old ali mohammad of silver spring died outside of the dc 9 club in the u street corridor early this morning after an altercation with club personnel. >> the assaultswith predicated by the fact that he threw a rock through the window, broke the window of the establish and was pursued by employees of the establishment. >> reporter: william speeler and four other club employees have been arrested. >> a beating as a result of a property damage, someone has lost their life from a savage beating that appears to be vigilante justice. >> reporter: ali's family wants answers to his death. >> he didn't deserve to die. he was only 27 years old. >> what was the cause? ali is 27 years old, young boy. is killed. so i'm just trying, the media

and approach all and everything and try to assist to the truth. that is what i need. >> reporter: and of course one of the biggest concerns for this islamic family is when will they get the body back of their son. by custom that body must be buried within 48 hours after the death. back to you. >> armando, we are learning a lot about the case but what seems to be the cause of the possible changes in the charges? >> reporter: well, when this case first came to light, police called it a homicide, but in order for them to actually file second-degree murder charges, which is what they said they were going to do, the medicalle examiner must rule the cause of death as a homicide and at this point the medical examiner has not done that. and that is why the victim's body is there and why police were originally going to call a press conference later this afternoon but have not done so. we are waiting for police to come back and tell us exactly what the charges are and a lot

of that will have to do with exactly what the medical examiner rules to be the cause of death. but of course sometimes there are still murder charges filed, even though the cause of death maybe undetermined, but we are not sure at this moment. back to you. >> armando, we will wait for the other information. thank you. today another pedestrian was hit and killed by a car and if you are keeping count that is five pedestrian deaths in the last week alone. this morning a 38-year-old man was struck in the 17300 block of dumfries road. he was walking outside of the cross walk from a commuter lot between i-95 and route 1 in dumfries, virginia. that pedestrian was not only hit by a 99 dodge ram but struck a second time by a box truck. the 47-year-old driver of the dodge ram stayed at the scene of the accident, but the driver of the box truck took off. police say the driver of the box truck may not have known that he actually hit somebody and they are not considering this accident a hit and run.

two days after being rescued, one chilean miner is giving insight in to what life was like for the men who spent 69 days trapped underground. he was the 28th miner brought to the surface on wednesday and he spoke to the immediate where from his hospital bed. he said the worst moments came before they were able to establish contact with crews outside of the mine. >> i think the worst thing is to pass, three, four, five days without food. to know there might not be any future. >> reporter: all 33 men were rescued safely from that mine. three were released from the hospital yesterday. officials say ten more could head home later today. on monday, virginia's lawsuit against the health care overhaul bill will head to court. attorney general is arguing that the law is unconstitutional because it forces people to buy health insurance, and he says that is in violation of a state statute banning such a requirement.

today he talked to wtop radio an said his obligation is to defend virginia's law. >> we all know that when the federal law and a state law conflict, federal law trumps under the supremacy clods, except when the federal law is unconstitutional and we are defending the virginia statute. >> reporter: the federal government argues it can force people to buy health insurance by power granted to congress in the constitution. both the attorney general and government officials believe the final decision will come from the supreme court. we are now just 18 days away from election day, but starting next friday, if you live in maryland, you will be able to vote early for the first time ever in a general election. to get ready the montgomery county board of elections ran tests on the equipment they plan to use next week. so they test voted on computers and paper ballots to make sure machines are tabulating the votes correctly. if you want to take advantage

this day care in centreville had to face the nightmare. fairfax county police say their daughters were molested. minnieland private day school prides itself as being safe will have environments and according to police, four children have been sexually violated by the people paid to care for them. that the centreville day care, a man is charged with sodomizing 4 and 5-year-old girls. managers at the day care say he was on the job a few months and passed a criminal background and reference check. even underwent 16 hours of training all requirements by the state. >> they are not allowed to work until the criminal records check comes back. >> reporter: they issued dozens of violations at stafford lake including one in february where an inspector reported a staff member "instructed children to inappropriately touch each other."

that is this ran, high ryan murray who faces 25 years in prison after pleading guilty to giving two 6-year-old boys candy in exchange for a sexual act. the mother started to send her daughter to stafford lakes. she never knew. >> it surprises me they didn't let the parents know of the incident. >> right. >> and she just started coming here probably a month ago. >> what's been your experience so far? >> they are very nice. the director and all, very friendly, very nice. the teachers are good but that doesn't excuse the fact that nothing was said. >> reporter: that mother says she has to go home now and  consult seriously with her husband about the future of their day care at this company. company ceo issued a statement about the centreville incident

saying -- department of social services here virginia oversees all day cares in the state. we're told an investigation is underway here at the centreville facility. that investigation could result in fines, suspension or even complete closure of the facility as far as the stafford lakes facility, we're told that investigation is closed but they are under careful and close monitoring. >> thank you. it is tough enough when you send your child to day care because you feel like they are out of your care. what should parents do to make sure the day care they select is a safe one? >> well, outside of visiting that day care, very often checking with day care, doing research, trying to get references and talking to parents, asking questions. you could also go to the website. the department of social services, in fact, list all of the reports that they conduct

do you wear when you decide you want to break in to a museum? this oregon man may not get points for his style of dress but gives new meaning to the term blending in. he put on a large suit when he tried to break in to the rocks and minerals museum. he got caught when police bit in to the moss in the wood and the alleged burglar yelled ouch. homeowners are seeing infestations this fall but scam artists are seeing tune. bed bug and stink bugs are tough to wipe out and the problem can linger even longer if the wrong pest control company gets in your home. jessica doyle tells us more on how to exterminate the bug removal scams. >> reporter: bed bugs, stink bugs, recent infestations of these creepy crawlers are left some homeowners desperate to boot them for good and scam artists have noticed. when looking for help, keep these tips in mind, do research. an exterminator should have the proper training and

now nine sports with dave owens the best sports in town. can wins mask problems? yes, they can. true the redskins have figured out a way to win when it looked like they could should lose and 3-2 is the only record that matters but some would say they can't continue to play the way they have if they can win consistently. especially on offense and especially at quarterback where if you look at the numbers, donovan isn't looking too good.
