the nobel prize foundation is giving out a prize for physics. it was just announced 15 minutes ago. two russian sign assist -- scientists are the winners. edwards won for his work develop invitro fertilization. the dc city council could take up a bill that will make it harder and more expensive to rid your house of unwanted critters. kristin fisher is live outside of the wilson building with the latest. >> reporter: i know some of you are sitting back saying why do we need a bill that will protect pesky critters but part of the bill is intended to help out and protect you, the homeowner, as well. now, what this bill would do is it would require animal control operators in the district to use humane methods when capturing and removing wildlife from your home. these operators could even kill the animals, provided they did it humanely. that's the bottom line. the bill is all about protecting the rights of this

wildlife. but it is also about protecting your rights, as well. this does not apply to mice and rats. it only applies to squirrels, raccoons, possums, animals that like to nest in homes and it doesn't apply to dc residents but only regulates companies. that sounds standard but one clause in the bill is causing the bulk of the controversy. it states a wildlife control officer should make every reasonable effort to preserve the animals family unit and not knowingly abandon dependent young inside of a structure. opponents say that is going too far but supporters say it makes sense. and here's why. >> if a mother raccoon or mother skunk or mother ground hog thinks an animal is still inside, they will keep trying to get inside no matter what. and that causes damage to a house, and so you may pay for something and not remove the young and then all of the damage is done again after you have paid for it. so it is important to solve the problem for the long term. >> reporter: the dc council

will vote on the first reading of the bill today. so far, it seems like the council will indeed pass it. jessica? >> kristin, how unusual is a measure like this one that is being considered? >> you know it is actually not all that uncommon. in fact, 30 states have already approved similar measures, including in virginia and in maryland. so it is actually not all that rare. although when you look at language like protecting family units of raccoons and possums it certainly may seem a little out of the ordinary. back to you. >> thank you so much. new this morning, fairfax county police investigate how a man was hurt at a metro station. the wounded man was found last night outside of the hurtington yellow line station. his injuries are not life- threatening. it is unclear exactly what happened and whether the man was stabbed, shot or something else happened. police may be at the station this morning looking for clues. answer autopsy shows the

driver of a charter bus suffered a deadly heart attack behind the wheel and that led to the crash along the i-270 spur. the driver died and several passengers were hurt. it made a mess of the rush hour. the bus was taking children and adults back to pennsylvania after a day of sight seeing in dc. residents of a southern maryland commune maybe receiving buy outoffers from the government. dramatic video shows why. part of the calvert cliff neighborhood falling in the chesapeake bay. one homeowner only has six feet left in his backyard. engineers declared his back deck unsafe. >> and then offer to the homeowners to purchase their property or buy easements on their property and relocate the home to a different lot that isn't right on the cliffs or perhaps move it further back. >> reporter: about 90 calvert

county residents known as the cliff dwellers have been begging solutions to their problem for years, but the tiger beatle complicated any proposal to stabilize the property. time for a "living $mart" report. maryland governor o'malley and congressman cummings both want a temporary stop to home foreclosures. the governor wants a 60-day moratorium across the state. bank of america and other lenders are halting foreclosures in two dozen states reviewing documents to make sure they were signed correctly. there could be federal and state investigations and could go beyond individual cases. >> it could be significant the court system takes a hard line and delays the foreclosure process significantly. it means house prices will be weaker for longer and so will our economy. >> reporter: it is unclear how many homeowners will be affected by this foreclosure

freeze. also this morning, a consumer alert. better business bureaus are warning about a rise in foreclosure scams. crooks are conning homeowners in the pros of losing their homes. the government accounting office names two scams. the first is so-called advance fee loan modification scheme. the crook charges you a fee to make a deal with a mortgage lender maybe a money-back guarantee. instead the scammer takes your money. another scam is a sales lease back scheme. the scammer convinces you to transfer your deed to them, offering to make your payments while you get your affairs in in order and then they say they will sell it back to you once your financial situation improves but instead they take out another loan or resell it without your knowledge. what can you do to avoid getting ripped off? look for these red flags, guarantees to stop the foreclosure process. instructions for you to not contact your lawyer our housing counselor. collect a fee before providing you with services or tells you

screen. >> have to keep them away. we want to remind everyone, 97-point wash fm my forecast can be heard there. and speaking of my forecast, let's get to it. the mom p.m. bus stop forecast a decent one. albeit a chilly one. it's dry, not raining an not that windy in most areas except for by the water. nationals winds are 15 miles an hour. a lot of areas are calm than allowed temperatures to drop to the low 40s. a few spots in the upper 30s. warm bus stop temperatures in the lower 50s. 7:08 on the sunrise. the day at a glance, partly sunny this morning and mostly cloudy midday through the afternoon with a stray shower possible. best chance of any rain showers will be in the mountains, northern western maryland, west viriginia higher elevations you won see as much sun this morning as we will. partly to mostly cloudy. lows in the 40s with a west wind at five.

6:45 on the sunset. and mostly cloudy and cool with a few showers. highs in the low 60s. best chance of showers on wednesday will be north and west of washington. south and east, you are likely to stay dry for a while now. low 60s tomorrow. west winds five to ten because nice warmup after that. there's the 39 from manassas right now. got got a 9 at the stafford regional airport. even though fredericksburg is 46. pax river 48. lower 40s across saint mary's county. orange is 43. winchester and martinsburg are 50 but 36 with fog in garrett county and oakland, maryland and 48 in gaithersburg. a nice, chilly start. national is 51. dew point 42. this is the difference at the airport. northwest women at 13. this is by far one of the strongest winds we have. right at annapolis and the bay bridge area. everybody else is five miles an hour or less on the winds. the storm sham brought us the showers yesterday morning.

it is way up here in new york state but the rain wrapping do you know through ohio and west virginia. this is the case. but tonight in to tomorrow it will start to move east. the rain that you see here will probably come across our northern sections on wednesday. right now we have the northernly flow behind the storm system. i expect winds north to west today as the system pulls to the north and east. you see the rains here by the evening. little bit in to western maryland, as well. overnight we see that start to pull out. could be wet flakes mixing in toward snow shoe. then tomorrow we watch some of the shower action north and west. doesn't look like a lot but partly to mostly cloudy again with the threat of showers. after that, things are looking up in a big way to finish out the week and especially for the weekend. the seven-day forecast, 62 today. breezy. tomorrow 62. couple of showers mainly north.

look at 95 and the bw parkway. no issues or construction out of baltimore past 32 down to the beltway. back to jess. we focus on campaign 2010. it appears republicans have more passion about this election than democrats. now check out a new poll this morning from gallup. it finds 50% of registered republicans are enthusiastic about voting next month and 38% of democrats feel that way and 29% of independents. election day is november 2nd. the passion maybe influencing the senate race in west virginia. what looked like an easy win for democrats is turning in to a tight race. the survey shows that john racey is leading joe mansion 48% to 46%. 4% remain undecided. the winner will finish the term of the late robert byrd. today christine o'donnell goes on the offensive.

more expensive but more humane. kristin fisher is live outside of the wilson building to explain. >> well, most of the bill is standard and straightforward but there is one section that is causing the big bulk of the controversy. and i want to read you exactly what that excerpt is. here it is, word for word. awildlife control a operator shall make every reasonable effort to preserve wildlife family units using humane eviction or displacement and reunion strategies. it then goes on to say that a wildlife control operator shall not knowingly abandon dependent young inside of a structure. opponent of the bill say it is ridiculous that why would you want to be concerned about preserving the family unit of say a raccoon or a squirrel but poeters say it actually makes sense. this provision isn't just intended to protect the wildlife but also intended to protect you, the homeowner, and

the theory is if you pay a company to remove a family of raccoons but the mother is separated from her babies the she -- she thinks the babies are inside the home and will do just about anything to get them back. they say it is about saving you money and solving the problem in the long run. the bill's sponsor says it is about protecting homeowners from wildlife control businesses that she calls inhumane. >> what we see with those businesses that are not responsible is they use traps that effectively torture animals, that nontargetted animals like pets sometimes get captured in them and when they kill animals thigh use horrific methods like beating them to death or drowning them. >> reporter: the bill does not apply to mice and rats but only to squirrels, raccoons, poses suchs. animals that like to nest inside of your home. the bill dunn apply to dc residents. it only regulates the company. that's an important

distinction. for those thinking the bill sounds ridiculous it is not that rare. 30 states have already passed similar measures including maryland and virginia. now the dc city council is expected to vote on a first reading of the bill today. so far it seems like it will pass. >> thank you, kristin. time for another "living $mart" report. mastercard and visa settling a lawsuit with the government. it claims the companies engaged in anticompetitive practices saying it stopped merchants from offering downs when it used other cards. american express hasn't settled and will fight the suit. toyota says it fixed 4 million recalled vehicles in the u.s. they were part of the safety recall. toyota recalled 1 a million vehicles world wide. when it comes to maryland -- millionaires, maryland is number two in the nation.

maryland is 6.79%. that's second only to hawaii. virginia is in seventh with 5.94%. dc ranks tenth with 5.53% of homes with over $1 million in the bank. avoid the section of l street southeast near the washington navy yard. that's according to a website that calls the area the ninth most dangerous neighborhood in america. we found residents scratching their heads. >> reporter: this is a service area in dc. quiet, well lit with neighborhood watches and friendly people passing by. all right street southeast feels safe. take it from a child. >> never felt like i was in danger. >> reporter: prizing that to everyone around here the l street block is named the most dangerous neighborhood in dc. >> i to be buy it. this is one of the safest areas you can be. it will be safe. you are right around the corner
