gadhafi is dead. many in libya are celebrating. bloody images on the tv show moammar gadhafi captured a-- alive. they pushed the former dictator against the side. now, rebels took video and photographs after killing gadhafi to prove he is dead. and they fired shots at the air. and people celebrated on the streets of tripoli to mark the end of 42 years. >> the new government is consolidating the control over the country. and one of the world's longest serving dictators is no more. >> reporter: the obama administration has spent about $135 million to help launch the

government. the u.s. also participated in the nato bombing operation when the rebellion began. when they fell on august, gadhafi disappeared. >> the libyan people, they now have a great responsibility. and to build an inclusive and tolerant and democratic libya that stands as the ultimate review to gadhafi's dictatorship. >> reporter: revolutionary forces still need to deal with fighters that remain loyal in the former leader, but without gadhafi, they have seen an easier path to the future. and today, president obama called on libyans to work with the international community to help secure the country's future. at the white house, back to you. >> and there are americans who have waited decades for this day. bruce leshan has been talking to some of them. >> reporter: in the lonely corner of the national cemetery, they will rise in

and the pain that we have gone through. >> reporter: and it is a shrine to the daughter's memory. but we spoke to her by phone in hawaii. >> we were comprised of her beautiful life, but she is with us in spirit. >> reporter: she rejoiced at the news of gadhafi's death. >> relieved and -- relieved and just a prayer that there won't be another gadhafi. >> reporter: but they still worry about libya's future. bruce leshan, 9news now. >> well now, four other top stories, the couple that held their own children captive. a bristol couple is undergoing drug treatment therapy inside the county jail. today, they plead guilty to three counts of felony child abuse. >> it is clear, you know, that it is a drug induced neglect. >> reporter: and it is now clear to prosecutors that they are guilty of felony child abuse today. and the two admitted to

trapping moore's three young girls, ages 4, 2, and just 4 months old in an upstairs bedroom inside this bristol home while they went on a drug induced binge. it's unclear if this mother will get it back. this is the second time that she has lost children to neglect. court records show that it in 2005, christina moore lost her then 2-year-old boy after they were found wandering near the dumfries landfill while she laid passed out in a trailer nearby. >> she should not have that. >> reporter: sentencing will be in january. 9news now. >> reporter: court has adjourned for the day, the trial of the montgomery elementary student, accused of physically abusing six of their students. she lost her job in silver spring when the charges surfaced back in january. well on the stand in her own defense, burke painted an unflattering portrait of the

young accusers, describing them as troublemakers and a class clown. they both testified that burke did not always tell the truth. closing arguments will be presented tomorrow morning and then the case will go to the jury. so is it ad cold or is it allergies? one way to find out for sure, take an allergy test. it's a pretty simple procedure that a nurse or doctor uses tiny pin breaks to place drops of different aler gins directly on the skin. aler gins like mold, weeds, even dust mites. and then they will look for the reaction. it takes about 20 minutes to develop. >> after determining the patient's particular allergy, doctors can then plot a course of treatment. well, temperatures are pretty dramatic. allergy season cannot still be going on? >> well, it is on the way. no doubt about that. it fell off the charts.

let's talk about the wind, they are still gusting up to 22 downtown. 18 up here in frederick and leesburg. look at oakland. the 31 miles per hour wind gust. temperaturewise, it's 36 in oakland. everybody else in the 50s and 58 downtown, 55 in gaithersburg. 57 in manassas. for tonight, skies will return partly cloudy, breezy and chilly. lows in the 40s, even downtown in the upper 40s. now, we'll come back and show you if they will be with us tomorrow and look ahead to the weekend. >> well, just ahead, details on the jail inmate's mistaken release.

new tonight, more than 2 million taxpayers, including prisoners collected billions of dollars in college tax credits last year. federal investigators released a report today saying that the actual amount was $3.2 billion worth. and now the program in question is called the american opportunity tax credit that was created by president obama's 20209 stimulus plan that provides students with the tax credits up to $2,500 annually

as long as the families don't make too much money. they released a statement saying that the report substantially overstated the wrongly paid tax credit. and now the columbus zoo is caring for the six survivors from the private farm in gainesville, ohio. the animals are being evaluated and they are doing pretty well. they are eating, they are active. they said that their owner released about 56 exotic animals including the lions, tigers, bears, shooting and killing one of them. and the own animal attacked his body, but that no one else, officers still have not found one of thompson's monkeys and the sheriff believes that one of the big cats, they may have eaten it. well, topper is back with your full forecast right after the break. plus, helpful folks who are facing foreclosures. çñ

mor gauge rates remain unchanged. they report the average rate is 4.11%, slightly down from 4.12% last week. the low rates have not done much to revive the lagging housing market. as a matter of fact, sales of new homes are on pace to finish at one of the lowest levels ever. well, we got a glimpse at one of the country's biggest lenders and how they are handling the foreclosure crisis around here. wells far duo wants to modify as many loans as they can for people in trouble. scott broom reports that the

odds are only about one out of four. but it is clearly worth a shot. in our region alone, they've got 16,000 people who look like they are potentially on their way to foreclosure. all 16,000 were sent mailers to come here to the convention hall at national harbor and to try to work out new terms this week. >> and i was reluctant to come. >> that is jesse ferguson and their wife who noticed right away that boxes of tissues on every desk with all of that here this fall. >> and they had, well, hip replacement. >> reporter: they are trying to save this. the house that he has been paying on since 1970. >> we are taking out loans for kids and everything as you are looking around, refinancing on it. some things that are thrown out there. >> and you can change the

interest rate and the extent of the loan. >> reporter: she says that the company is trying to qualify the struggling customers for workout -- for the workouts. they could get payments down to about 36% of the gross that the family has coming in, wells fargo will try to make a deal. >> there is no value to us in taking someone home. >> they needed to change. >> reporter: they were moved from a loan at over 6% down to 4.25 with a new 30-year term saving about $300 a month. this time, the tissues, they work for tears of relief. >> i will tell anyone to come to your mortgage people here and, see what they could do for you. >> so they have some breathing room and the bank is happy too. in fact, wells fargo has a delinquency in foreclosure rates that are well below the national average. in capitol heights, scott broom, 9news now. and wells fargo will continue the event for another day for customers in distress at the convention center at

national harbor. the senate took a final vote today to correct some type of graphic cal error in the legislation. and ten states from maryland to massachusetts, performing the electric vehicle. they will be trapping vehicles in the clean energy infrastructure. for now taking a look at the other top stories in virginia and richmond, the deputy sheriff has been fired because of an inmate that was mistakingly let go. the sheriff says that the deputy did not follow procedure. another employee was us pended as well. and down here, a middle school security officer used pepper spray to break up a food fight and now, well now the school is investigating as to whether or not that was excessive force. 37 students claimed they were injured in some way by that pepper spray. they put out the call for help last night and 9news now

and many around this community answer that call. our peggy fox with the uplifting updates for you. >> now it is bright again. >> reporter: the color slowly coming back. all day long, people have been ringing in bags of food to help replenish the food pantry. >> this is america. no one should go hungry. they had to temporarily close when they ran out of food on monday. >> that's why i came. i couldn't imagine being a mother. >> reporter: they are giving away produce, but not meats, cereal, canned foods that people depend on. >> yes, that's sad because you know, now you don't even have the backbone, if you're hungry, you're hungry. >> reporter: they know what it is like to be hungry. >> i slept in this and my kids

slept in that. now he focuses on the car washing job. his wife has a full-time job, but they still depend on the food pantry. >> i want to give back and in this area alone, you've got to make over $25 an hour. that's if you want the two bedroom apartment and have food in it. if you're not getting that, you should. >> in just two days they have received about 12,000 pounds of donated food and $55,000 including a $5,000 grant. they will open their doors tuesday at 1:00. in dumfries, peggy fox, 9news

now. >> it's so much out there. and something uplifting and positive. very cool stuff. now, our weather forecast is looking chilly, but the weekend is coming and that looks better. >> yeah, each weekend, it will be nice. it's getting a little cooler, but they will be working their way through october out here. it's all good. we'll start with the fall color. this is the weekend no doubt to go after skyline drive. i mean, even in our suburbs, thecolors are getting pretty good. we are talking about that out here and all that stuff, the good stuff out there in the area. now, if you jumped the divide, you're kind of passing it once you get into oakland and garrett county. all right, temperatures, 58 downtown, 65 in gaithersburg. 65 in manassas. temperatures in and of themselves. not too bad. it will make it feel a little cool. you jump the divide, it's 36 for our friends in oakland. winds are still gusting

downtown. 18 miles per hour wind gusts in frederick, but they are better and not as strong as they were during the day. with the wind gusts over 30 miles per hour. satellite picture radar combined, here is the storm sitting and spinning. and they have produced that wind we showed you earlier in chicago, cracking up boats. well we are now looking at ohio and western p.a. and some of the showers could get into western sections of garrett county. a couple snowflakes fell down there today. as far as the clouds with us right now, we will eventually go out at the scene, we'll be in pretty good shape. turning cooler tonight, still breezy tonight, not windy, but breezy. chilly overnight, cool, but nice on friday. and they will be crisp for high school football, which means to grab a sweatshirt in the 50s during the game. now for tonight, becoming partly cloudy, lows in the 40s. winds are southwest and manageable 10 to 15 miles per hour. and so even downtown, we're thinking upper 40s tonight and in the burbs, the mid-40s. 45 in gaithersburg, 49 in arlington, 48 downtown, but 47 in college park and bowie, and

49 at waldorf. this is a far cry from our 60s. they will be held in the 50s past midnight. 46 in reston and 46 in fairfax. sterling at 45. maybe 45 in leesburg and manassas as well. now tomorrow morning, partly cloudy and breezy. temperatures in the 40s and the 50s. we're still going to have the southwest wind, 10 to 15, at least through the morning hours. but by the afternoon, we'll be pretty nice. partly cloudy and cool, yes, but nice. highs around 60. and the winds not much of a factor. winds, only northwest at about 10. so that will feel a little more comfortable for you. highs then on friday, temperatures should make it to 60 everywhere. maybe even 63 in arlington and springfield. but barely 60 in gaithersburg and college park and bowie. maybe low 60s in waldorf, but you get out here in sterling and leesburg, you'll be creeping. we'll say 60 in leesburg and 60 also in manassas. all right, the zone forecast, well, west of the device,

oakland held in the 30s today, we'll put you in the tomorrow. more sunshine, partly sunny. upper 50s for hikerstown and -- hagerstown and culpepper. but again, warrenton and manassas, they will be struggling to get to 60. but without the wind, you will feel quite nice. downtown 61, 61 in gaithersburg, low 60s as you go into southern maryland. that's waldorf all the way up here. and the winds will be strong enough on the bay right up potomac for the small craft advisory through friday. we'll break it down for you. 40s to start, partly cloudy, 65 by noon. 58 to 63 under partly to mostly sunny skies. pretty nice day. the next three days, saturday, fantastic. 62, a little chilly for the walk, but we'll see you out there at 10:00. 9th and madison on the mall. great on sunday. 65 with sunshine. all right, next seven days, monday, there's a cold front that will be approaching. we're going to put some clouds in and maybe a shower. it's not exactly a rainmaker or

a potent system, but a little lower for the temperatures down there briefly, then back up to the mid-60s by tuesday. derek, look at this, a nice little treat. low 70s on wednesday and mid- 70s on thursday. >> that is a treat. not bad at all. well you know in this world of photo shop and online scams, it's not always easy to tell what's fake and what's for real. you just never know. but the researchers say that this looks genuine. and do you know what that is, top? it's an albino shark with one eye in the middle there. do you see that? it is just freakish. this is sliced from the belly of the pregnant dusty shark, caught over the summer. the commercial fishermen in the gulf of california. now, the shark researchers have taken a look at it, kind of preserved as you can see, they say that it is made of functional optical tissues. they also say, however, that they would not have survived outside the womb, but how do they know? >> it would be verying strange. >> very strange. we want to hear what you
