a liver transplant never got the chance because the hospital apparently couldn't reach her even though this woman was a patient at georgetown the entire time. >> hard to understand, but this is all according to her sister. that woman died a few weeks after never getting that transplant. she was a very sick lady. nobody knows if that new liver would have saved her but as peggy fox tells us, the woman's sister has filed a $5 million lawsuit hoping to force change. >> one year from the day she died. >> reporter: her sister donna roy died two years ago on thanksgiving day. she was 59. she had been on the transplant list at st. george's hospital. >> she was desperate for a liver. >> reporter: in november of 2008 a liver match was apparently found and a georgetown employee tried to reach donna at home. twice. >> this is martha calling from georgetown transplant.

i'm calling to offer you a liver. a liver offer. >> reporter: that would have been great news except donna didn't get it because she was a patient at georgetown at that time and dorothy found the messages on her sister's answering machine too late. i returned martha's call and she said someone else got the liver. >> reporter: dorothy said she spent every night at the hospital with her sister. >> it was unreal. she had been seen by a number of doctors at georgetown. the transplant team. everyone knew she was at georgetown. how did this happen that they called her at home? >> reporter: did georgetown have your number? >> i was her emergency point of contact. they had my home number and my cell number. >> they didn't call you? >> they did not. >> reporter: georgetown university hospital declined to comment on the case because it is in litigation. i did call the number that martha had on the answering

machine and it did go to the oncall coordinator for the transplant institute. dorothy hopes someone that needed the liver more than her sister got it but she is filing this lawsuit because she wants answer. >> i want to know why she did not get that liver. what happened to the liver? >> reporter: peggy fox, 9news now. the organ center uses a computer system to match organs to a list of several patients. a spokesperson says the patient isn't called unless they are at the top of the list and their physician okayed it. we do know donna roy was in fact called. a georgetown spokesperson says it is too early to comment on this case because they were just served that lawsuit yesterday. tonight, friends and family are remembering the first woman to lead one of america's 100 largest churches. thousands turned out for her funeral today.

a california college student was pulled under the water by a shark when he was on a boogie board. he lost his leg and they could not stop the burning. the beach is closed for the weekend. police say a california woman living out of her car was driving around with a passenger she had befriended at a park. the thing is her passenger was dead. she died months ago but the woman with the car had kept the corps right there with her in the passenger seat. she told police she was afraid to contact them. an autopsy does not show any signs of foul play. a tree trimming job in north carolina did not go as planned. the tree wasn't the only thing that came down. >> i was like there goes the chimney. there goes the house. >> the whole street, just
