murray inside the lululemon shop in bethesda and then lying to investigators about what happened. surae chinn is joining us now from the district court in rockville with the latest on today's events, surae? >> reporter: well, j. c. testimony is going on the right now -- on right now in the courthouse behind me. the detective who interviewed brittany norwood multiple times. the jury now listening to at least 50 minutes of recorded interviews. i have now legal expert jim shalleck joining us now. premedication? >> exactly right. was this a premeditated murder or a spur of the moment outburst where the defense lawyer says she lost it during a fight at the shop? >> reporter: the jury really has to decide is this going to be murder one, murder two, life in prison or 30 years in jail with the chance of parole after

15. >> the jury will never know what the penalties are, the judge will tell them not to consider punishment. however murder one carries is penalty of life without parole. murder two which is not premeditated is up to 30 years but you can be paroled after 15. big difference. >> reporter: the defense really has to overcome premeditation when they have so much evidence stack against them. we're talking about 307 injuries, 107 defensive wounds and eight different weapons, knives, box cutters, a wrench, metals. a lot of things that they have to overcome. >> but don't forget surae, all they need is one juror to say not guilty or it's not premeditated they cannot convict her. one juror. >> reporter: lastly the family. the defense and the victim are sitting in the room right now. they are listening to testimony. but today, someone held up a -- a witness held up socks

station. it happened at the fairfax studios of 106.7 the fan. earlier this morning. phish fish joins us now -- kristin fisher joins us now from fairfax with information on exactly what happened and the ensuing investigation. >> reporter: this all happened around 7:45 this morning. a car was just cruising down main street in fairfax when all of a sudden, the driver swerved and slammed into the studio. >> three to five seconds of like one of the loudest bangs you ever heard. >> reporter: that was a car plowing through the studios of 106.7 the fan. two hours later they want interrupted once again by me trying to get an interview. >> kristin is here with us -- >> she's here with four american heroes. >> this happened early in the morning, what did you all think had happened weapon you heard that?

>> i thought it was lightning. >> lightning? >> but then the building started shaking and frankly i thought we were having another earthquake for a second. >> reporter: turns out it was a honda civic. the driver told police he swerved to avoid a pedestrian but the sports junkies aren't convinced. >> i believe he physical asleep at the -- fell asleep at the wheel. if you actually look at the tire tracks they go straight into the building. >> i believe he's a disgruntled listener and trying to make a statement. >> reporter: the one thing we know for sure is that he wasn't driving drunk. police say alcohol was not a factor but still it's sheer luck that nobody was inside the room when the car burst through the window. what would have happened if somebody would have been actually in there? >> they would have been seriously injured or possibly killed. the car probably hit the building at 30, 30 miles an hour i guess and the only thing between you and the car is a big giant pane of glass. >> reporter: it really is incredible that neither the

driver for anybody inside was injured. but unfortunately, the same cannot be said for their building. you can see they've just got two huge open windows there. it's going to take some time to fix and i can tell you what j. c., the rain is certainly not helping. back to you. >> kristin fisher reporting lye, thank you very much. right now d. c. police are investigating two armed robberies that occurred overnight. the first happened in the 2200 block of minnesota avenue southeast. investigators say that two men took a woman's purse and then ran off. now the second robbery happened at 14th and quincy streets northwest. a police surveillance camera may have captured that robbery. police tell 9news now three men robbed a man at gunpoint. luckily neither victim was injured in those two robberies. and police made another arrest in a string of crimes against metro riders who use the suitland station.

22-year-old michael mcintosh has been charged with a series of armed robberies at the station's parking garage. mcintosh was not the only suspect lurking around the suitlands station because police arrested and charged 30- year-old phillip fleming of district heights with several sexual assaults at the station earlier this month. secretary of state hillary clinton tackled serious questions from lawmakers in her first appearance on capitol hill since returning from the latest trip abroad. danielle nottingham reports that members of a house committee wanted to know about the future of afghanistan and iraq. >> reporter: hillary clinton took the hot seat in front of a house panel ready to face tough questions. she's just returned from a trip through afghanistan and pakistan and lawmakers want to know what comes next. >> we still face a difficult fight but coalition and afghan forces have reversed the taliban momentum in key areas. >> reporter: some members of

congress are upset over recent remarks from hamid karzai just days after a face-to-face meeting with secretary clinton. he said if the u.s. and pakistan ended up at war with one another, his country would back pakistan. that has lawmakers from both parties thinking it's time to stop committing american lives and dollars to fight there. >> too much american blood and treasure have been invested in afghanistan for us to walk away or to have a government that threatens american interests. >> reporter: right now, about 98,000 troops are in afghanistan. and the current strategy calls for most of them to come home by 2015. u.s. forces in iraq will pack up and pull out by the end of this year. president obama made the announcement last week saying it's time for american diplomats to take the lead there. the secretary also outlined a plan to reach out to iranians through a virtual embassy.

the state department is working on a special web it is that will have information -- website that will have information. danielle nottingham, cbs news, washington. the virtual embassy doesn't mean the united states will open an actual embassy inside iran. the two countries broke off formal diplomatic ties in 1980 when iranian revolutionaries took over the u.s. embassy and cap churned more than 60 -- captured more than 60 americans and hold them hostage over a year. still to come on 9news now at noon, work on a new museum honoring our fighting men and women just got off the ground. we'll tell you all about it. and the wife of bernie madoff shares details of her husband's suicide attempt. that report is going to air sunday night on "60 minutes" but we'll have a preview when we come back. ♪

things and things that i thought they might want. i mailed them. it was christmas eve. it added to the whole depression. we took pills. and woke up the next day. >> ruth madoff says that they took ambien and that the attempt was impulsive. but she's glad that they didn't succeed. the entire interview will air this sunday right here on channel 9. what would you do if life as you knew it was totally shattered? how do you pick up the pieces? in 2007, a woman named carmine was left permanently disfigured and nearly killed by her estranged husband. he attacked her with a baseball bat and then he poured lye over her face. well, she is now waiting to be approved for a face transplant. she made a special appearance

some vintage military muscle will grace the scenic landscape of prince william county. organizers of the americans and wartime museum broke ground yesterday for their new facility. the museum will tell the story

of americans in combat from world war i to the present. and organizers say they are especially proud of their plans for an outdoor exhibit. >> we think it's very important that our youth, the generations to come, understand the experiences and the values demonstrated by those who have received our country. -- served our country. >> the museum is set to open on veterans' day, 2014. we have a quick note that we want to tell parents about. students who attend fort smallwood elementary school in anne arundel county. the students are going to be dismissed in about 10 minutes because they have a power outage there. >> for smallwood. >> yes, bge is working to restore the power apparently a car ran into a utility pole and classes hopefully will resume tomorrow. okay? >> that must have been exciting at the school. for lunch hour. >> yeah but what about the

participants? >> that's going to be a little bit of a mess but they'll get there. we'll be okay too. we've got some showers arnold right now. had a steady rain the last few hours. that's going to break up in more showers in the afternoon and then we're going to get colder much colder. in fact by tomorrow morning areas to the north might want to put the plants away. here's a look we start with the freeze watch and get to doppler in a moment but freeze watch up north near the pennsylvania border and mt. mountains -- in the mountains of west virginia. the dark blue areas, charlestown, hagerstown to myersville and frederick and westminster. north of that in pennsylvania a freeze warning is in effect. our day planner calling for spotty showers for the rest of the afternoon. 64, 65 for a high. the late afternoon and evening winds are going to shift behind a front that will clear us out a little bit. we'll go partly cloudy tonight and temperatures by 9:00 low 50s. by tomorrow morning, low 40s 234 town with mid 30s in many of the suburbs and closer to freezing up north where the freeze watch is in effect.

look at this on the radars how everything has been moving from west to east. things not as intense but we still have some rain around generally light rain out there but lots of breaks and upper montgomery and northern loudoun county out through areas in fauquier county south of 66. here from d. c. points east, well, light to occasionally moderate showers and even into southern maryland the eastern shore. howard county, you're also starting to clear out some. we'll take you up north here, the lower part of montgomery county silver spring, bethesda, up 29 and up to columbia, we still have showers going to laurel, beltsville and prince george's county. down to the south, the southern prince george's county, western charles now but this is moving east. you guys in southern maryland still have to deal with this. woodbridge down to quantico but that will break up as it moves to the east. to the west, some spotty showers here. that will be headed back to fairfax county. 61 in town and 60 in hagerstown. 68 though in fredericksburg and some 70s down in richmond with lots of upper 50s and low 60 ad

scattered across the board right now. annapolis 64 with 61 here. light rain showers south winds at 6 and the dew point at 57. lots of cold air in the rockies, this is going to be moving east and a storm system heads this way saturday. going to be a close call. there will be some rain with it. maybe some wet snow north and west of d. c.. but temperatures should be too warm for any accumulations and i don't think it's going to snow heavily enough. kind of a novelty wet snow mix. 65 today. tomorrow, 52. as we head to saturday a cold day with the rain and again some wet snow north and west as temperatures hold in the 40s and that 46 may be warm as we head to sunday though looking a lot better with temperatures then recovering into the lower 50s. could be a rough afternoon in college park. faith winier is here from the prince george's county spca and she's got joker. and joker is a little timid. >> a little shy. >> he's a good boy though. saying hi to joke in the green room and joker is a healthy

she's the editor of the new penguin anthology of 20th century america poetry. this anthology is a must-have for your library if you like poetry and you like to really evaluate how this country has changed over a 100 year period. quite an undertaking. >> it was. but it was an undertaking filled with joy and discoveries. and recoveries. so that was -- it was wonderful thing to do. >> it is featuring poets such as wallace stevens, t. s. elliot, robert hayden, how did you decide who to put in and not to put in? >> the who to put in. like being in a candy store for me. i want me a little bit of frost and bishop. so that's how it began and then came the winnowing process because 100 years of poetry in

such a compact volume is not easy to do. but also poems that spoke to the century. you know it came out of life so that you could go and say oh, the '20s. that's what it was like to live in the '20s and that's how i proceeded. >> the poetry does tell you a lot about the times and even though they are old, the old is new right? >> they never get old in a funny way. you know and a poem by alice dunbar nelson. i sit in soap. written in 1920s. i sit why men are going out and dying in the battlefields. that could be happening now. they never die or get old. >> how are you doing after putting this together? my goodness, that took four years offerer life. how are -- of your life. how are you doing? you're a professor at the university of virginia. >> i teach creative writing and poetry which i love to do. i love to be in contact with the young people writing poetry
