a few weeks ago. >> a male in the street suffered from a gun shot wound. >> a murder that we're now learning probably could have been avoided. >> the timing really probably couldn't be any worse. >> it happened back on september 19, just before 9:00 at night. that's when walker allegedly shot and killed a man here in capital heights over some type of argument. >> we believe some type of dispute between the two led to the actual murder. >> here's where the story becomes especially troubling. two hours before the murder, prince georges county sheriff deputies served walker with an order of protection at his home here in capital heights. after one of his neighbors complained he felt threatened by walker. there was a warrant out in connection with a second-degree assault. deputies did not arrest him for assault when they served him the order of protection. >> cornell darren palmers with the sheriff's department, he says the case is under

family in danger. an investigation by the montgomery county office of consumer protection found that contractors violated county law in more than a thousand homes. delia with the advisory for homeowners in prince georges and montgomery counties. >> i might as well leave a loaded shotgun down here in the basement. >> frank of silver spring had a subcontractor install this water heater early last month and he instantly knew it was a dangerous install with a flexible connector that leaves this pipe completely unstable. >> this is a perfect place for a little kid to sneak in. they can go or can't go. so all you have to do is pull on that pipe and you open up a gas leak. >> this must be secured. >> it took minutes for washington suburban chief inspector to find at least five dangerous violations that could have sent silent killer carbon monoxide into the home. >> need to get a permit from

wssc. they need to be licensed and after the installation, they have five business days to arrange for a wsoc inspection of that installation. >> and this house explosion in kensington is what could happen. though this homeowner here made the dangerous mistake of installing a gas dryer himself. >> we have consumers paying for a permit. they are losing money and potentially in harm's way. >> and this is the absolute worse case scenario. i am standing in the basement of what used to be that home in kensington. this is all that is left after that gas explosion in may. if you have any concern about your recent installation, you should call wssc immediately. in kensington, 9news now. a spokesperson from sears say they are working with investigators. >> no more repelling down the

washington monument. this morning the engineers finished up their inspection of the outside of the monument looking for any exterior damage that might have been caused by that earthquake back in august. those engineers did come across a number of cracks and loose stones, but they say the monument remains structurally sound. you have heard of people defending their homes with any number of variety of weapons, but what about a musical instrument? that is what happened this past weekend in manassas. shaun is being hailed as a guitar hero after he fought off a drunk home invader with his guitar. why a guitar? >> that's the first thing i picked up because it was next to my chair. i pushed him out the door with it. >> i thought it was funny. i was mad, but i thought it was funny. >> i think the bat might have worked better, but john mayhew was arrested and taken to the hospital. now he is charged with unlawful entry, public intoxication, and assault on a law enforcement

officer after he spit on a manassas city police officer at that hospital. was she a loving grandmother beset by a terrible mental illness or a cold- blooded murder filled with rage? the jury is now trying to answer that question in the trial of the grandmother charged with throwing her grandchild off a tyson's corner sky bridge. carmella carmela delaa rosa -- caused psychosis and she didn't know what she was doing. several psychologists said it can happen, but the prosecution psychologist argued she knew exactly what she was doing and knew right from wrong. the jury will reconvene at 9:00 tomorrow morning. now to the trial of conrad murray, that's the doctor accused of killing michael jackson. today, prosecutors once again played for the jury an audio clip of jackson speaking, sounding very slurred, recorded just weeks before he died.

>> i love them because i didn't have a chance. >> prosecutors are trying to show a pattern of jackson being over medicated by murray. the doctor is guilty of involuntary manslaughter for overloading jackson's body with the powerful anesthetic. it was jackson himself who administered the drugs that killed him. a civil rights leader who was hailed by dr. martin luther king, jr., for his courage and energy has passed on. fred was a target of a bombing attack and beatings and was repeatedly arrested during the fight for civil rights. he was also the cofounder for the southern christian leadership conference. he died this morning in birmingham, alabama, he was 89. just ahead, rage against

this sixth grader in omaha, nebraska, banned from wearing the religious beads because gang members have taken to wearing them. today, pete from maryland writes that common sense must have been banned as well. i can agree with things deemed offensive or not in good taste, but a rosary? even if gangs are wearing them, do we condemn the catholic society? if gangs started wearing business suits, would we ban all from wearing business suits? i think not. whoever came up with that ban should give it a second thought. but we get a different take from mckale in hagerstown. i think it's a woman who says she is a roman catholic. the girl should certainly be prohibited from wearing a rosary as a necklace to school, but forbidden for all the wrong reasons. a rosary is a sacred and religious article of prayer. it is not an article of clothing or jewelry. catholics all around the world would be offended by the wearing of a rosary as a necklace or crucifixion of

today. and scott has been following up with metro trying to get some answers. >> rory doyle's ride to nowhere happens all the time according to advocates for disabled people who ride metro access. but metro says it has the data to prove that they are all wrong. 21-year-old rory doyle functions at the level of a seven-year-old and uses metro access to get to the programs that help him. >> through a gps tracker. >> on september 22, doyle was taken on a four hour ride to nowhere while his father followed tracking software on rory's phone. >> i became concerned. >> sounded very familiar. >> today, pat spray said it happens all the time to him. >> it is about one out of six coming home in the evening from montgomery county is what we call the ground tour. >> the dispatching software used by metro access and contractors. >> they are not judged by how long they have you on the van. >> metro says spray has it

wrong. spokesman dan provided data from march of this year showing that 98.81% of the time metro access rides take the same time as the equivalent bus or rail trip for an able body person. none of this excuses what happened to rory doyle, which metro has apologized for and is investigating. according to metro, dispatchers may have kept doyle on board in the cab while the driver picked up and delivered another client because they believed no one was home at rory's house. which was not the case. scott broom, 9news now. >> and par transit advocates will challenge metro's number. the movement known as occupy wall street is rolling full steam ahead. you know it just started with a full dozen protesters, but three weeks later, demonstrations are popping up all over the country. and some of the most powerful labor unions are joining in. the goal, the exact goal is sort of unclear, but the message is angry and folks say

harry reid, says he plans to bring that to the floor next week. rfk stadium is 50 years old and some dc residents are hoping some day the washington redskins will return home to a new rfk right here in d.c. the issue came up this afternoon as district leaders met to talk about plans to commemorate the 50th anniversary. >> the future would be that this stadium would be demolished and build a brand- new stadium on this site, retractable roof for the redskins. >> you think the redskins ever come back to d.c.? >> i hope so. that is anybody that is from this area would hope that. >> yeah, it would be nice. mayor vince gray declined to talk about whether or not there are talks underway about the redskins returning to any new and improved rfk stadium, which would be not yet on the drawing board. >> no. >> all right. would be nice. >> it would be. now top, this is the kind of weather we've been talking about for the last couple of weeks that we should have had. >> we earned it over the
