good evening on the in the only local news at 7:00, drying out. after more than 13 inches of rain, one maryland community is questioning whether they were allowed to return home too soon. trapped, investigators say they think a deadly fire in a dc apartment building was set intentionally and residents were then blocked from getting out. but first brazen burglary. even that nasty weather couldn't keep some bold bandit from breaking in to four virginia houses overnight. i'm surae chinn in fairfax county, where a serial burglar has struck again. this time preying on people in

annandale. >> i freaked out. >> reporter: the thief was long gone whennierry discovered her home broken in to. she's among two other neighbors who had the same thing happen overnight. earlier this week, jan became one of eight victims in oakton. >> oh my god, somebody's been in my house. somebody has walked around my house an looked around my house and gotten in to my property. >> reporter: she has gone to great lengths to secure her home. >> yet they walk in my house. i'm upstairs in my bedroom with my dogs and they walk right in my house. >> reporter: investigators say the majority of the cases, the thief got in through an unlocked door or window and in all residents residents have been home and sleeping. >> must be still think not to wake anyone. >> reporter: fire investigators say a possible dispute between neighbors may have sparked the blaze early wednesday morning. >> we have what we would call suspects or people of interest. >> reporter: fire chief dennis rubin says it looks like the

arsonist tried to block people from escaping the flames. >> there was a mattress that we found in the hallway that was pretty well burned out and we think that may have played in to this scenario. two days after the fire repair crews are here at the building, trying to make this building whole again. they are heading up to the fifth floor, repairing the doors and trying to clean out that floor. that's where the fire started. all of this in hopes that the families can return home. >> as soon as we walked in and i saw bloody footprints across the lobby area, i knew something upstairs was pretty bad. i'm scott broom in saint mary's county and this is the lange rilier trailer park. one of the many places recovering caused by 13 inches of rain but at this trailer park some people complain they were caught by surprise. >> they act like it was our fault that we come back to our own home. >> reporter: the complaint is the road to the trailer had been reopened late thursday

after an evacuation earlier in the day allowing residents to come back in only to be flooded out by the saint mary's river when the rain picked up again with a vengeance overnight. >> fire department went back at 3:00, 3:30 in the afternoon yesterday. there were two door to door weeps by local firefighters during the day on thursday to warn people. officials say the road to the trailer park was reopened, but that did not mean the voluntary recommendation to evacuate had been suspended. >> it is not a guarantee that those waters won't exceed the banks of that river later on in the day. the situation warrants. if we get more rain, like was predicted, it wasn't going to happen again. >> reporter: the water is getting higher on the potomac, as well. high enough the maryland natural resources police are urging folks not do what you see those folks doing not without a professional guide. the potomac is slated to crest at five feet. that is below flood stage but high enough to knock loose logs

and other debris. a lot of thrill seekers hope it will go even higher. >> you are looking for more energy and volume. >> oh, heck ya. >> reporter: you wanted it to be bigger. >> we did. >> reporter: well, the natural reourselves police say they are not closing the river. they are just urging you to use a pro until the water level comes down. that will happen october 4th. you think all of the rain over the last few days would make a difference in our dry conditions, apparently not, not enough to keep the u.s. department of agriculture from declaring a drought disaster in loudoun county. it is one covered by the drought declaration and means farmers and ranchers can apply for low interest merge loan emergency loans to cover their losses. nice and breezy out there. felt like fall, topper. >> it is great. the drought emergency thing is because the damage is done to those folks. we are out of the drought but they will collect money from the drought a couple of months ago which is a great thing.

out there on 495 north of town, especially on the inner loop from silver spring in to college park. tracking a lot of brake lights. no accidents but a lot of volume. be aware of that if you are heading out anytime soon. switch over the maps here. an accident to tell you about. this is 95 southbound in maryland. off ramp on to 175 an overturned tractor-trailer there. you want to take 32 to get around this. if you are heading northbound 95 at bw parkway to baltimore right now all lanes are open. and finally we will head out to 66 where we are seeing a little bit of traffic out here between 495 and 123. and roadwork was scheduled for earlier, 66 westbound and the dulles connector road is supposed to shut down tonight. it is now not happening tonight. it will be happening on saturday and monday instead. keep that in mind and watch out for detour and you should be okay. back to you. this week's rain caused a chewer alert. check this out. it is a sinkhole and it's right

mayor. the man who, was chief of staff for president obama's senate office, pete rouse will be the next white house chief of staff. an unusual funeral at arlington national cemetery today. first lieutenant travis manning was laid to rest again. that's after being exhumed from his grave in pennsylvania. you see he was killed in iraq in 2007 but last week his best friend, lieutenant brandon looney was killed in a helicopter crash in afghanistan. and the families wanted the troops to be buried side by side. >> we were talking about where brandon was going to be laid to rest, and amy was like, in arlington with travis and i said but travis is in doylestown, not arlington. >> he wanted to be with his brothers and now he's with his, one of his closest brothers in brandon, together, side by side. >> they had such a strong friendship and such a bond to each other that it just -- you

don't see that often. >> reporter: manning was initially laid to rest in a family plot in pennsylvania. it was only later his family learned he really wanted to be buried at arlington. manning and looney were roommates at the u.s. naval academy. a protest outside of the looney funeral on monday. those are the folks from kansas who have made a habit of protesting against gays outside of million funerals. well, today the u.s. supreme court announced it will hear arguments about one of those protests in the new term. the father of a maryland marine matthew snyder is suing the church over what he calls the exploitation of his son's funeral. turning to campaign 2010 in maryland. the candidates for governor say they will meet for a debate in two weeks. governor o'malley and his predecessor and challenger robert ehrlich will be at our sister station in baltimore on october 81th. then next thursday, governor o'malley gets high-powered help

drug back then, penicillin, was working. starting next fuse you will get more than a driver's license or registration at the dc department of motor vehicles. they are partnering with a nonprofit group to hiv tests for 15 bucks a the penn branch dmv in southeast. the family and medical counseling service is expecting 15% of customers to take advantage of the program and that would add up to 3,000 people. arlington county wants to opt out of a new system that will allow police around the country to check on people's immigration status. but as lindsey mastis learned it may not be so simple. >> reporter: it's called secure communities and links law enforcement databases with that of the fbi and the department of homeland security. it will allow immigration and customs enforcement to search fingerprints and identify people that are in the country illegally. >> this has been imposed. >> reporter: arlington county council member says it is something many people in

arlington are against. >> one of the most important things a stake here is the trust between our community, especially immigrant community and the police officers, law enforcement. >> reporter: the board passed a resolution asking to withdrawal from the program. he cites aer will written by department of homeland security director january janet napolitano. >> we have evidence there is an option to opt out. >> reporter: according to a source in the federal government, we learned local jurisdictions may only be able to opt out of a portion of the program. he says arlington doesn't want that. >> is there a process to opt out, yes or no. >> reporter: the definitive answer is hard to find. according to ice, fingerprints of people arrested would be searched but not that of victims calling in crimes. the entire country is scheduled to be linked in to the program
