with other users who contacted reporter, scott broom today. scott has been following up with metro to get some answers. >> rory doyle's ride to nowhere happens all the time according to advocates for disabled people who ride metro access. but metro says it has the data to prove that they are all wrong. 21-year-old rory doyle functions at the level of a seven-year-old and uses metro access to get to the programs that help him. >> through a gps tracker. >> doyle was taken on a four hour ride to nowhere while his father followed tracking software on rory's phone. >> i was becoming concerned he was being abducted. >> advocate said it happens all the time to him. >> it's about one out of six coming home in the evening from montgomery county is what we call the grand tour. >> the dispatching software used by contractors. >> they are not judged by how long they have you, just if they pick you up on time. >> metro says spray has it

wrong. dan provided data showing 98.81% of the time, metro access rides take the same time as the equivalent bus or rail trip. none of this excuses what happened to rory doyle, which metro has apologized for and is investigating. according to metro, dispatchers may have kept doyle on board in the cab while the driver picked up and delivered another client because they believed no one was home at rory's house. which was not the case. scott broom, 9news now. advocates promise to challenge metro's numbers at an upcoming series of town meetings. right now, hundreds of protesters are taking to the streets of manhattan once again denouncing the dismal state of our economy. today, a thousand college students and union members joined the people who have been marching near wall street for weeks. and now, a similar protest is being called for right here in d.c. tomorrow.

our bruce leshan went to mcpherson square where a small group has been camping out for days. >> needs to control by the corporations. >> protesters shouted nationwide plea for college students to march out of class and join them. >> we need as many like minded individuals as possible. >> on dc area campuses, few people heard the call, but many felt the fear. few jobs and crushing debt. >> i came from meeting with my advisers and the job market is really tight. the occupied wall street rallies aimed to turn people's fear into power. to demand jobs, mortgage relief, taxes on the rich. and more organized liberal groups now aimed to harness that anger and fear just as the tea party mobilized anger on the right. >> i'm not working. i can't do what i want to do

for my family. i got 14 grandchildren. and they need me. >> people are looking at the young people on wall street. why is wall street sitting like lobbyists in d.c.? to take over democracy. >> and that was bruce leshan reporting. meanwhile, the protesters outside wall street, not so much impact inside today. the dow closing up 131 points. the nasdaq up almost 56 and s & p 500 finished 20 points higher. >> adp did provide good news on the economic front. private companies increased their hiring last month. but another new survey also shows an increase in the number of people layed off last month. 116,000. that's up 126% from august. as danielle nottingham reports, that has congress scrambling on the president's jobs bill.

>> top democrats on capitol hill are proposing a fresh way to pay for president obama's $447 billion jobs plan. >> we're going to move the richest of the rich, pay a little bit more. >> democrats are calling for a new 5% tax on people making more than a million dollars a year. the president wanted tax hikes on corporations and to limit tax deductions for individuals pulling in more than $200,000 a year along with couples making more than $250,000. those proposals did not sit well with several party members. senate majority leader, harry reid, is hoping the change will win more votes. >> we'll get most all the democrats. >> but senate republicans want to vote on the president's plan now. they don't support it. they just want to call attention to the members of the president's own party who aren't on board yet. >> even democrats know it's a nonstarter, which is why so

many of them don't want to vote for it. >> over in the republican controlled house, leaders say there are parts of the bill both parties can agree on. danielle nottingham, cbs news, washington. and a footnote, the president is planning a bus tour through north carolina and the state of virginia the weekend of october 17 to stump for his plan. the district's department of transportation wants to add the name, national mall, to the name of the smithsonian metro station. it's one of four station names the city wants metro to alter. ddot formerly requested that waterfront, seu station. they want the word ballpark to be added to the new york army station, and be shortened to new york avenue. no word on when metro may respond on the changes. the fate of the grandmother charged with murdering her own granddaughter now is in the hands of the jury. closing arguments just wrapped up a short while ago and peggy fox is live from the fairfax county courthouse with the

latest on how the trial finally came to an end. peggy. >> reporter: well carmella dela rosa is severely depressed. >> her actions were unthinkable. a grandmother throwing her little granddaughter off a 45- foot high bridge. but did carmela delaa rosa do it because she was in a psychotic state and didn't understand what she was doing? moments ago, her defense attorney said we live in a world where people are deflected with mental illness. she was afflicted. she has always been thoughtful, loving, and giving by nature to her family. will the jury believe that explanation or the commonwealth attorney who said she was basically angry at the world. i told you we were going to look into the darkest part of the mind and we did. she cuts off the problem and in this case, she threw the problem off the bridge.

the prosecution's rebuttal witness, dr. stanton said there is no evidence she wasn't connected to reality. my opinion is, she was able to appreciate the consequences of her actions. when she threw the grandchild over the railing, she knew it was wrong. she knew right from wrong. he diagnosed dela rosa with border line personality disorder. he said she simply did not get along with family members. she was a woman who wanted things on her terms and when things did not go her way, she was angry. life was not going the way she wanted it to go. >> the jury is expected to deliberate another hour and then go home and reconvene at 9:00 tomorrow. when will there be a decision? that's anyone's guess. reporting live at the chows, peggy fox, 9news now. >> thanks peggy. coming up later tonight at 9news now at 7:00, you can find out how the kind of mistake that you might make that might really irritate you actually

national airport honoring its name sake. this morning, the washington airport authority announced that new statue of ronald reagan will be on permanent display. it's going to be outside the airport's terminal a. planning and design cost $445,000. the transportation department says the government's plan to modernize our air traffic control system has run into some serious problems. and those problems threaten to delay the upgrade and make it more pricey. the faa plans to replace the current system with one based on satellite technology. but some software problems have delayed full deployment of a critical flight tracking system. >> we are all plugged in these days, be it on our computers, at home, or at work. despite the warnings of dangers of taking that technology with you behind the wheel, some people still seem unwilling to just hang up and drive. a new survey by the aaa foundation for traffic safety found 95% of the people said they know it's dangerous to

text or e-mail while they're on the road, but 35% say they do it anyway. seeing an armadillo on the side of the road could be a bit distracting. why it may not be as farfetched as that sounds. we'll be right back.

>> moby is tracking an alert system made for real estate agents. it has a check in tool and send out gps cured coordinates in an emergency. today was the fall harvest at the white house garden. first lady, michelle obama invited kids to help bring in the bounty. this is the third year she invited students in to help with the harvest. while local farmers are thinking fall harvest, some californians are thinking skis. video from a resort near lake tahoe where autumn seemed to be skipped. 4- inches of snow fell last night. the resorts aren't expected to open until closer to thanksgiving. >> a change in our climate could bring invasion of armadillos. the website reports biologists have seen the animals migrate north. they say if this trend continues, we could soon see the scaly creatures in d.c.,

still nothing to complain about. let's break it down. 46 to 54 tomorrow. in the morning, 60s by noon. and then 65 to 70 by evening. you'll need a light jacket and shades for the remainder of the day. now the next three days, milder on friday. sunshine, 72. and then sunshine on saturday. we're going to be close to 80 degrees by saturday. next seven days. we don't make 80 on saturday. we will on sunday. 82. and we probably will again on monday, columbus day, low 80s. around 80 on tuesday. and well, maybe some thunderstorms on wednesday as the cold front approaches. temperatures in the mid 70s. we had ours last weekend. >> that's right. >> the caps? >> saturday is the season opener. the question is, what can he and these guys put together? the regular season has been fun, we would like the playoffs to be equal fun. is this year the cup year? the caps make their final

launching one of the great nhl careers of this generation. no doubt a stanley cup would soon follow. six years later, it hasn't followed. the caps have been good for sure, winning their division multiple times and president's trophy for the best record in the regular season, but when it comes to the playoffs, like the fans at dodgers stadium, they exit early. this saturday, they'll start season 7 and the cup is on everyone's mind. >> i think that guys know that, you know the window to win a stanley cup is short and we have a great chance. >> we want to see how good we are. we want to get this thing going as soon as we can. get the hockey games going. >> redskins are off for the bye week, but you can't go a day without -- the nfc defense player of the week. he had 2 1/2 sacks and five sack les five tackles against the rams.
