he will be the third person to receive the medal of honor for service in afghanistan. it is walk to school day nationwide. the goal is to have parents or children walk or ride bikes to school. they say it helps the environment and cuts down on obesity. also today a heated first amendment case before the supreme court. it involves protesters outside of the funerals of fallen u.s. troops. kristin fisher is live outside of the court with a preview. >> good morning, jessica. this is a case that will likely take several months for the u.s. supreme court to issue a ruling on, but the process all starts right here this morning. and the big question the justices will have to decide on is whether or not these protesters are protect -- protected by the constitution, first amy, freedom of speech or whether the military families win the right to privacy, the right to bury their loved ones in peace without these protesters shouting or singing

nearby. now, this is a case that started in maryland more than four years ago when members of the kansas-based west borough baptist church protested across the street from a funeral of a marine killed in iraq, lance corporal matthew snyder. these people believe that u.s. soldiers are being killed because god is punishing america for tolerating homosexuality. they carried picket signs at his funeral that read thank god for dead soldiers. his father says the protesters were clearly in the wrong. >> my son and hundreds of thousands of other men and women have died to protect freedom of speech. and to have a group of 80 people degrade it and mock it is disdust -- face gusting. to so al snyder sued the church for causing him extreme emotional distress and then a baltimore jury awarded him $5 million in damages, but an

appeals court later overturned the ruling, citing freedom of speech and now that case is right here at the highest court in the country. the u.s. supreme court and the opening arguments will begin at 10:00 today. >> kristin i at some funerals we have seen opponents of the church taking matters in to their own hands. what have they been doing? well, jessica, it is actually an incident that happened right here at arlington national cemetery this past monday. a group of motorcycles, some of them veterans themselves actually came right up in front of the protester and parked their bikes right in front of them and then as the funeral procession rolled past they literally drowned out the chanting and singing and all of the signs they were holding up by revving the engines of their motorcycles as loud as they could. people in the funeral procession, some of them gave

them thumbs up because the protesters were holding signs that again read thank god for dead soldiers and another one said thank god for ieds. the whole purpose was for these counter demonstrators to block out that noise. >> thank you, kristin. new this morning, talks reportedly underway to end the war in awful. the "washington post" reports the afghanistan government and taliban are in secret talks. the goal to end the nine year war there. the taliban rejected negotiations in the past but is considering joining the afghan government an allowing the withdrawals of u.s. and alternate troops. nearly two weeks after she was hit by a car a silver spring, maryland woman has died. she was struck by a car on september 25th as she was walking along carroll avenue. the driver took off. she died yesterday. they are still looking for the mid 1990s model pickup truck

that witnesses say hit her. a scaled down version of a on-line voting site is up this morning. you no longer get this when you try to submit a ballot ♪ [ music ] ♪ students at the university of michigan hacked in to the site. they got it to play the school's fight song when a vote was sent in. the site will let troops vote on-line. the city invited people to try to hack the site so problems could be found. >> this is exactly why we had this public examination period so we would discover these issues now. not when ballots are being transferred. >> reporter: the michigan hack wasn't the only test to dc's system. more than 50 comments have come in from site testers with problems, but none of them played fight songs. we have another "living $mart" report for you. the tarp bank bailout program is coming to a close and looks like it is way under budget.

two years ago the government approved the troubled asset relief program for banks. congress authorized $700 billion. well, now it looks like the price tag will be closer to $50 billion. >> i think that the taxpayers can get comfort from the fact that a program that was lit rally hated and is still very much disliked by the public for understandable reasons will be less costly than was feared. >> reporter: critics say tarp helped wall street more than main street and add banks may now expect bailouts every time there is trouble. congratulations, you might have a grade a credit score. credit scores aren't like a report card but the higher the score the more you can save. lenders and even your boss could use the scores to determine if you are financially responsible. a bad score can mean low rate and the worse-case scenario being declined for a new account.

the critter bill in the district. the city council tentatively approved the measure on tuesday. i toughens standards for animal and pest control companies. the most controversial part it requires exterminators to try to keep critter families together. a final vote is expected later this month. an emotional meeting in montgomery county where a laytonsville couple met the man who saved their lives. fedex driver earl spence was honored as an everyday hero. he spotted them on a road side this summer unconscious in a van. they don't remember the event because they have been overcome by gas fumes. >> didn't have an opportunity to thank him for saving our lives. >> emotional an trying to keep myself together because i wanted to look them in the face. i heard they were all right but it was a pleasure seeing them. >> reporter: police say that in all likelihood the couple would have died had he not stopped and called 911. it is 6:19.

it involves protests following at a funeral of a soldier. >> the supreme court justices will hear opening arguments in this case in just over three hours at 10:00 this morning. now, of course, no ruling is expected today. it is likely several months before the supreme court justices issue a ruling in this case. this started four years ago in maryland. take a look at the signs that started it all. some read "thank god for dead soldiers. " others read "thank god for ieds." these members of the kansas- based west borough baptist church protested at the funeral of lance corporal snyder. these people believe u.s. soldiers are being killed in places like afghanistan and iraq because god is punishing america for tolerating

homosexuality. snyder one gay but members of the west borough baptist church have been targeting the funerals of all soldiers, not just gay soldiers and for matthew's father, he says the protesters are cherry in the wrong. he sued the west borough baptist church for causing extreme distress and baltimore jury awarded him $5 million in damages but a supreme court overturned it citing freedom of speech. >> most speech will offend somebody and we have to protect that. we can't have rules that make speech illegal or subject to incredible penalties just because it offends people. >> reporter: that is kind of the line of defense that the west borough baptist church will be taking in the case. but snyders attorney doesn't think it is a free speech issue but it is a matter of whether an individual can sue for the infliction of emotional distress and for the invasion

this process [ applause ] >> reporter: in last night's meeting, gray called jobs and education reform his top priorities. the next town hall meeting is tomorrow at the saint columbus episcopal church at 421 4a lbormoro street in southwest. police in arlington are looking for would be shoplifter who made a daring escape. she was caught trying to steal shoes at ballston common mall and used mace or pepper spray as she was approached. seven people were treated for irritated eyes or skin. none of the injuries considered serious. the shoplifter got away. alexandria is promising to remedy an issue with parking meters. a sharp channel 9 viewer alerted us to the problem in old town. people putting nickels in the meter are losing money because they are not receiving credit for their change.

morning. >> good morning, jessica. >> reporter: now parents are available to drop the kids off or to get them to the bus, why promote walking to school? what's the value added? >> well, certainly even with a little bit smaller number of children walking to school it is very, very important for us to make sure we concentrate on any of the children that are walking to make sure they get there safely. >> absolutely. safety is a huge factor for folks. what are some of the things we can do, as drivers, and as parents, to ensure these little ones are getting to school safely, walking to school on the crowded roads we have here in the washington area? >> the first thing we can do is slow down. that's the most critical thing, jessica. an the second is where schools are located or during the school hours that children are walking, what's very important is that we look, listen and certainly slow down, as i said. >> reporter: obviously we'd love to give our kids the

latest toys. a lot of kids have ipods and head phones on. should we allow them to walk to school with this equipment on or tell them to take it off? >> it would be a great idea for us to encourage them not to have them on. as pedestrians these small children need to be aware of their surroundings. >> one of the things we have been hearing is the health benefits as well as the impact on the environment because we are driving a little less. what can we expect for the kids if they walk to school in terms of getting healthier. >> reporter: obviously the. >> obviously the exercise for walking to school for children or anyone is a great benefit and secondly with the emissions being reduced will certainly help the environment. so all of those things are extremely positive and we encourage everyone to walk as much as they can. >> reporter: we thank you for joining us, montgomery county fire chief richard bowers. thank you so much. >> thank you, jessica.
