda is responsible for sending down the chain and the gao say that's failed to send out a timely complete notification about suspect food products. >> i was saying how long of a delay? they know it and -- >> within a week at least.
