and neighbors are always walking their dogs all the time. >> police are going over that lexus inch by inch. they are looking into whether or not this case is connected to other home break ins around the general area. fairfax county police, they have determined the man found shot outside the metro last week. and they had a self-inflicted found. discovered in the parking lot after a concerned family member contacted police. and police, they say that the 32-year-old shot himself and then drove to the parking lot. he was initially taken to the hospital with some very life- threatening injuries. the doctors say that he is getting better. an update on a hamburger restaurant drawing a lot of complains. the owner has agreed to close this evening. people working near the circle restaurant, they complained that it dumped smoke and fumes into their offices. and many flows, they say all the grilling makes them sick. and the superior court judge cited them today. ordering the restaurant to close their doors this evening.

investigators are still looking at the cause of the deadly fire in northern virginia. does the flames have reported it this morning on orchard street in the city of fairfax. found dead in his bed with the dog nearby. and they say that it took them some time to get them to the house because of all the piles and the trash and the empty beer can that litters the living room. neighbors try to alert the man inside the homes. they could not reach it. >> i knocked on the door here on the driveway side. and then they ran around the back, knocking on the windows in the back. and there just wasn't anything out there. >> a neighbor says that the man who died was a smoker. and the fires, they say that they could not find any smoke detectors in the house. the commuters, they really need to work out today. metro's escalators were not working until a lot of people, they just walk. and maybe they made a lot of walking. as if that is not enough. an independent audit found the serious problem with metro's escalators and the elevators. detailing problems that include

a failure to clean and adjust the escalator switches. water making their way into the machine rooms and the worked areas. mechanics that need more training and a shortage of the supervisors. riders say they just want the problem fixed. >> if there is something that they are putting up the prices on metro, i think that they should get these elevators fixed as soon as possible. >> we need the new ones here on maintenance. and a lot of escalators in that system. >> reporter: yeah, there are three escalators at the wheaton station. one of them are closed for rehab. another one is broken. and metro says that these escalators are the longest in the western hemisphere. while filming a transformers 3 is set to roll tonight. involving the film's bumblebee car and the dc police suv. no one seriously hurt. but it prompted police to take a look at their safety procedures when it comes to police vehicles, driving onto roads that have been closed for special purposes.

and that was the case yesterday. the crash remains under investigation. a popular bar near the university of maryland is now in the cross hairs of authorities who say it should be shut down in the wake of the stabbing involving several students last night. and the fite started inside the thirsty turtle on baltimore avenue, moving inside, where three underage fraternity members and another man were stabbed. a fifth man seen in this photo is being sought as a suspect. he is six feet two with a black mohawk haircut. >> a hearing with the county board of license commissioners might be set as early as the first week in november. the owner of the bar, they have not commented. >> there is something to cheer about in college park.

the university of maryland and the marching band, they won a big contest. they will get $25,000 for their performance of the hawaii 50 theme song. promoters held a national competition, and news of the victory, went pretty well over campus. the first of the trapped miners in chile could be freed in less than an hour. you're looking at now live, the rescue operations at the san jose mine in chile. and the 33 men, they have lived nearly half a mile below the ground for nearly two months. a test run involving the rescue capsule that went off without a hitch. engineers say that it will take more than 36 hours to rescue all the miners. once that operation finally begins. and family members, they are anxious. they are eagerly awaiting a reunion with their loved ones. when the first miner reaches the surface, you might just hear a roar of the applause down on massachusetts avenue. bruce leshan is live at the embassy where they are getting ready to party. and bruce, with good reason. >> reporter: yeah. with good reason. they are suppose to start at 6:30. but folks, they are already gathering. you can see them gathering with their chilean flag and the red, white, blue. are you excited? >> very excited. >> reporter: and folks on the side, they are gathering two
