county was charged with involuntary manslaughter and felony murder but this case rose to that level. the defense disagreed and they might appeal. if not, sentencing will be this coming february. reporting live in prince william county, back to you. >> thank you for that. a tough day for the prosecution in the trial of brittany norwood accused of killing jayna murray. >> evidence that might have helped the prosecution establish motive was ruled inadmissible by the judge. we are live from rockville with more on that trial. >> reporter: the bulk of the testimony involved blood splatter and dna evidence. one of the most striking moments of the day took place before testimony even began. a significant defeat for the prosecution when judge robert greenberg ruled that evidence pointing to norwood's possible motive would be inadmissible. victim jayna murray allegedly caught and confronted norwood

trying to steal clothing from the store ours before the attack. murray allegedly called the manager who said norwood would be fired the next day. but the jury will not hear any of that. state state's attorney john mccarthy, the judge is effectively silencing the voice of the victim. referring to murray's call with the manager, the judge responded that is rank hearsay. also today blood splatter analyst william vosburgh testified the greatest volume of blood flew off murray's body near the floor and under a bookcase. he testified murray wasn't in a standing position for long because the bottom of her tennis shoes had little blood on them indicating she didn't walk around the bloody floor. the defense, you would call it a quick time line. dr. vosburgh, yes. that was significant because the prosecution has been trying to prove that the 20 to 30

minute attack pointed to premeditation. now people on facebook and twitter are riled up about the judge's ruling not to allow testimony related to a potential motive of theft. let's bring in the legal analyst jeannie cho for more on that. damaging to the prosecutor. >> yes so. the prosecution said, yes, judge, are taking away the voice of the victim and the judge correctly but strongly said this is rank hearsay. that is, in fact, the state of the law. our rules of evidence don't permit that system to be admitted. >> reporter: why is that? we could hear testimony from the other end of that phone call, from the coworker and from the manager that received the call. >> but there is no way for the defense to probe and attack and question the validity, veracity of those statements because in fact the victim's word and they died with her. >> reporter: interesting.

a lot was made about the potential speed of the attack. the defense would like to say that it was quick, swift were the words of the defense lawyer. the prosecution is describing it as prolonged. why is that significant in terms of proving premed expectation. >> because premeditation is what was on your mind and what was the defendant thinking before she committed the murder. everything in this case is about how long did it take. the longer it takes, the better it is for the prosecution. the shorter the time the more it is credible and believable that she just lost it which makes it second-degree murder and not first. >> we will be talking more about the defense strategy that jeannie calls brilliant. she just lost it. we will talk about another significant finding, dna evidence of jayna murray's finger nail clipping, only her own dna. why is that significant? we will tell you at 6:00. >> amazing stuff. a great legal lesson for all of

us. thank you. we should mention andrea has been updating the latest from the courtroom throughout the day on facebook and twitter. follow her and all the developments in the lululemon murder trial by logging on to wusa9.com. a car crashes into a yard and bursts into flames and police find the driver shot behind the wheel i. happened at 17th and monroe in northeast. the man who lives there says the car came crashing through the fence then caught fire. police say the driver was shot before he crashed. he is in the hospital with critical injuries. police don't know why this happened or what was behind it. three workers had to be pulled to safety after their scaffolding gave way this morning. the men dangled about 100 feet in the air until help arrived. this was at an office building in the 6,000 block of montrose road in rockville. none of the men were hurt. it appears the scaffolding

motor failed. a congressional report out today finds sulaimon brown was not directly promised a city job. the report finds brown received money from people with ties to the 2010 gray campaign but found no concrete evidence that supports brown's allegations that he was promised a job for attacking adrian fenty. there was circumstantial evidence to support the claim. mayor gray denied any knowledge of this. herman cain is denying allegations he sexually harassed two former he female employees. anonymous sources told politico it happened in the '90s when cain was the head of the national restaurant association. tara mergener reports an investigation turned up no evidence to support those two women's claims. >> i was falsely accused of sexual harassment. >> reporter: cain called the allegations a witch hunt and

distracted from a campaign swing to promote the 9-9-9 tax plan. >> it's a bold idea and a bold plan. america can't wait. >> reporter: cain is coming under more scrutiny now that he is leading the polls. he is just ahead of mitt romney in iowa. during a visit to a washington, d.c. think tank, he gave credit to the grass roots movement that is supporting him. >> this flavor of the week is now the flavor of the month and it still tastes good. >> the national restaurant association released a statement saying it would not comment on any of the allegations saying they were personnel issues that allegedly took place nearly 15 years ago. sky 9 flew over st. mary's college in maryland where students ship came in literally. hundreds of students have been in and out of temporary housing since mold was found in the

dorms three weeks ago. today was supposed to be the day they moved into their new home, a cruise ship. but kristin fisher reports that ship is still empty at this hour. >> reporter: say hello to the sea voyager, a 300-foot long cruise ship with a crew of 22. today it's being converted into a floating residence hall. >> it will be awesome, i think. >> reporter: caitlin is one of the 240 students who will get to live on the sea voyager at the same time that crews are cleaning out the mold from her old dorm on campus. >> we are excited about cruise ship parties. >> reporter: the students will have the run of the ship with access to the ball rooms, decks, wireless internet and satellite tv. >> they will have something they don't have now, twice a week linen service done by the ship. >> reporter: it's close to being the dream college dorm but the rooms are small and security will be tight. >> despite the fact that the

ship is docked. every oceangoing feature is in place and students have to comply with it. no one gets on and off the boat without proper identification. >> these students were supposed to move in today. then the coast guard found a problem with the way that the ship is docked to the pier. now it will likely be at least 24 more hours before the students can move on board. >> stressful moving. >> reporter: it's yet another delay for students who have had to move two times in two weeks. they are frustrated but hopeful that the wait will be worth it. >> what you are looking at me now, until the bridge was built in the 1930s, this is the way they got here. it reminds us of our roots. >> reporter: kristen fisher, 4 news now. >> the total cost of renting out the cruise ship is $1.5 million, almost exactly what it was to put up the students in hotel rooms. at least that way they were right on campus. the parking restrictions

the mchenry and key bridge in baltimore. the good news, slight discounts for drivers that use their maryland easy pass. millions of folks are without power up in the northeast after the october storm that may have dumped a couple of inches in your neighborhood dumped more than two feet of snow in some places. >> that snowstorm is blamed for at least 12 deaths from accidents and falling trees and electro cush chons. ron dale -- electrocushions. randall pinkston reports. >> reporter: at the height of the storm, some residents say it sounded like a war zone with limbs snapping. one family in the house behind help decided to move downstairs. good thing they did. crews are hard at work in northern new jersey. using chainsaws to clear trees that have fallen on homes, yards and power lines. more than 2 million people from maryland to maine are without power two days after the

unusual fall snowstorm. >> the way things look, it will be a couple of weeks before we are caught up. there are trees down everywhere. >> reporter: there were close calls. >> all of a sudden, there was a noise and the house shook. >> reporter: it shook from the two trees that fell on this home. a branch pierced through the ceiling of their home office. >> scary. >> the house went like this. >> reporter: in many neighborhoods in new jersey, the first snowfall of the season caused more damage than hurricane irene. this brand-new home will require major repairs after a 100-foot tree fell on top of it. we have trees down all across the northern part of the state that have taken wires down both supply wires, transmission lines and lines directly to homes. >> reporter: it's the same situation in parts of massachusetts and connecticut where crews are trying to repair sagging or severed power lines. >> it looks kind of like what i think a war zone would look like. >> hundreds of thousands of residents may not get their

power back until the end of the week. >> reporter: tree removal services say they have customers backed up for weeks. it will take time before the damage from the october snowstorm is all cleared away. in upper saddle river, new jersey, randall pinkston, back to you, leslie. >> that snow created a travel nightmare. airline passengers were stranded more than seven hours. 23 flights were diverted to hartford included six jet blue flights. passengers say bathrooms became backed up. it was hard to breath and the pilots were frustrated. >> they are filled. totally filled. no one can go in any more. you have to hold it. >> bathrooms are locked. people are upset. >> all right. jeff blew is apologizing saying that the power outages at the airport compounded the situation. the department of transportation is investigating. topper, the roads are still dangerous in parts of

massachusetts and connecticut that they have pushed off halloween for a week. >> you know it's bad then. >> you know how lucky we were. imagine if it was 1500 miles south, we would be dealing with the same things. our friends to the west got 3 to 6 inches but downtown we were lucky. now, a different story in south florida. it's been raining in miami the last week or so. extensive flooding across most of miami. it has a hard time percolating into the soil but unusual for them to have this much water. they had a lot of thunderstorms over the past week. central and northern florida have not seen it but they have in south florida. they will get a few showers tonight. they should dry out tomorrow. that's kind of cool -- not cool but crazy walking your trash out to the curb while it's floating. temperatures are cool but pleasant. 54 downtown. costume on, you will be warm.

bank of america is rethinking the new debit card fee that caused so much trouble. boa is reportedly considering dropping that monthly $5 charge for customers who make

purchases with their debit cards. last week jp morgan chase and citibank announced they would not charge their customers a fee. honda said a part shortage from flooding in thailand is forcing it to cut the car and truck production by 50% in the u.s. and canada. the japanese automaker will stop all production in north america on november 11th. honda says the december sale dates of the new version of the popular crv could be delayed by weeks. monday was just starting to recover from the shortages from the japanese earthquake and tsunami in march. she was dubbed by some the sexy spy. anna chapman was busted in new york last year. today the fbi is out with surveillance video they took during the 11 year investigation. one of the tapes shows chapman sitting in a coffee shop allegedly sending out coded messages. other videos show the spy hiding money, handing off

for the ends of the service. sky 4 flew over laurel mall this morning. the washington examiner reports they plan to tear down the mall and build a new town center. the 32-year-old mall has been losing business to columbia and anne arundel mall. demolition should begin in the next three to four weeks. union station's main hall is open for business. it closed friday night after a small piece of plaster fell from the ceiling. it's believed the damage was caused by the august earthquake. crews hung netting from the ceiling to keep any more alaska plaster from coming down. owners of mount washington tavern caused damage from this morning's fire a total loss. the two-alarm fire began at 4:30 this morning. no one was hurt. the tavern is a landmark in the mount washington neighborhood. it has been there 30 years. luckily the owner -- owners plan to rebuild.

>> the taliban released another round of attacks in afghanistan. first an insurgent drove a pickup truck loaded with explosives into a checkpoint. then three insurgents stormed the area, took control of at least one building and touched off a gun battle with afghan and nato forces. it is the taliban's second major assault on foreigners in three days. on saturday a suicide car bomber struck in kabul killing 17 people including a dozen americans. after getting the whole weekend to prepare, prosecutors are questioning the final defense witness at the manslaughter trial of michael jackson's personal doctor. karen brown with the latest. >> reporter: a key defense witness is admitting dr. conrad murray made mistakes on the day michael jackson died. >> i think he should have called 911 sooner. i do not, however, think it would have made any difference

in the out come. prosecutors grilled dr. paul white about the care dr. murray gave his superstar patient. >> have you ever administered propofol in someone's bedroom? >> no, i have not. >> reporter: have you ever heard of anyone doing that prior to the case? >> no, i have not. >> would you walk out of the room and leave them alone with no personnel and no monitoring if you are of the opinion that they like to push propofol themselves, would you walk out of the room in that situation, yes or no. >> i wouldn't, no, i would not leave the room. >> jackson's personal physicians is accused of causing his death. dr. white believes he injected himself with the fatal dose of propofol. but the prosecutors has its own expert that says the defense's theory that jackson could have given himself the drug is crazy scenario. he previously testified that jackson would have been too groggy with the medication he

was on to give himself a shot. prosecutors claim murray gave the singer more propofol than he admits then left him unattended and his recklessness and negligence directly lead to his death. dr. murray is charged with involuntary manslaughter. jurors will likely begin their deliberations later this week. >> if he is convicted, dr. murray faces four years in prison. coming up, students teaching students. how children at two very different all girls schools in our area are learning life lessons from each other. up next, ghouls and goblins aren't the scariest part of trick or treating for kids with allergies.

in tonight's health alert, the president is stepping in to control the drug shortage that reached a crisis. president obama signed an executive order instructing the fda to take immediate action in three key areas, broaden reporting of potential drug shortages, speed up reviews of applications if they need to change the production and make sure to report any possible

monuments. >> the real d.c. >> reporter: this is the excel academy, the city's first all girls public claire tear school. the schools founder. the girls start at age 3. >> i don't think it's just important for our kids to have opportunities here in ward 8. i think it's important for them to be able to experience the riches of the wider washington environment. >> reporter: half the schools inside the excel academy live in the southeast academy. four years ago there were only 134 girls at this school. 410. there is a waiting list of more than 100. roughly 60 stone ridge schools are here every wednesday to tutor, hold hands.
