vote. and this is another race where the primary served as the general election. and phil mendelson is the winner for the d.c. at-large city council seat. he easily beat michael brown. in maryland a different landscape and in prince george's county today with new faces winning primaries for every major office. the marquis race has been claimed by baker and he is promising to appoint a inspector general to clean things up. >> reporter: it promises to be a dramatically changed prince george's county government. there will be new faces and five of the eight council seats will have new people too. >> i don't plan to wait until december. i plan to meet with the budget folks immediately. >> reporter: for baker, the third time running for county executive was the charm. he defeated county sheriff

michael jackson and four challenges despite the endorsement of jackson by the current county executive jack johnson. baker took no direct shots at jackson or johnson but said he wants to create an inspector general office to clean up county government. >> i think if we're going to have the confidence in the public, whether perceived or reality, that prince george's county is a place you can't do business or contracts are being handed out, we need an inspector general who is independent from the council and county executive to come in and make the hard decision. >> reporter: baker will join angela alsobrooks for state attorney and melvin hine leading a tight race for sheriff, to provide a new top three. and also brooks declared victory today as well. >> it is something of honor that the people have their trust and confidence in me and to feel i can keep their family safe is wonderful. >> reporter: among baker's

direction. alley in the november 2nd general election. meanwhile in delaware, the tea party is celebrating a big upset in that state's u.s. senate race where tv commentator o'donnell upset mike castle in the republican primary. we we are going to take a closer look at the tea party elections tonight at 5:30. now to breaking news out of prince george's county. right now we are keeping an eye on a police investigation in largo. we're told a 19-year-old man was shot in the 10,000 block of benington drive. investigators say she was shot in the chest. he was taken to the hospital and his condition is not yet known. we'll monitor the scene and bring you updates as soon as they come in. the end of a mystery for a family from ohio whose son is left at arlington cemetery. there was question about whether he was buried in the

right spot. we were with the family as their son's casket was exhumed today. eric joins us with the story. >> reporter: scott and melicca warner returned to a familiar site. the final resting place of their son. keith warner was killed in iraq in 2006. since the beginning of the summer, the government tells them they can't confirm he was buried in the right spot or even the right casket, leaving the family a painful kiss to exhume his -- cowboy to -- choice to exhume his body. >> if it is him, i'd like to set it on him again. >> reporter: if a lapse in government paperwork couldn't tell if he was same casket buried in arlington days later. they would check the outside of

the casket against the one on the inside. with a close marine friend by their side, scott and melissa warner came out with good news. confirmation that his body was in the right spot. >> i can breathe. i feel like a ton of bricks have been let off my chest. such good news. >> reporter: but because the casket had broken open, scott took matters into his own hands for confirmation, to see his son's body up close. >> his right arm, and then verified it to the photos that we have of his right arm and then i knew for sure that it was heath. >> reporter: the tattoos also verified by fellow marine brend on wheelan who served with him in combat. >> tell me why it was important for to you be here for heath.

no words could endure. >> it was to confirm that it was him. >> reporter: such an emotional day for the family. and heath warner's remains are now in the right spot in a new casket rein toured today. but now they know where their son it. >> eric, we know you were involved in this family and you are an iraq veteran so this is close to your heart. is this the end of the saga for this family that you followed for so long. >> probably not because they'll hear from other veterans and as a veteran it's upsetting to see any family go through this. but for now they said they would take him back to ohio. they're going to sit on that

and help other military families who, like they are, in limbo about their own relatives buried here at arlington. we'll follow that up. >> thank you. a man is charged with sexually assaulting a woman he met on an online dating service. the woman was held against her will and sexually assaulted. they met through the e harmony website in june. there is concern that there are other victims who have yet to come forward. one minute a metro bus is on the route, and the next slammed by a fire truck and dozen of dazed people are taken to the hospital. that's what happened this morning at the intersection of madison and 14th in northwest washington. lindsey mastis takes us to the scene. >> reporter: the metro bus was headed south on 14 and the fire truck east on madison. the metro bus would have had the rights of way but pete beringer said the fire truck had the lights and sirens on, responding to a call of a woman

hit by a car. >> it was so fast, we didn't see the fire department was coming. >> reporter: the fire truck hit the side of the bus, pushing it sideways. >> i was on the floor, so the next thing i opened my eyes and the guys were saying to get up. >> reporter: 2 people were transported to the hospital, including all four firefighters on board. >> none of the injuries were serious. again, they were all precautionary. >> reporter: this man lives nearby and said the sirens came on too late. >> it was not a way off, it was very sudden. you heard woo -- and then it was like within a 15-second span. >> we heard the siren too late. >> it was a boom. >> reporter: the fire department, metro and police are investigating. but they haven't determined whether anyone is at fault. in northwest washington, i'm lindsey mastis. 9 news now. >> d.c. fire and ems said everybody is expected to be treated and released from the hospital today. there is minor damage to the

future. the weight loss drug meridia became popular in 1997, but concerns that it can increase the risk of heart problems in certain people has an fda advisory panel deciding if the drug should stay on the market. >> if though don't remove the drug entirely, they will probably put significant limitations or warnings on the drug. >> reporter: a study this year found in over weight people with diabetes or heart disease, meridia raised the risk of heart attack or stroke 16%. it is already banned in europe and earlier this year the drug's maker advised doctors not to prescribe the pills to

patients with cardiovascular disease. this doctor has advised the manufacturer. >> this is for those that have a significant amount of weight to lose. >> reporter: many believe it comes with too much risk. this month the new england journal of medicine wrote, it is difficult to discern a credible rational for keeping this on the market. >> most physicians would agree a 5-8-pound weight loss isn't worth any risk, much less significant risk of cardiovascular disease. >> reporter: the advisory committee could recommend it be pulled off the market or leave it and have stronger warnings added to the label. the fda will take the panel's recommendation into consideration when it makes a final decision in the coming weeks. cant is gibson, cbs news, los angeles. >> so within the last hour, half of the fda advise ors said it -- advisors said it should go off the market and the other half said it could stay with warnings. fda volumes the advice of an advisory panel but not always but in this case it is split.

lowered into the ground. the men have been trapped into sweltering conditions for more than 40 days. >> hard to imagine. turning to the disaster in the gulf and the clean-up that followed. the well that led to the largest oil spill in history, is expected to be permanently sealed and declared dead by sunday. that is the word from thad allen. the explosion killed 11 workers and led to 206 million gallons of oil spilling into the gulf of mexico. >> that's part of the chapter of that saga is over but we know the long-term implications will be around. >> you have some video of a hurricane with a monster name. it is a monster name. igor. this is a satellite picture from nasa. we like these pictures. this is a different view. the pictures we show you, our satellite is 22,000 miles in space and this is 400 miles in space and you can see the curvature of the earth and this

sky 9 was over a bulldozer that caught fire in anne arundel county this morning. the video shows firefighters pouring water on the flames.

the heavy equipment operator appeared to be clearing on the wildfire preserve. it's unclear what sparked the fire. investigators are searching for the cause of this giant apartment fire in houston. the flames broke out early this morning in a complex in southwest houston. several units were destroyed, forcing the families to find somewhere else to live. look at that from the sky. and again, unclear the cause of this one. new york city officials want to take their smoking ban outdoors. city council will consider a bill introduced today outlawing smoking in parks, marinas, boardwalks and even ped tran plazas, including times square. violators could be issued tickets by the parks department. a st. louis bathroom has been dubbed the best in the country. it has vintage features, hand painted murals and designer moorers. all of the things we look for.

right now, new at 5:30, the tee party on a roll. but some republicans are concerned last night's win in delaware could cost them a chance to control the u.s. senate. don't be a drop-out. that's what denzel washington came to washington to tell an important group of high school students. and a care giver facing charges after incidents of elderly abuse are caught on tape. it was a big victory for the tea party in the little state of delaware. christine o'donnell won

yesterday's republican senate primary against a moderate candidate supported by republican leaders. and as joel brown reports, both parties are saying her victory could be the key to who controls the senate in november. >> reporter: she's the tea party nominee who beat the odds to win the republican primary, but the question now is can she win in november? >> if those same people who fought against me worked just as hard for me, we will win. >> reporter: christine o'donnell beat out nine-term g.o.p. veteran castle in the delaware primary and did it despite republicans who mobilized against her. in the primary campaign top republicans called her unelectable. and now they have plenty of ammunition against her in november. >> and the residents of delaware nominated somebody who

volunteer fell through a plate glass window. you can see the young man amid the shattered glass. he was bleeding pretty badly but got into an ambulance under his own power. the loudoun county sheriff's office has released surveillance pictures of a armed robbery at a hair cutery. he walked in and asked the clerk for change and then he pulls out the knife and grabbed the money and ran. it is believed they also hit a restaurant earlier in the week. we'll have more at 6:00. a marker will be in place at the charlottesville bridge where harrington was last seen alive. she disappeared while attending a metalica concert in charlottesville. her remains were found three months later on a farm. no arrests have been made. award winning actor denzel

washington was in town today, not to promote a new movie, but a new program aimed at keeping kids in school. our delia gonsalves tells us how the boys and girl's club plan to reverse the high school drop-out rate. >> reporter: there is a buzz at this boys and girls club in southeast. >> i think it was pretty inspirational. >> reporter: they saw denzel washington at the national press club adding his star power to the new campaign, attacking the high school drop- out rate. only 69% of american teen-agers finish high school compared to the clubs 90% graduation rate. >> we need more programs like the boys and girls clubs during the hours when our children are out of school. we need for every american to do his or her part. >> reporter: washington said the club shaped him as a young man. >> he said young man, with the smarts you have, you can do anything you want to do. and it was a -- maybe a small thing to say, but i never forgot it. i'm 55 years old and i never

caught on tape, disturbing video of a trusted care giver abusing an elderly patient. these images may be hard to see. this is a 91-year-old who was violently shoved on a bed and smacked several times before a feeding tube was shoved into her mouth. the woman's daughter set up a hidden camera after noticing unexplained bruises on her mother. >> i was furious. i do not know what -- heartbreaking it is to see your own mother abused. >> police say they have over a month of the elderly woman's abuse on tape. the care-giver who was out on

bail in jersey city, new jersey, could face additional charges. some intense moments for a medical chopper struck by a large bird. it was a plaque vulture that crashed into the windshield in arizona. it landed in the lap of the pilot. he still managed to safely land the helicopter. no one was hurt but the bird was killed. rescuer received an odd call in oregon. a camel stuck in a sinkhole. firefighters had to shovel out mud to free it. the owners who have several camels and run a children's ministry had tried to get the animal out themselves and failed. not happy about this rescue effort but it appears the 1500- pound camel was unhurt after he got out of the sinkhole. we also have an update on a escaped spider monkey in texas known as wc fields. he was captured today near the prime air preserve where he made his break near san antonio. the remnants of tropical storm
