>> reporter: good morning. early this morning rescue workers confirmed what had been feared here all week that yes, those four missing miners were indeed dead. conditions were so bad inside the mine, so much smoke and so much dust, that those rescue teams had actually walked past the bodies of these mean miners their first trip on monday. just after midnight, a grim governor joe manchin of west virginia matt announcement. >> we did not receive the miracle we prayed for. we have accounted for four miners that had been unaccounted for. we have a total of 29 brave miners who we're recovering at this time. we have been spending time with the family as you can tell. it's a very difficult time, they're strong, loving and good people, but very, very hard times. >> reporter: you heard the governor talk there about 29

miners. seven bodies were taken out right after the explosion, that mean 2/2 more have to come out of the mine. no time table on that. a community wide memorial is set for tomorrow. >> jim al ex-rod for us in west virginia. thank you very much. if other news, john paul stevens said on friday he will retire this summer after nearly 35 years. some republicans are promising a tough fight if president obama nominates someone they consider too liberal to replace him. cbs news chief legal correspondent jan crawford with the latest on this story. >> reporter: well, the white house said it wants to move quickly to replace him, but whether the senate moves quickly to confirm him or the nominee is going to depend partly on who the president picks. when justice jop paul stevens joined the court 35 years ago, he was considered a moderate conservative. now he's seen as a solid liberal. >> i don't like try to change the law. i just think it's part of the

job of the justice to explain his or her vote. >> reporter: with the nine justices often split along ideological hines, stevens led the left wing on key issues, affirming abortion right, upholding apif i have difference action, banning the death penalty in certain cases, limiting presidential war powers. his announce want comes on the heels of a bitter health care debate between the white house and congress, would not that could play out again as the presidented mom natures a replacement. >> i hope the senate will move quickly in the coming weeks to debate and then confirm my nominee. >> reporter: sources say the white house already has a short list of potential nominees. those include elay in kagan, former dean of the harvard law school, well regarded by some conservatives. die an wood, a chicago federal appeals judge, highly respected, a university of texas law graduate. and merrick garland, a federal

appeals court judge in washington, d.c. who is considered more moderate on criminal issues. but one thing any successor won't get is the kind of confirmation justice stevens had. he was confirmed just 19 days after he was nominated and the vote was unanimous. >> don't see that happening this team around. let me ask you right off the bat, who is the front-runner of t the three that you mentioned? >> reporter: i think this depends on what kind of fight this white house wants, and i don't think they want one. merrick garland would probably be the easiest to confirm, but there are a lot of voices calling for a woman. and that points i think to ekagan. she hired a lot of conservative law professors. so you remember there are only two of those nine justices are women. a lot of calls for another woman on that supreme court.

>> does the president go with who he thinks will get the smoother confirmation or the person he would rather fill the seat with? it's got to be tough for him to decide how big a fight he wants. >> reporter: that's a great question and it always factors into these picks. what they'll try to come is get the best nominee possible from a liberal perspective, the most progressive. but also the one who is probably going to be the least of a fight. so it's almost like you plot it out on a bar graph, whold be the best, but also the easiest to confirm. if they plot that out, that paints to kagan. >> thank you so much for taking the time. good to see you. we have other breaking news stories this morning. elaine quijano is at the news desk this morning. good morning. as we mentioned earlier, there is breaking news out of western russia. authorities say there this are no survivors after a plane

carrying president electrlech kaczyns kaczynski's plane crashed. >> reporter: we have conflicting reports on the number killed, but the latest we understand from the russian emergency men industry is that the in that killed is 96. the local authorities are saying that the pilot may have been to blame. we know there was very heavy fog when this plane tu 154 was attempting to land. it had come from warsaw, it was attempting to land in very heavy fog. around three or four attempts at actually handing on the runway were taken. and from the picture that we have seen, the entire plane was shattered. the debris spread across a wide area of the information rest and the plane itself was carrying a very large delegation of polish officials, the highest officials in government. of course the president himself, lech kaczynski, his wife, maria, the army chief of staff, the

have issues with the u.s. going nord with adoptions. what do you say to that? >> well, we join in the collective outrage over this situation, the decision of the part to send him back to russia. we also think it would be a real shame and not a service to children at all if international adoption was to be suspended over the misguided action of the parents in tennessee. certainly there's many, many and literally tebs nse of thousands successful adoptions. alex, a yuoung boy adopted at a omder age, he's now collecting donations over $65,000 sent back to russia to build playgrounds for orphaned children in that country of birth. >> what are the parents options with an adopted child?

>> there's many. the last thing you want do is call a travel agent and send a country back to their country of birth. they could have called their local church, there are plenty of support groups. there's psychologist, school counselors, social services by the state. they could have called their adoption agency who has licensed staff to assist in these types of situations. >> peter, let's turn things over to you. what happened here, how can this possibly even take place? >> this is really dealing with a chain of custody situation. who had custody, who provided documentation that was properly notarized and accepted, and then was he traveling on a u.s. passport, a russian passport, at what point does the airline accept liability. >> the airline in this case, unit united, denies wrongdoing. do you buy that? >> there are too many unanswered questions. but the real key is the child custody situation in this country with so many children

divorced traveling between parents. so there's case history where one parent has to provide a notarized document of approval allowing the other parent to at that time kid out of the country. in this situation nobody was taking the kid, the kid was jt put on the plane. once the airline accepts that child, that's where the responsibility starts. >> it looks like we've lost that feed, but it is an important story. we'll continue to follow it and continue to follow the outcomes. meantime, we're following some chilly weather here in new york. thank you to tom and peter and thank you to lonnie for bringing us up to speed. >> wednesday we hit 92 in new york. today you won't see anything other than around the 60 degree mark. but let's talk about the big weather story. it's the fact that there is no big weather story. this is the springtime, the time of volatile weather around tornado alley. i don't see it. it's pretty calm from one coast to the other. a little bet of front here that will put light showers down in portions of the smrl plains

awkward. kids love totino's party pizzas. this week we welcome actress hol holly robinson pete and her husband, rod they pete. their 12-year-old son, r.j., has autism and they have become leaders in the fight against the disability that now affects one never 110 children. they along with their daughter, ryan, have just authoreded two books on the subject and recently i sat down with the petes and started by asking

holly when she first noticed there might be something wrong with r.j. >> there was a needle on the record moment, if you will, where he stopped connecting with us, stopped talking to us and looking at us. and so we saw that and we're like what is going on. so almost -- it took a year to get the diagnosis. and i walked around a little better about that because that's year of intervention that we missed ut on. so if you see sign, get on it, don't be scared of what you'll find. >> parents in your situation who are out there listening to this, what's your advice to them, what should they be thinking about and doing right now? >> you you shouldn't hesitate. i think that holly mentioned the fact that if there are sign, get your son or daughter checked out. we were lucky enough to have early intervention and we're lucky now that he's mainstream manage school, he's playing in organized sports, he's doing a lot of things that early on our doctor said he would never ever do. and so we're lucky in that, but

early intervention is the key. >> and you've written about that, the fact that the doctor said to you, said he couldn't play sports, said he wouldn't be able to say i love you to you. that must have been heartbreaking. >> it was. but that's one of the reasons why we broke "my brother, charlie." she was so cute, his twin sister, she advocated for him and said, look, he did get on my nerves, did he ruin a lot of play date, buzz he's a really cool kid if you get to know him. so it's important to talk early to children about autism and promote autism acceptance and awareness because they're really exceptional human beings. w >> you writing with your daughter must have been therapeutic with you. >> i'm laughing because when i read it, i sounded like such a b word. >> but that's what -- coming to that point, that's one of the issues that parents raising children with autism face. there is a very high

unfortunately divorce rate, much hire than the averages, for parents who are dealing with children. how did you stay strong for each other? >> wow. it was her. >> i like to say it was him. >> i was stuck in denial for a period of time. i really was. and i talk about that in my book. of just being that father and that man that wanted to fix my son and really didn't pay attention to the signs ors p education that i needed in order to communicate with him. so for a period of time, we didn't connect and she was rolling up her sleeve, she was reading every book, talking to family, talking to doctors, and she was sending me books an i'd throw them under my bed and not read them. and it came to a point where i really had to almost get embarrassed by the treatment that was given to him and understand that i needed to really put away al my expectations, really come down to his level and understand what automatic it tim is. >> i was for nat that rodney was willing to sit down with a therapist and talk openly about

dweeki i tweaking his expectations. dads process autism differently. i went on the war path and he sort of retreated. so i'm really blessed that we were able to meet in the middle and i think rodney's book will be very helpful to families. because i needed him to get through this. >> in terms of the information out there that you've come across in researching your books and also in understanding what r.j. is going through, what would you say is the most surprising thing you've come across? >> the most surprising thing is how present people with autism are. even if they're nonverbal, they're there, they can hear you. they're not deaf and they're around. and also just how amazing they are and how we need to value them in society. >> and how far has r.j. come? how is he doing today? >> he's doing great. they said they would never be verbal, we're so blessed that he is. a lot of parents don't get to experience that. >> i'm so happy to hear from both of you on this. thank you so much for taking the time. and if you'd like to see more of

what you can deduct for next year. but the problem with keeping them like this is that, and we won't go through them all, but then you hand it over to an accountant and he says i'll charge you by the hour and it's very expensive. so instead, i have a very high-tech secret method called an accordion folder. >> and very expensive, too. i'm just kidding. >> inexpensive. what do you you do is color cod p topic. whatever it is, you just flop it in the folder, keep it in a convenient place. and have a pen and you write on it lunch with rebecca and coming up for ideas "the early show." and you have it all year long. >> and then when you actually get down to doing the taxes, you say tax software is a great way to go. >> there's turbotax, all kinds before tax act, h&r block at home, and these are great.

center, only 5% of millennials cite work ethic as a trait to define themselves. in fact half of the 18 to 24 year year olds still live with their parents and three-quarters continue to take money from mom and dad. so the question for this week's early line, are millennials a generation of slackers? and i hate the question because i am a millennial. joining us, author and career coach. it is great to have both of you here. not the greatest topic for the generation. does it surprise you? >> it doesn't surprise me. what i've looked at is that a work ethic is something that has to be instilled. it doesn't happen naturay. and most people learn their work ethic in the home or in schools. and the trends in parenting and in the schools really are against or away from, not

against, away from challenging, rigorous commanding activity and a away from the kinds of punishments owe demerits for not coming through. >> i love this generation. and i've seen many kids, young adults, who are determined but viewing the workplace deathly. their parents may talk about work ethic, but what they've seen is a lot of agreed and negative outcome as a result of working hard. they've seen absent parents, they've seen parents stressed out. and as a result, they're in debt and not able to enjoy the fruits of their labor. >> so what needs to change? >> what i think needs to change is we need to understand there's a big difference what happens when you get into the workplace. and for these people, they're not willing to pay their dues and that does need to change. because they have to realize

that they can't hav everything they want right away. >> do you agree? >> largely i agree with the latter part. they do need to change. and i take a pretty hard line on things especially when we look at the helicopter participants. those parents who are managing their children's lives long beyond toddler and childhood time, well if to their 20s. just ask college admissions officers how many phone calls they get from parents. and when we look at high school and college, one phenomenon is grade inflation in order to get that a or b, you don't have to work as hard as you used to work for that a lot of kids when they leave college or high school and they enter the workplace, they're shockinged. they don't understand why didn't i get a delay the way i did when i wanted to submit that paper. >> and right now the workplace is more economy difference than ever. unemployment, 10% overall, but among young people, it is much

higher. what do you people need define themselves in the workplace and work through this bad wrap? >> they really need to set themselves apart and they need to be willing to take a stake and say i am responsible, i am willing to do what it takes. and to prove themselves. but these are great kids. many are not looking for just the paycheck. that's the big difference. they're looking for meaning in their work. they're looking for purpose. and they want to make a contribution, they want to take a stand and have a statement for their own generation. and it will be different than previous generations and different isn't always positive, but it can be. they have a lot to teach us, as well. >> any words of wisdom? >> i think that if you want to instill the work ethic in 25 year olds, they are so peer oriented where peer pressure is even higher dan than before. so what employers and teachers need to do is to single out young people who do have the work ethic and hope that their
