accused killer of chandra levy is seeing some embarrassing mistakes. a male, presumably, a cop or tech got his dna on her type. and prosecutors misplaced or lost a hair sample found on the body in rock creek park. >> i'm not surprised by that information. there have been mistakes made from the very beginning, and it's what happens in washington, d.c. >> reporter: capitol hill intern san chandra levy was reported missing in 2001. the case became a natural infat ration. her body was discovered in rock creek park a year later. police charging mark with her murder. now the mishandled evidence. >> a defense attorney could say there has been tampering of the

evidence. the defense attorney could say that. someone in law enforcement may want to cover up something. >> reporter: we asked, but were told quote, the police department captain discuss a case before the court. the prosecutor said the answer is no comment. >> they've hidden things. they've mistreated information. that's mistreated our family. it's been going on for years. >> reporter: the murder case is currently scheduled for october. thank you, meantime our nation's intelligence leaders say a terror attack could be likely within the next 3 to 6 months. these terror groups are thought to be smaller group, and intend to use simpler methods of attack. >> the threat itself could be any number of things.

we've seen most recently with abdulmutallab the attack, the attempted christmas day bombing on an airplane. other than that it could be shopping malls or mass transit systems to larger scale attacks like we saw on 9/11. >> the experts say officials are paying closer attention to terror suspects on our soil already. a woman is behind bars accused of killing a mother and her child in dale city. natalia wilson is charged with two counts of murder in the stabbing death of a 41-year- old. she was the ex-wife of wilson's current husband. they had been living on columbia pike in arlington. >> i just think it's horrible. it's really scary to think that could happen. just a terrible story. >> one of the victims had been a mail order bride and the

sister of a bulgarian tycoon who was assassinated seven years ago. they say the motive appears to be purely domestic in this case. the fix is finally in for the toyota recalled vehicles. today they started repairing the potentially sticky gas pedals. they will use a small metal and graphite tab. the they expect the customers to start flooding in any day now. >> we're telling our customer it's, plan an an hour. by the time we check the vehicle in, we want to put it in the shop, and complete the recall for the sticky pedal, and also do a complete safety inspection. >> today, ray lahood warned owners to take the vehicles in for repairs as quickly as you can. questions are being raised now about the brakes on the toyota

prius hybrid. there have been eight complaints about the brakes in this country. 77 complaints in japan. the automaker says that problem has yet to cause any accidents. gay marriage in d.c.? another utah lawmaker says not so fast. this time, it's senator bob bennett, he's introduced a bill that would force d.c. to put same-sex marriage on the ballot, before allowing any gay couples to wed. this bill is similar to one introduced in the house. the d.c. council approved gay marriage in december. prosecutors are asking a judge to officially close the case of that deadly shooting at the u.s. holocaust museum. the suspect james von brunn died last month at the age of 89. prosecutors said he opened fire as he entered that museum last june, killing stephen johns. under arrest, 27-year-old

michael gordon of brandy wine. investigators said the trouble went down at a shop. they said he exposed himself to two female shoppers and ogle d another teen. in illinois, a man who broke into a shop and took hostages is now dead. police said he turned the gun on himself after they entered the building. some scary moments for passengers on an american airlines flight from dallas to seattle today. the plane had to be diverted to oklahoma city after passengers heard a banging onboard. the mother of a 6-year-old in colorado is suing her son's school after a teacher duct taped her kid's mouth shut. that teacher has pleaded guilty to misdemeanor child abuse charges.

three young children left alone in their apartment almost died there today. a fire broke out in the kitchen and that sent toxic smoke into the kid's bedroom. by the time the rescuers burst in, those kids had stopped breathing. one had no pulse at all. but they managed to revive all three of them. >> went down the hallway to the right, did our search, where we had two children on the bed. the middle one i found at the bottom of my feet. >> investigators say the father had headed off to work this

morning, by the time the neighbor showed up, the fire had already started. investigators said the kitchen stove had been left on. police in gaithersburg need your help to find this robber. you've got info, call the cops. in california, a swarm of teens attacks a city worker, and it's caught on tape. we want to warn you, some of these images are disturbing. police say the worker was driving a backhoe. a group of teens started to go over and beat him. officers said the group stole the man's wallet and left him on the side of the road unconscious. >> once the individual goes to the ground, a large group swarms over him that you can't even see anymore. it's difficult to see how many of those were witnessing, or
