abiding people around the world. in falls church, andrea mccarren, 9news now. d.c. police say a man who lost his life after a fight outside a mcdonald's may have been the one who started that fight. 33-year-old pat casey died after four days in a coma. police say the afghanistan war vet was disturbing customers at the mcdonald's and even blocked people from leaving. they believe he may have been drinking. >> the initial push came from, we believe it was mr. casey. it may have been someone that was with him. we are ironing that out. but that was the initial push that put a subject down on the ground. >> now captain michael says someone from that group pushed or punched back. casey fell, hit his head, he suffered a severe brain injury and he died on tuesday. his parents told a far different story. an unusual sentence was handed down in a montgomery county hate crime case today.

it is not the prison time that got our attention. everybody on this case expected the suspect, steven armstrong would be sent to prison. but as scott broom tells us, nobody expected the judge to ban him from returning to his own home once he gets out. >> i'm scott broom in wheaten where a neighbor was sent away to prison today for committing hate crimes against his hispanic neighbors and told by the judge once he gets out of prison, he will not be allowed to live in the neighborhood again. steven armstrong conducted a personal campaign of hate and intimidation against latinos in his wheaten neighborhood by targeting vehicles for nearly 100 mysterious late night tire slashings over at least two years. >> i'm afraid for my life. >> and now it's unlikely armstrong will ever return here. he was banned by judge robert greenburgh from coming home during the three years of probation he'll serve after getting out of prison. armstrong was sentenced to year behind bars.

addicted to our phones. when you are driving in maryland, you better put the phone down. starting tomorrow, october 1, it will be illegal to read a text or e-mail while you are driving in maryland. that ban was passed in '09, but a loophole that allowed you to read a text. the new tougher law is also a primary offense. that means officers do not need another reason to pull you over. >> a police officer can pull you over and fine you. the fine of $70 for the first offense. if you are convicted, that's a point on your driver's license. >> another law that takes effect tomorrow, stiffens the penalty for any driver whose negligence leads to a deadly accident. well, we were hoping for sunshine, but it is not going to work out that way for the weekend. topper, topper, topper, what do we look like for tonight? >> we have a nice friday night. nice for high school football, too. look at the temperatures. it's not turning cold just yet, yes, it's 45 in oakland.

a remarkable story of survival in southern california. david spent six days trapped in a ravine after his car plunged some 200 feet off a mountain road. he is 67 years old and managed to stay alive on creek water and whatever else he could find to eat. that includes grass, ants, even bumblebees. it was his kids who found him yesterday. when they didn't hear from their dad, they started to search on their own. >> we stopped at every ravine and looked over every hill and then my brother got out of the car and we kept screaming and the next thing we heard dad say, help. help. >> very, very emotional time. now he had broken his arm, dislocated his shoulder. he has multiple fractures in his back and ribs, but he is

still alive. his vehicle landed near another car that had gone off the same road and that driver was not so lucky. he didn't survive. a new jersey police chief may be spending a few nights on the couch. he gave his wife a ticket. lodi police chief ordered an officer to ticket his wife after she had double parked while dropping off their five- year-old son at school. he did not want her to get any special treatment just because she's his wife. >> it's the right thing to do. she's not above the law. nor am i or my family and he issued the summons and brought it to me later on that morning and i went to the court and paid it. >> dude, you're rough. not the first time his wife had been ticketed. the chief ordered another officer to ticket her two years ago after she forgot to move their vehicle for street cleaning. the bank of america getting hammered in the court of public opinion over plans to charge a $5 monthly fee for the use of their debit cards to make

purchases. b of a stock, which was trading at $6 fell further as enraged customers accused the bank of gouging them and promised to that i can their business elsewhere. one fox news anchor went so far as to cut up her debit card on the air. not being a b of a customer, i have no need to go that far. i have some questions for terri green. he's a branch manager. he's also president of the national lenders alliance. terri, glad to see you. >> glad it see you, derek. >> first of all, is this a move by a desperate bank down on its luck or something we are all going to be dealing with? >> this isn't a desperate move. the government has taken away their ability to collect a merchant fee. they are trying to replace that lost profit. >> they can collect some merchant fee, just not as much. >> debit card, they are not collecting any fee now. just from credit cards. >> $5 a month is not a lot of money. it is $60 a year. most people could afford that.

the principle of the thing, when people blame banks for our economic trouble, taxpayers help bail them out. some of the same taxpayers are being fore closed on. they think it's too much. >> well, they do. but it's a good thing. the way i see it, i have been preaching for years for people to cut up their debit cards. your credit card is the one you want to use. >> your debit card does not get you in debt. >> that's part of the reason why it is not the right card. it's four really good things you get with a credit card. you get to help your debit score. debit cards do nothing for your credit score. your score starts to rise so you can get better rates on everything. >> that's the problem. most people don't charge it and pay it off. they charge it and begin to build up debt. >> i think it's time for people to grow up and learn how to face their responsibilities and pay that debt. that's what it is all about. you need to establish a good credit score. >> the the end of the day, we

are going to be paying extra fees. let me ask you this question. it used to be the bank and you had a deal. they paid you interest. they made more interest by loaning it out or whatever. you wrote some checks, got a credit card or something. that was the deal we had. what's wrong with that? why is that no longer a viable business? >> good question. because the banks have lost their ability to make money on the money. the government regulations are limiting what they can do, so they are losing revenue. they have to pick it back up. >> you keep blaming the government regulations. a lot of folks are saying the banks are getting involved in more and more risky things. the profit is the only goal when they could do safer things, still make some money, and not charge us so much. >> well, that's true. and with the regulations, it has helped because now the loans they do are good. the new loans are all safe. banks aren't lending out money that is going to get foreclosed on right away anymore. that's good. they are doing smart things, but they need to pick up the lost revenue. >> they have to survive. >> so, when you look at the

wet field. a little bit of anne arundel county. temperatures are still mild. cold air is not here yet. it's coming. not here yet. 65 in rockville. 64 also in arlington. and 63 in great falls. 64 in reston. and 68 in college park. okay, here's the deal. more like november than october this weekend. tonight breezy and turning colder. wet and chilly tomorrow. the first flakes will fall in the mountains tomorrow late and tomorrow night into sunday morning. that's west of the divide. and chilly, but not as wet on sunday. so some good news for sunday. here's a look at the future cast. by 2:15, it's just cloudy in the metro area. but we see some showers begin to build back to the west. in martinsburg and winchester. put this into motion by 8:00 in the morning, here comes some showers. not enough, i don't think, to cancel the little league game. enough to make it miserable. take your umbrella and sweatshirt and notice this. this is pink and blue.
