you're look live at the rescue operations. the miners have been on the ground for nearly ten weeks. they say that they are actually much more relaxed than the rescue crews up on the surface. well tonight, there's a crowd gathering at the chilean embassy in northwest dc. watching the operations, hoping for success. brittany morehouse is with them. brittany? >> reporter: that's right. trapped half a mile underground for 69 days. it feels like a personal victory. i'm going to have them look forward and show you what they are watching. a huge screen with the pictures coming straight out of the rescue. you can see people here. just the emotion comparable. they are gathering their faces and they are very happy. basically what we have been seeing all night long. these men dressed in typical guards. they will actually do a dance after the first miners have seen where the ambassador will

speak here. doing a typical chilean host. they have also been passing out some stickers to people who are wearing on their clothing. when the stickers, they are bearing the symbol, the actual what was printed, when the miners were rescued. it continues to build through the night. we'll be here when we bring you much more at 11:00. >> all right, brittany morehouse, thank you for that. and by the way, we'll be monitoring that rescue operation throughout this program. now, we move onto tonight's other top story. another metro maintenance mishap. forcing some commuters to have to climb more than 200 feet. plus, student stabbing. a from the celebration gets way out of control from the heart of college park. and clues uncovered in the murder mystery, but the investigators have many more questions. >> i'm peggy fox in fairfax. where police, they are optimistic about catching a

killer. it could hold the clues that police have been looking for in a murder mystery. last week, they were found dead at his home in fairfax station. his wife found his body on thursday afternoon. hissed gold 2002 lexus, ls470 had been stolen. and today, an alerted police officer spotted the car parked miles away on americana drive, just off the beltway. police have confiscated the lexus and they are going over it inch by inch. >> they will be looking for anything out on the vehicle, either fingerprints, dna evidence, anything that will help us identify the suspect and lead that person to an arrest. >> i'm scott broom in college park. we're after a stabbing of three students last night. the university of police, they are vowing to push the county, to shut down the establishment for the fight that started.

>> in short, the thirsty turtle has become an attractive nuance. >> reporter: the business has suffered at least $1,000 in fines since 2008. >> i'm ready to padlock it tonight. but it's not my fault. >> i want the thirsty turtle to comply with the local and state laws. >> you need to make sure that they are in age. >> reporter: last night's intimate fight started acing among two men inside the bar. they were ejected. the fight moves on to the corner where at least one knife came out. three students, age 19 to 20 were injured as well as the 23- year-old man. and police, they are looking for a fifth person who ran. >> i'm lindsey mastis in the wheaton metro. the escalators are broken and the commuters are having to walk. >> you're getting a good workout. that was a long escalator. >> reporter: this isn't the only metro station affected. an independent audit found serious problems with metro's escalators and elevators. detailing problems that include failure to clean and adjust the switches. they are making their way into

the machine room and work areas. mechanics need more training and there is a shortage of supervisors. riders say they just want the problem fixed. >> they need to do better. this is uncalled for. i think they should get these fixed as soon as possible. >> only one is working. maintenance crews are hoping to get the other up and running by tonight or tomorrow morning. >> and we are looking live right now on the flip screen rather at the scene in chile, where those 33 trapped miners will be hoisted to the surface. and the rescue capsule you see right there, they will come up one by one. just keep in mind when we first began this ordeal that it was summertime, august, when we talked about back to school. now it's ten weeks later. talking about october. we're talking halloween. and those 33 miners have been underground all that time tonight. the first of them will see the light of day, we hope, or shall we say just the the surface. it will be nighttime by the

time they come up, showing you as it happens. meanwhile, obviously, they just got a bit longer by about 20 minutes to be exact. they are planning some major traffic changes, starting tonight, and it will go on for two years. they are giving us the good, the bad, the ugly, of the new construction. >> the sights and sounds of progress. >> this will be taking time and a part of the time, a little pain. >> drivers better enjoy the ramp while they've got it. starting tonight, this exit, 495 north off 123 will be shut down for the next 18 to 24 months. instead, drivers will have to merge over to these two far left lanes where they will hit a set of traffic lights at the green arrow. they will then loop back onto 495 north. the new pattern allows crews to work on the beltway hot lanes for the high occupancy vehicles. and starting wednesday, the

changes in the forecast when you're going to meet your coach and when you will need your umbrellas. and the sheriff deputy, allowing some serious trouble brewing there tonight. a grand jury, hitting them with charges of soliciting a bribe from a woman he pulled over, giving false information about the case to his supervisor. that deputy is the 27-year-old, jason warren. of west virginia. he is on leave with pay. turning now to fairfax county, where the police went door to door in the area of the road. they were notifying neighbors of the burglary and an attempted burglary. both taking place overnight. investigators are looking into the possibility that those two crimes, they are connected to a hole string of the burglars committed over the last few weeks. >> we are continuing to work with residence to keep the awarend tieing the situations. and again, to remind people to lock their doors, lock their windows, and stay vigilant. >> police are investigating more than 50 burglaries and

attempted burglaries. all that might be connected to the same group of thieves. investigators say all too often, those burglars enter through a door left unlocked. up next on 9news now. >> this is bruce johnson if many montgomery county. and the league died as they are lifting them as the democrat. what is that all about? i'll have that story coming up. two governors, two different approaches. even in good times bob ehrlich didn't make education a priority.

his body found in his dead, his dogs right nearby. firefighters believe that the fire could have been just smoldering all night long. neighbors say that they smelled smoke last night around 10:00 to twelve o'clock, but no one could find the source of that smell. this morning around 7:00, a woman driving by and a neighbor investigating the smoke, saw the house on fire. >> i knocked on the door here on the driver's side. and there wasn't anyone around. >> we have fire upon our arrivals, down to the basement, coming up through the first floor. and they went in and they head back, having problems due to things behind the door in the contents of the house. >> firefighters couldn't find any smoke detectors in the victim's house. >> it has grabbed some national headlines. they have disappeared more about five years ago. now, prosecutors are targeting their husband. they have charged him with killing her, but the case is a

bit unusual because the body has never been found. they headed off for the motley crew concert in dc and be not giver there. the only trace of her, finding surveillance video in her car. >> and there is even a murder committedded, much less to keep them with their client, who felt that murder. >> they were arrested late last year. prosecutors were hoping for a slam dunk. this driver was suppose to last only two weeks. well, don't ask, don't tell. don't buy it. the federal judge has issued a worldwide injunction. and that immediately stops the military from enforcing the don't ask don't tell policy. for the past 17 years, that rule has blocked openly gay men and women from serving in uniforms. they called the policy unconstitutional. now, the justice department, they have 60 days which to appeal. the obama administration says they are lifting that on the

deep water oil drilling in the gulf. imposed after the disasters for the bp oil spill. the administration has been under heavy pressure from the industry and others in that region to lift the ban on the grounds that they have cost jobs. well, it's not the adventure that the sky diver has planned on. after jumping out of the plane in massachusetts. he landed in a tree, more than seven stories up. the most powerful part of the sky dive might have been the last 70 feet. because he spent three hours dangling from a shoe harness that had snagged in the branches of those tall trees. >> two, you could even steer this. but he did not do what he was suppose to necessarily or he just didn't know what was going on and let the parachutes fly. and he put himself in the trees. they had to rig up the special ropes to get the rest of the way.
