need the umbrellas more than likely tonight and on thursday. here's the day planner, temperatures this morning in town in the 50s. some 40s in the bushes, a late shower 5:00 68 with highs today upper 60s to lower 70s. more than likely the bulk of the showers will hold off after dark and on thursday as well. we're watching the moisture this morning up in ohio and pennsylvania and trailing back to kentucky and western tennessee. that's why for the afternoon we have to be concerned for a shower or two in a couple of spots. leesburg right now down to 48. manassas and culpeper in the mid 40s. la plata is 54. 57 for our friends down in southern maryland and up north, we have a 52 in hagerstown. and look at cumberland. all the way down to 41. to in spite of cloud cover some sunshine today. anywhere from the upper 60s up in order to 70 in -- north to 70 in town.

jurors will be allowed the see once testimony begins. 9news now reporter surae chinn is live outside the courthouse with more on the story in rockville. good morning. >> reporter: good morning andrea, good morning mike. yes, we are standing in front of the montgomery county circuit courthouse in rockville where the trial is expected to begin but first we have to get through jury selection, but according to the judge, it should be fairly quickly. but everything happening through those doors inside this building here in rockville. the judge saying it should only take about 30 minutes this morning to set the stage for opening statements. it's taken two days for jurors to be whittled down from 300 to 65. jayna murray was bludgeons to death back in march inside the yoga store after catching her co-worker allegedly stealing clothes. the accused her co-worker, 29- year-old brittany norwood now stands trial in her murder. friends of murray have been coming to the courthouse this week.

>> she was life with an open arms -- she lived life with an open arm you know. she embraced everybody and loved what she did and did what she loved. she was full of joy and i want to celebrate her life and carry on her legacy. >> reporter: 12 jurors and five alternates should be seated by late this morning. they've all been asked to arrive here around 9:30 this morning. the trial meanwhile is expected to last through next week. mike, andrea? >> the prosecutor wanted to show a number of very graphic pictures before the trial even started to the jurors. talk more about the judge's decision to only allow a few pictures to be shown. >> reporter: well, that's right. it was highly contested especially from the defense saying that these pictures are too emotional. that they were shown during opening statements that it would be prejudicial and too emotional and too distracting

but in the end the judge did allow a limited number, four photos including closeups of jayna murray part of her skull, her hand. and also one that shows her still alive. so it will be interesting today to find out exactly these pictures, to see them firsthand. back to you andrea. >> surae chinn reporting live from outside the montgomery county courthouse. two people are now in custody facing charges in last week's murder on the metro bus in southeast washington. police in orlando, florida arrested the suspects tuesday. d. c. police were searching for the men caught on surveillance video boarding the bus. the victim was 22-year-old demetrius thompson. he was shot just after midnight last thursday in the 2300 block of alabama avenue. those surveillance pictures eventually led to the arrests. keeping teenagers safe on the streets in montgomery county is the goal but should it be done with a curfew or an

anti-loitering measure? county lawmakers are at odds over which one to choose. two members proposed the antiloitering option as an alternative to a curfew proposed by ike leggett. they feel the antiloitering ordinance is less likely to lead to age or racial profiling. >> it should be based on behavior, not age and that's what the executive says he's trying the get at. this is a much better way to get at it. >> how much a spokesperson for ike leggett released a statement saying quote -- is similar law was taken off the books in 2006. a commission set up by the general assembly is recommending the state's gas tax be raised 15 cents a gallon and that's not all. the commission also suggests doubling the cost of emission

inspections, increasing car registration fees, and hiking m. a. r. c. and commuter bus fees all to help offset the shortfalls in maryland in transportation funds. 5:06. >> and jessica doyle is here with today's headlines, wall street, wow, not good. >> not good at all and more red arrows again this morning. some stocks down in asia overnight. europe though is making some small gains this morning and investors facing down major head winds today with worries about corporate profits and the economy here and the debt crisis in europe. these factors combined to spark a selloff on wall street with the dow which had gained more than 400 points in three trading sessions giving back half the gains. checking the numbers this morning --

here's another head wind today. shares of amazon are sharply lower ahead of the opening bell on wall street after the close it reported third quarter net income sank 73% despite sales growth as the online retailer spent more money to grow its business. but there's good news for investors on the ereader front. preorders for the kindle fire tablet have been so high. what a difference three months have made at netflix and not in a good way. remember back in july before deading to raise prices by as much as 60% and splitting up the services? the stock was trading at about $300 a share. as of yesterday. try $75 a share. and it dropped 35% alone yesterday. >> wow. >> after revealing that netflix had lost more subscribers -- we're talking about 800,000 since july and they expect more defections in the coming months

making news now at 5:10. police fired tear gas at "occupy wall street" protestors in oakland, california. dozens were arrested. some went peacefully but officers grabbed others kicking and screaming trying to stay there. overnight the clashes came hours after police dismantled the protestors' camp site near city hall. the united mine workers union says the masse energy company is guilty of quote industrial homicide. in a new report the umw claims masse knew about and allowed dangerous conditions to exist leading up to the explosion that killed 29 west virginia coal miners last year. no comment yet from masse's new owner. remember joe the plumber the 2008 presidential campaign questioning then-candidate obama's commitment to business? well, he's back. joe's real name samuel wurzelbacher and he's running for congress in ohio's ninth district. he's running as a republican

by then with a mid-afternoon high right around the 70-degree mark. this morning 57 down south in southern maryland. tappahannock is 50. richmond is 49 the morning. to the west, culpeper 56. cumberland 41 degrees but generally a southwesterly winds and that's going to keep us mild today. reagan national's at 54 be a south southwesterly winds at 10 and that dew point sitting at 44 degrees. much colder air not just in canada now but from denver north through the rockies. 20s and 30s and there's actually quite a snowstorm raging in and around the denver area. they had 80-degrees for a record high a couple of days ago. this morning, some of the forecasts just north of denver call for as much as a foot of snow and maybe 2 feet in the mountains to their west. it is snowing in the mile-high city this morning and it's headed east. for us we've got the showers this morning from new york and pennsylvania back through the ohio valley. that's moving east and i do think we're going to seal a few of the showers actually survive

the trip across the mountains later this afternoon and this evening. middle of the day mostly cloudy. isolated sprinkle in the mountains. as we go through the afternoon and evening hours look how the rain showers head out of west virginia and into virginia. this is by 7:00. so we may get through much of the daylight part of the day dry but by this evening a few showers. tomorrow morning, some more rain will be approaching the region with a front. front is going to slip through in the afternoon. the mild air will be replaced with the goldier air. that means a couple of snow showers potentially in northern pennsylvania, new york state and the cat skills, western massachusetts. this gets out of here though thursday night. so friday is chillier but see the moisture there? that heads this way for saturday. saturday, we may not get out of the 40s with the chilly rain and i mean mid 40s. today 70 and an isolated shower late. torrent we're going to be into the 50s again. tomorrow we don't recover much. 64. winds are going to pick up out of the northwest late in the day. it will turn cold and chilly on

most familiar faces won't be taking the field at all again this season. >> tight end chris cooley, he was trying to overcome lingering knee problems that forced him to miss the entire preseason when he broke his finger october 16th against the eagles. except in 2009, cooley has played in every game of his seven year career all with the redskins. now with more on the nba lockout situation, dave owens and "usa today's" jeff zillgitt. >> we will have an nba season. i can't tell you when it's going to start but at the end of the day there's too much money for both sides to let a full season go by the wayside. >> people are glad to hear that. players get 57% of basketball related revenue right now. how can they justify their stance? >> the one thing dave is they felt they already made concessions, they came down from the 57% to 53%.

which it amounts to about $160 million in annual givebacks from players to owners. the players felt they met owners halfway and that's enough right now. >> when we read the tea leaves, magic number 51%? you think that's going to get it done? >> it will probably be in the neighborhood of 51%, 52% to players, 48%. 49% to owners and that will be enough at the end of day to get a deal done. we're not there yet. >> we're certainly not there yet. so what's got to happen in the next couple of weeks so we don't lose more games? >> owners are going to continue to drive a hard bargain and players are going to have to give up maybe another percentage 2004 of the basketball related -- or two of the basketball related income and maybe do what hockey did. if it's not a good a year, revenues for players are not as high and i think that's the direction we're headed. >> you mentioned hockey and the nhl model. ted leonsis has been on both

upper 60s to low 70s. with more cloud cover and the threat for a shower late today. so you know grab the umbrellas, you probably not going to need it until real late or even after dark if you're going to be out. better chance to see some shores tonight and on thursday. lot of moisture oftest knot and west this -- off to the north and west this morning back dun into kentucky and even missouri. the showers are all moving east. sometimes what you see this stuff gets squeezed out hitting the mountains of the appalachians and doesn't survive. i think a couple of those will make the trip east through the later afternoon hours and this evening. this morning i want to point out we're in the 40s and 50s and in fact low 40s in cumberland. pittsburgh is mid 60s. there's some really mild air. a local look at temperatures, manassas at 45. fredericton to 43 but in hagerstown they're at 53. a lot of information, in fact my intern just told me tell everybody on the green line at southern avenue, there

from tokyo to hong kong. boeing says the carbon composite design of this jet makes it lighter so pitayas less fuel and it's more -- it uses less fuel and more economical to fly. in more serious news, a house committee report finds thousands of banned items have made it through tsa screeners. in addition to the 25,000 banned objects that passed through security check points, they also found at least 17 known terrorists have gotten past tsa screeners. today the prosecution may get to begin its opening statements in the lululemon murder trial but first jury selection needs to be completed. that is expected to happen this morning. brittany norwood is accused of killing jayna murray back in march inside the clothing store where they both worked. 9news now reporter surae chinn is live outside the montgomery county courthouse with moron the story. >> reporter: day one of the trial the expected to happen later on today but first it's been a lengthy process of seating this jury.

we're going into day three now and we are not finalized the jury selection yet. but we have whittled down the pool from 300 to about 65. this is a high-profile case. that at least two-thirds of the pool have heard about. the selected they have to be prepared for the trial to last 10 days. listening to testimony of the brutal beating death of jayna murray inside the upscale yoga shop. on trial is her co-worker brittany norwood who police say staged a cover-up to look as the both were attacked by masked men. the judge haystacken extraordinary -- has taken extraordinary measures to seat the jury. our legal expert jim shalick talks about that. >> reporter: it means the judge may not be excusing jurors for some of the reasons they're giving like i can't pick up my child. i need someone to pick up my child. those kinds of reasons, this

force trauma. huguely's lawyers believe though that love died from an irregular heart beat caused partly by taking the medication adderol and drinking alcohol. the d. c. council has taken unnine bills. a committee will hold a hearing this afternoon on ethics reform which has been a key issue this year with several members facing criticism for ethical lapses, some of the ideas under consideration include tightening requirements, establishing term limits for council members and banning members from holding outside jobs. well, melt row is trying -- metro is trying to reassure montgomery county leaders it's working on the escalator problem at the bethesda station. people watched jealously as riders headed into the station just glided down smoothly on the only working escalator. we took a blood pressure of

to their west. so winter is raring its ugly head out in the rockies this morning. for us we're watching this rain and new york state and pennsylvania. this is going to slide more east and a little southeast and i think some of this will be around at times late this afternoon. we'll call for spotty showers here and there. as we go through the morning, this stuff in pennsylvania and new york fizzles out a little bit then late this afternoon. here we are at 6:00 p.m. you'll see the showers really into west virginia and al couple of stragglers getting into northern virginia. more than likely the showers overnight and then tomorrow morning, stop the clock just before 6:00. on thursday, 5:45, notice the metro north and west dealing with the rain. some of it heavy in western maryland and west virginia. that is with us on and off through the day on thursday. they'll start to sag south late thursday. 6:00, shenandoah valley seeing some clearing as far as the radar is concerned. much cooler friday. friday's highs in the low 50s

and then late friday notice the moisture returning? that rain could be here saturday and hold temperatures saturday in the mid 40s. yeah, a real raw day. today, 70, isolated shower late. tomorrow 64 with the rain showers becoming breezy out of the northwest late. 53 on friday. saturday, a raw damp 45. and then sunday we're back to the low 50s and hey trick-or- treaters looking okay for you. just a little bit on the cool side. speaking of cool, here's monika samtani. thank you so much howard. a look at the big picture first on the metro green line. residual delays as you leave southern avenue heading toward green belt. they had mechanical problems early morning. we're going to zoom into 295 and i'm focusing on the area because there's construction on the southbound side right near malcolm x. avenue and that's causing delays to south capitol street. 19 miles an hour and on the northbound side heading up to the 11th street bridge at 45 miles an hour with construction in place there as well. let's take you live to the 14th street bridge. here's what it looks like

5:57. we're looking at some partly to mostly cloudy skies this morning. 40s and 50s. in fact in some spots, the lower 40s. so you'll need a jacket this morning. and we may just see a sprinkle or two before the day is out. we head toward the 9:00 hour, upper 50s, 60 at annapolis although only 50 in luray and mid 50s from cumberland. we'll be in the mid 60s for lunch so a comfortable lunch hour. partly sunny down south. mostly cloudy north and west. again with that isolated sprinkle. and as we go through the afternoon, we're going to be up to 70 and even low 70s in a couple of spots with the mostly cloudy skies and late this afternoon into this evening we'll be watching some moisture moving out of west virginia. across the region so by 11:00 we're still looking at a few showers and 62 degrees. you'll definitely need the
