9news now inquiries, police said we must decline comment because the investigation is ongoing. >> this is a case where nothing seems to make sense. none of the pieces really seem to fit. >> reporter: gern, no one has been charged -- again, no one has been charged with juan's murder. it's back in court at the end of the month. derek and anita. >> all right. thank you. you were right, disturbing stuff. now a follow-up on a virginia priest convicted of stealing from his own churches. virginia's court of appeals has agreed to hear his case. now, he contends he should not have faced charges in both state and federal court. he was convicted in federal court on charges of fraud and money laundering and sentenced to five years in prison. a state court found him guilty of embezzlement up to $1 million. now, that judge gave him 13 years to be served after the federal time. dc council member plans to introduce a bill that would allow same sex couples to marry in the district and he plans to

introduce that bill next tuesday. it's expected to pass and then get signed by the mayor. but it will still have to get by congress which can overturn any dc legislation. the district already recognizes same sex marriages performed elsewhere. people living near the mount vernon square area in dc say police are not paying attention to crimes that take a toll on their quality of life and they say they want it to stop. brittany morehouse has the story. >> you have a cop that is selectively enforcing the laws. >> reporter: in this neighborhood near mount vernon square, there was one common complaint. it's the kind of scenario he says he faced up close yesterday afternoon. >> i pulled on to 4th street right by the 395 tunnel and watched a homeless dude start peeing in the tree box. >> reporter: he says stopped in the lane next to him was a police officer. >> so i threw it in neutral and set the parking brake and knocked on the cops door and said there is a dude peeing in the tree box. are you going to do anything.

he's doing, what, he's peeing? leave him. he's fine. and i was just in shock. >> reporter: oddly enough, that's the reason why months ago he said he moved away from dc. his house was broken into. >> basically they came in through the alley. >> reporter: and he thought it could have been prevented. >> i had reported peeing in the alleys and drug use in the alleys before multiple times. and still never saw a cop in the alley. >> reporter: he is sharing the story on the community blog where some respond with anger. >> it could have been children around. >> reporter: others defend the police. they tell 9news now they think officers have enough on their hands. but he counters. >> did you start with the quality of life crimes, maybe you'll get bigger criminals. >> reporter: brittany morehouse 9news now and wusa9.com. >> and we did reach out to the police about this. they say they cannot address specific claims posted on a blog. they recommend that concerned citizens file a complaint with the department. a local hotel and a federal

lawsuit over the maids it hired. when the brand new owners bought that hotel two years ago, they hired only hispanic housekeepers. the other housekeepers that worked there for as long as 15 years lost their jobs. tonight the cdc says h1n1 flu cases are now widespread in the district, maryland and virginia. today's map shows 26 states with widespread infections, 11 with regional questionsters and just 12 states with localized cases. vermont is the only state still reporting sporadic cases. the government did start shipping out the first orders of the flu vaccine today. 25 states in metro areas, including maryland and the district placed orders for the vaccine yesterday. the first day they could make those requests. now between 6-7 million doses should be available by next week. but the first 6 hundred thousand to go out will be in the form of a nasal spray.

not a shot. virginia health officials are expecting to get 43,000 doses in their first batch. the majority of those will go to hospitals and local health departments so they can immunize their employees. virginia and maryland are on a list of 15 states one group says may not be ready to handle a large outbreak of h1n1 flu. the trust for america's health estimate that if a third of the people contract the flu they could run out of hospital beds. it's ushlinging hospitals to have -- urging hospitals to have a surge plan to prepare for an onslaught of six people. people are lining up for their urnl flu shots but -- usual flu shots but they're dealing with delays because of the crunch to get out the new h1n1 vaccine. some doctors say they've already been forced to turn patients away and some public health offices have had to cancel their community flu tickets. now, you can stay up-to-date on all of the developments with the
