long list of charges that i found against him that stretch back months and years. >> jones was the driver of this white van that hit the toyota camry head on monday evening here at alabama and 36th street southeast. >> i er 1 there arredentin drlaing thout a licee or offeri suspended out of state license. and additional accusations of driving without registration or insurance. all the charges are still awaiting outcomes in court. >> this guy was booking. >> by all witness accounts, jones was speeding wildly when he crossed the yellow line to avoid slow traffic at the light here. >> he hit this car so hard, i know he was with me. >> the head on can the camry killed the driver, bystanders rescued three children from the car. a two-year-old girl was ejected, but survived. all the kids were evacuated in critical condition. a passenger in jones' van was also hurt. today one neighbor left flowers

at the scene, still badly shaken by what she saw. >> they had to cut her out of the car, and that was hard to look at. >> by the way, the accused driver, ajene jones and his passenger were rescued before the van caught on fire. the woman who was killed was mary elizabeth wimbush of southeast washington. the children's names have not been made public. all this happened at 7:30 last night in front of beers elementary school and this evening, there's a dc police officer running camera speed enforcement. something they do here a lot, but it wasn't enough to prevent this accident last night. reporting live in southeast, scott broome, 9news now. >> before you go. jones is charged with involuntary manslaughter, has he apeered in court yet? >> he is still optized, but he has a court date scheduled for tomorrow afternoon. that will be his first appearance. >> friends and family are preparing to bury brian bets.

the 42-year-old was gunned down in his home almost a week ago. police recovered his stolen suv, but no suspects are in custody. audrey barnes spoke with his sister and neighbors about the legacy he leaves behind. >> lesli, jennifer will never forget the knock on the door at 1:00 in the morning and the feel of dread that set in. police will tell her her big brother is dead. she can't imagine who would want to hurt brian. he was surrounded with friends and helping to put a couple kids through college. she says the family won't rest easily until police make an arrest. >> my parents and i just want the person caught. and we know that they are doing everything they can and we just want everybody to remember brian for who he was. just an amazing man. an amazing, amazing man. >> the family is working with

dc school chancellor, michelle reid to establish a scholarship fund. she had personally recruited him from montgomery county schools to try and improve things that shaw middle school at garnet patterson and that job was well underway when he was murdered. we are told this afternoon that bus loads of student frs shaw and montgomery county schools will be going to his wake tomorrow night in manassas. it's being held at pierce funeral home from 6:00 p.m. until 9:00 and it is open to the public. the funeral service on thursday, however, is private. lesli. >> no doubt. some very emotional days ahead. audrey, thank you for that. two residents face felony charges connected to cockfighting. they are 36-year-old ellis locklear and tonya williams. investigators conducted a search warrant and confiscated more than 600 foul.

all the roosters had to be euthanized. this was the lanchest seizure of its kind in the state of virginia. the supreme court struck down a federal law today aimed at banning videos that show graphic violence. at issue was the conviction of robert stevens. the virginia man was sentenced to three years in prison for videos he made about pit bullfights. the videos are within the bounds of free speech and threw out his conviction. the humane society is firing back, forcing congress to treat them like child pornography, which isn't protected under free speech. taxation without representation will continue in the district. house majority leader announced tuesday that lawmakers will not take up legislation this week giving dc residents a vote in the house of representatives. dc residents who pay federal taxes and serve in the military have been denied a vote in congress.

the ground in florida. news out of china tonight about that 7.1 magnitude earthquake that hit the country last week. the official death toll climbed to 2,046 people with 193 still missing. rescuers are searching through collapsed buildings looking for survivors. scientists say that volcano may just be the opening act. they are afraid the tremors could trigger a more dangerous eruption nearby. it would be a worse case scenario for the airline industry and travelers. for now, more flights are taking off. alex is live at dulles international as some travelers are finally returning home. alex. >> reporter: lesli, many anxious people waiting for that highly anticipated arrival. those planes finally landed today and lesli, it sure was nice to see many local families reunited with their loved ones after the long delays. now here at dulles, the first planes to arrive were between 1:30 and 3:00 this afternoon

from europe. many folks have been separated from their loved ones longer than they expected. the spread of volcanic ash had a massive impact for the past five days. the delay was certainly disrupted the lives of many, including a couple from dc. >> the waiting and you know, not knowing when he was going to be there and house is on the market and we are closing on our new house on friday and i really needed him to be here. so he went to great lengths to be here. >> are you kidding me? >> her husband, craig says he is glad to be home. now certain air outs to european cities, like madrid and munich have deemed safe. 2/3 of flights between the u.s. and europe have been canceled. but the last few hours here, if it's any indication, looks like things are getting back to

normal. reporting live, i'm alex, 9news now. >> all right alex, thank you. sarah palin is expected in court in tennessee. she may testify in the trial of a former college student who was accused of hacking into her e-mail account. this allegedly happened while she was the gop candidate for vice president. the judge has rejected a defense request to ask jurors if they have strong political feelings about her. >> martin o'malley who is running for reelection visited the university of maryland today to talk more about making government more efficient. the visit was part of what he calls the jobs across maryland tour. o'malley talked to students and faculty about what he said were standards he implemented as governor. well, if your pill lee keeps you from drifting off, will a pricey one help you get there quicker? the more expensive pillows are more comfortable. but memory foam pillows had the same level of comfort.

it will be cool. not as cold as it has been. 46 to 52 and winds have turned now south, southwesterly at 10. that's a warmer wind. tomorrow morning, mostly cloudy and cool. light rain and showers. temperatures in the 40s and 50s. winds out of the southwest at 10. the light rain and showers will be in some of our southern viewing areas, as it worked its way from southwest to northeast throughout the morning and afternoon. by afternoon, i think everybody is going to see light rain and showers, highs around 60. and winds easterly around 10. so easterly winds will keep temperatures down. that coupled with rain and showers will do it. here's our 9 future cast. by midnight, not too much. a high and mid level clouds coming in. take you through the nighttime hours, some showers possible west of town after winchester, north of culpeper. as we go through the morning, we are looking at a good area of showers and light rain for fredericksburg up to dc and that will envollop. again, not a huge storm, kind of a pes ky storm quite

frankly. rain fall amounts, half an inch. that's about it. satellite picture, radar combined. we are going to watch this big storm out west. it's a big sized storm. that's for our weekend. we are looking at light rain through eastern kentucky and tennessee, back down, cleared atlanta. that's what is headed our way. it's going to move up to the northeast. it's not a huge storm, but enough to make your take your umbrella tomorrow. high clouds right now. they will stay dry through tonight. next seven days, 61 tomorrow. light rain and showers. 68 on thursday. almost 70 on friday. those are the two nicest days of the next seven, i would say. rain and showers, showers and thunderstorms possible. upper 70s on sunday. for the earth day festival and low 70s. left over showers monday and tuesday. a little unsettled. >> here's something that may be unsettling. do we want t.o.? >> i don't know if we want

olsen on the bump. this will be olsen's second start of the year. finally tonight, this had disaster written all over it from the beginning. the oklahoma city thunder mascot, who is some kind of -- was going to do a back flip, but he hit his head on the ladder and went tush over tea kettle and didn't dunk anything. fortunately, when you are wearing the big head and body, it absorbs some of it. >> that would have been a hard hit. >> i mean, that's a good thing. >> oh man. >> and that's a perfect segway to me. >> brett cam. >> a little more growth. we do. >> but come closer, i think the problem is, it's like nine different colors, because it's gray over here, brown and blond. it's just -- i said i would wear this thing, but it's not a good look.
