going northbound near the falls road exit. and finally 95 in maryland we have construction to tell you about near 198 an should be clearing soon. it is an incredible story and right now the world is watching as 33 miners who have been trapped in a chilean mine for 69 days are rescued one by one. cheers erupt as the first man was pulled to safety last night. this is a live picture outside of the mine in chile. as each was pulled to safety they were met with hug and tears from loved ones awaiting their return. so far five men have been rescued in this life picture they are moving in to stage picture where those with more serious health issues are being raised. if all goes according to plan, all the miners should be freed by thursday. locally, later this morning, michelle rhee is expected to announce her resignation. her resignation is no surprise after she called mayor fenty's

defeat in the primary devastating for the city's school children. rhee is expected to leave at the end of the month. >> reporter: both respected an revealed, michelle rhee closed dozens of dc cools, fired principals and hundreds of teachers during her career. she boldly took on teachers unions and created a system of merit-based pay in which compensation was determined by improvement in test scores. >> it's a total shame she has kids in public schools and we really see the improvement. >> we like her as a school chancellor. we were hoping that her and vincent gray could have reached an agreement. >> reporter: rhee became a central figure in the dc mayoral primary, activity campaigning with fenty. and the rate became a referendum on her job overhauling the district's troubled school system. >> i think what she attempted to do was a little drastic to

helping to lift stocks around the world this morning, and we will have to wait and see if they are strong enough to power wall street higher, as well. csx corporate one of the largest railroad companies also beat estimates. the dow stands at 11020 after climbing ten points and the nasdaq up 85 and the s&p -- 15 points an the s&p up five points. gm is conducting independent reviews of its procedures in all 50 states. they hope the review will restore confidence in the foreclosure process. gmac and other lenders halted some foreclosures after coming under fire. it led state and federal officials to ramp up pressure on the industry. general motors is offering reemployees and retirees an opportunity to buy shares in

virginia north carolina border and to the west and area of low pressure. this is going to come together as we head to the day tomorrow and give us an excellent chance of rain starting on the. here's the future cast, high pressure coming on today. we will be protected through the day today. as we head in to tonight an tomorrow, the moisture starts to gather. big time to our west. by tomorrow morning, some lighter showers, heavier stuff in western maryland, west virginia. that overspreads the region through the day. by later in the afternoon and evening, low pressure forms near us and rain pennsylvania through the delmarva and we clear out and turn breezy on friday. that's going to keep temperatures down in the low 60s and even saturday looks like a breezy day. very crisp, autumnal feel it to. by the way, paula is also strengthening. now 100-mile an hour sustained winds. rain potential out of this, almost an inch here in washington. more than an inch northwest and half inch in the southern suburbs.

under current law, most vaccine lawsuits go to special vaccine courts set up 25 year ago but the family says it can't get justice for their daughter in those courts. they argue that special courts are needed because if drug companies could be sued under vaccines they would be unable to stay in business and as joel brown tells us it is up to the high court to decide. >> reporter: the parents of 18- year-old hanna brushwicz asked the supreme court let them sue a mayor drug company. they say it left their daughter with life-long injuries. >> for the rest of her life she will need care in order to live her life. >> reporter: when hanna was six months old, she was given a type of vaccine that's no longer sold. her parents say since then she suffered seizures and developmental problems. >> the disorder and disability she suffers from is incredibly

difficult. it's expensive and there's no treatment for it. >> reporter: this case has the justices looking closely at what are called vaccine courts. lawmakers created the special legal system 24 years ago. it's the only way for people to bring lawsuit against vaccine manufacturers. congress set it up as a way to care for people injured by vaccines and protect drug companies from most vaccine- related lawsuits. drug companies say they couldn't function without that protection. >> if manufacturers would be driven out of business today we will resee a resurgence of upfectious diseases we have almost forgotten about in our time. >> reporter: they worry this the supreme court goes forward it could open up the case of vaccines related to autism. but for this family the case is about one thing, forcing a drug company to make up for the damage they say it did to their daughter. joel brown, cbs news, the supreme court. >> the supreme court is not
