shattered left leg, a broken knee and multiple contusions but says he is luckily to have survived the fatal crash that killed his 16-year-old cousin noel. when they released me from the hospital yesterday i wanted to see noel and tell him i was okay. that's when i learned he had died. it was horrible. noel's guardian tells 9 news now the boy suffered massive trauma to the head. >> the entire head is destroyed. >> reporter: this mercedes rear ended the two as they were riding their scooter from work. >> the big bang gave it away it was a serious accident. i immediately called 911. >> the good samaritan said she tried to comfort the injured teens. >> i'm not a doctor, but first thing that came to my mind is put on the side to avoid choking because he was completely covered in blood from his head. and then i told his cousin,

don't move. >> the driver of the mercedes turned himself in to police 12 hours after the crash. >> he was scared and didn't know what to do, or cold hearted. >> reporter: mario says moments before the accident his cousin was hugging him and telling him how happy he was to be in america. >> i guess god decided it was time to call him to heaven. >> reporter: and while noel's family continue to make funeral arrangements here in washington, montgomery county police are still wrapping up their investigation and that's why they say charges against the driver have not been filed. in northwest dc, armando trull, 9 news now. >> noel's family intends to send his remains back to honduras once funeral arrangements are in fact finalized. an american university professor has been found dead inside of her bethesda home. sue markham was a business professor at au. police say all signs point to a deadly home invasion. bruce johnson is live from the au campus tonight.

>> the 52-year-old had a full day planned, teaching classes, open office hours. as a matter of fact she had a 5:30 class which would be still going on right now. but that has been cancelled the dean of the business school sent an e-mail out this evening informing everyone that she had died. the 52-year-old sue anne markham had ban professor at au teaching accounting and taxation since 1999. >> a fantastic professor. on top of her -- on top of the students. making sure we did our work. >> everyone kind of looked around in bewilderment and someone was try -- crying in our class. >> her body was discovered by her boyfriend. police say a back window had been smashed. a struggle occurred on the lower level of the residence. >> it is juniorly a very safe place to be. we all lock our doors at night but generally we go to sleep feeling confident this is a

report of a strange odor on campus. police found chemicals in the dorm room they say were the makings of a drug lab producing dmt, a hallucinogenic drug. charges were dropped against john romano. >> the heart goes out to the families who won't be as fortunate to go home tonight. >> the men are back on court on wednesday. they are charged with conspiracy to manufacture drugs and possession with intent to distribute. both of those are felonies. it is day one in the chandra levy murder trial and they admitted that police badly botched the investigation nearly a decade ago of the young intern's disappearance and say they are left with a circumstantial case but they say all the circumstances point to ingmar guandique, not the congressman levy was having an affair with. bruce leshan was in the courtroom and is live at the courthouse. >> the prosecutors pointed

right at ingmar guandique and said his was the face in the shadows. his was the last face that chandra levy saw after she went jogging in rock creek park on a beautiful spring day in may of 2001. close the chapter the u.s. attorney said, find him guilty. >> are you okay? >> i'm all right. >> reporter: susan levy is back in dc hoping for justice for her daughter chandra. prosecutors say that ingmar guandique had a pattern of attacking women in the park and they put on the stand two other women with remarkably summit stories, except prosecutors say they survived to i.d. their attacker. one woman was in tears as she described how ingmar guandique grabbed her from behind as she was jogging in the park and that he choked her. that she fought him off by digging her fingernails in to the soft tissue below his tongue but chandra levy may not have been so lucky. the year her body lay out in the woods, washed away almost

all the forensic evidence they cannot say for sure how she died. >> it is case that lacks evidence rather than the case that has evidence. that's why the government needed to go to all sorts of prisons throughout the country and rip out gang members and see what they can testify to. on the other han, jurors love to put circumstantial cases together. i think they are as powerful as direct evidence cases. >> reporter: ingmar guandique's lawyers say that the police investigation failed right from the start. they failed to even go out and look at other sex offenders who happened to be in rock creek park at the time. they poisoned the well, and everything that flowed from it. and they said when you set aside the emotion and the heart break, you will see that the government has no case. >> reporter: anita? >> thank you. wasn't someone else's dna found on chandra levy's when this went down? >> we don't know whose.

republicans a five point lead over democrats. it is a 14-point edge among unhappy independents that is giving the gop the advantage. time for another check on the evening rush hour as it moves along on a monday. richard is here with time saver traffic. richard? >> good evening. not a bad monday evening to end the rush hour. a few spots that are slow here and there. one new wave oven them northbound on 270 from the beltway to past montgomery village avenue. occasional brake lights there. in virginia, as you are driving outbound 395, the slow spot from king to duke street and then speeds pick up beyond that point as you access southbound 95. below the beltway, a bit of slowing, off and on from newington going past the occoquan bridge in to quantico but speeds are picking up there and no problems reported at the third street tunnel or eastbound 50 moving to annapolis. >> thank you. now a family's dream washed

away. a house lost its battle with mother nature. it was teetering on the edge of what is called wash away beach in washington state and that's exactly what happened. look at that. it was washed away. the owners say it felt like losing a loved one. it is the fastest eroding area on the pacific southeast coast and has been losing 100 feet a year for a century now. great views but not much holding up the houses anymore. >> they had a big storm that may have been the tipping point for that. we had clouds and temperatures in the mid-70s. pretty good deal. another nice weekend. >> i don't know if we can deliver another one. it stays warm tomorrow and wednesday. in fact 76 tomorrow. almost 80 on wednesday. now, some showers are possible tomorrow. the best chance will be on tuesday night in to wednesday morning. and even in to early wednesday afternoon. and then we get cooler but still comfortable. temperatures around 70 on

thursday. it is breezy to windy through thursday. here's the tuesday planner. 60 to start. 72 by lunch. 75 by evening. we have a drop in the time period, but again nothing really heavy. i think we will have a dry commute in the morning. so leave your coat at home if you want to bring something, bring your umbrella. 72 downtown. 72 gaithersburg. these are warm temperatures for this time of the year. 76 fredericksburg. even 68 in cumberland. 71 in hagerstown and winchester. look at the winds. this is what is keeping us warm. strong southerly westerly wind, 23-mile an hour gusts at national and 2 1 at hagerstown. they are not going to go away. for tonight, mostly cloudy and breezy and mild. a chance of a shower in. 55 to 60. and winds southwesterly at 10 to 20 with higher gusts. look at the lows, almost like an early summer evening. 60 downtown. 57 college park and bowie. nerve the mid to upper 50s. 57 fairfax and reston.

55 leesburg and middleburg and 55 in manassas. for tuesday morning, variable cloudiness, breezy and mild. a shower is possible. 50s and 60s. winds southwest 10 to 15. by afternoon, winds pick up a little bit. variable cloudiness, windy and warm. a shower and maybe a thunderstorm is possible. highs of 75. winds southwesterly at 10 to 20 and rather gusty. here's the deal, cold front is on the way. windy and warm through wednesday. a few showers tomorrow, not really the main event though. big thunderstorms are possible on tuesday night. eneven strong storms in to wednesday morning. that's the point where the cold front is pushing through the metro area and the point we are most concerned about. the storm itself is back in the plain states. this is the cold front that is west of kansas city. it will move quickly through chicago tomorrow and approaching the metro area tomorrow night and wednesday. until it goes through, we will stay very warm. tonight, we have showers and thunderstorms to the south of us. thousand and thunderstorms to the north of us. a light chance of a sprinkle in between.

bears quarterback jay cutler said today he's not afraid of hall and that if he ever had the chance again he would throw in hall's direction another four times without hesitation. which makes him either very brave or very dumb. because it was the redskins hall who died the nfl record yesterday, intercepting cutler four times including this 92- yard pick in the third quarter and for hall, who's been at odds with the redskins coaching staff at times this year, yesterday was an affirmation that he is worth the hassle. >> watching jay cutler all week, we knew we would get some opportunities. didn't think they were going to come in bunches like that but we will take them. >> they challenge them during the game and sometimes a corner doesn't get those opportunities but when you do you have to take advantage and i think he did that. he took advantage of opportunities. >> reporter: it wasn't just hall that experienced redemption yesterday. haynesworth was given the freedom to hunt the quarterback
